Make sure you stay on top of your lawyer. Does he specialize in these situations or is he just a general civil cases attorney? You don't want an outclassed lawyer who their counsel will be able to bamboozle on some outlandish technicality.

If these funds never made it your state unclaimed funds account then I should think WF has to legally account for what happened to them.

If they can see that the CD was redeemed, that is a "debit."  Every debit has a corresponding credit.  Can they tell you what the "credit" was??

If the "credit" was a cashier's check (most likely if it wasn't deposited into a checking or savings you have with them) they should be able to see if the check was cleared itself and where it was deposited.

Other than that, I can't make any suggestions...

Wow, I appreciate everyone's support on my problem, I have read each and every one. And thank you all for the enthusiasim you have displayed for my grandkid's lost funds. I have exhausted EVERY avenue in the attempt to collect. And basically Wells Fargo arrogantly says sue us. I have hired an attorney to do just that. Letters have gone back and forth between my lawyer and Wells Fargo's Senior Counsel Herb Leney. Mr. Leney's letter to my lawyer was "The CD is 5 years past Maturity" we asked so what? He cited that Wells Fargo was only federally mandated to reatain records for 5 years. And therefore they say, that Yes the CD existed. And say as well that it was cashed at maturity (which was almost 5 byears to the day they no longer have to retain records) We say, we have the CD unindorsed and unsigned for redemption. They say "The doctrine of laches applies here" Doctrine of Laches is an interesting theory but doesn't hold water. Basically the "Doctrine Of Laches" says that" if you are negligent in time of recovery to recover what is yours, you shall forfiet your rights to recovery" An interesting loop hole that Wells Fargo expects to skate through.

I'm not going to bore anyone any more with my problems with Wells Fargo, other than my grandson was forced to drop out of college (brilliant kid 4.0 grade average) now works for Target Stores. I've written a blog by JimWaldorf2 "Retire Outside The US" What Happens When A Bank says sue us.I really appreciate all the support and suggestions that you folks have given. But Basically if a Bank Hasn't failed and being bailed out by FDIC, when a Bank simply says we won't give you your money, FDIC, OCC, Is Of No Help! Pay the lawyer to recover your own money. Kind of stinks!

Karl, we're getting sick of your stupid paranoid rants and poems. First, it screams of lunacy, and secondly, it DOES NOT HELP THE ORIGINAL POSTER.

OK - two possible issues. It could be Wells' screwup, or let's not let the Nevada State Treasurer off the hook, either, governments screw up and rip people off too, if anything, they do it more often than companies do.

If Wells indeed escheated, they should be able to find proof somewhere of when they sent it to the state. I highly doubt they just took a hundred thousand dollars indiscriminately, that makes no sense.

I don't know WF's internal workings, but at the bank I work for, if I have an account number (and the CD was originally taken out through our bank and not a pre-merger company) I can get an image of all paper transactions that occurred going back 10 years. If electronic there are other ways to find it. They should be able to find this for you.

Good luck. This probably isn't a "ripoff" so much as the left hand not knowing what the right hand is doing, i.e., incompetence and/or poor recordkeeping on someone's part.

Yes. What generally happens is after a period of years, an account that has been left dormant is transferred to the state as unclaimed property. This period of time may vary by state, but its usually somewhere between 3 to 7 years. Now, if you opened the CD and it DID NOT automatic renew, then yes in all likelihood the state of Nevada has it somewhere in their unclaimed property records.  However, if the CD auto renewed, then its possible that it may not have escheated quite yet, and that Wells Fargo may still have it. From what you describe, either case might be at play here. I would just keep contacting both entities till your money turns up. The laws of physics dictates that the money still exists somewhere.

Have hired a lawyer at 220 dollars an hour to collect my own CD. Wells Fargo admits that it existed, but can not show any explaination of what happened to it. Only that the account was closed. question is simple, show us how it was closed. They claim that they have no record to support what their computer is telling them! Will keep you posted.

As of today Sept.4th 2009. Have taken all steps required, which were: Contacting the branch over a year ago. Contacting Wells Fargo's unclaimed accounts in May 2009, they had told me that account had escheated to the state of Nevada. Nevada's Treasury disputed this. Back to Wells Fargo's unclaimed division again in May 2009 Upon recontacting them, tey admitted that they had no record of escheatment to the state, or any record of the C.D. Around June contacted FDIC, they e mailed saying that they have no authority unless the bank has failed, but referred me to U.S. Comptroller's Office. Filed the complaint with the Comptrollers office on July 23rd. to date no response from them, other than a case number that I check occassionally which says "case under review" They did say that someone from the Bank or the Comptroller will contact me within 60 days (we are almost there and still nothing) A real eye opener here is that FDIC has no authority unless the bank has failed. Comptrollers Office states that all they can do is talk to the bank, and that they have no authority should it become a civil matter.. So, in otherwords if the bank failed I would collect from FDIC, But, if the bank simply says we don't have record and they don't want to pay, It's up to me to hire a lawyer to get my own moey. I have the original CD, with bank officer's signature. To date, Wells Fargo can not show me what they have to dispute it...Sounds like I'll have to file suit pretty soon.

I work for a different bank but there may be a few avenues to try... 1) If you are dealing with a teller, tell them you want access to a private banker. Have someone by name at the branch you can discuss this with. If that doesn't work ask for a RVP's (regional Vice president's name) phone number. This will usually be a business cell phone number. If you have a direct person to contact it will be harder for them to ignore your request. Let them do the leg work. 2) If that doesn't work, call the 1800 call center phone number and start by speaking with the third (team leader) or fourth (group leader) supervisor. Explain the situation and DEMAND a resolution no later than 48 business hours. This way they can pull their paperwork. IF they have something showing that the account went dormant and was transferred to the unclaimed propery division, they can pull that paperwork up and fax it to you so you have something to present to the u.c.p. Hopefully this works!

Do as a friend of mine did: He went to the FBI and filed a criminal report that his money was stolen. The FBI went after them. I see you have faxed and emailed, if you want your money bring your documents and go in person with an attorney with an appointment with the VP of the bank where you bought the CD and don't leave until they put the money in your account and utter an apology. Diplomacy and lots of honey will go far, pretend its just an honest mistake, make them your ally, ask them how you can help them solve this error. Don't play the victim be diplomatic, you'll get your money. Of course never give them your original CD. good luck

You have said you have contacted the OCC by E-mail. That may not be the most efficient way to contact them. If you go to occ.gov and click on "Consumer Complaints and Assistance" That will link you to an on-line complaint form that should work better than e-mail. If that does not work call them directly at the Toll-Free Number(above) to where you can hopefully talk to a live person. While I normally don't agree with Karl, he may be on the right track. But start locally. That is with your local news station or paper, a 100K missing account would be news worthy in most local markets. The local ones also tend to be a lot more approachable than national organizations. As a last resort think about consulting a lawyer and filing a suit. However, you need to be sure against who. Because if Wells Fargo did actually turn the account over, you need to go after the State of NV. So you may need to file suit against both parties and let the court figure it out.

After almost a month since my original report on Wells Fargo Bank's lack of ability to honor my Grandchildren's C.D. Actions that have been taken so far are: After first telling me that their fund's had escheated to the state of Nevada, the state of Nevada has denied that action was taken. Have had absolutely Zero response from Wells Fargo, even after forwarding at their request, copy of original 100,000 dollar C.D. Upon contacting FDIC, they did respond promptly and referred me to U.S. Comptrollers Office. On that same date I forwarded my complaint to the Comptroller (around May 25th) By June 5th had heard nothing from the U.S. Comptroller's Office, and forwarded a Second reply. To date have heard nothing (not even courtesy of acknowledgement that I had requested). I appreciate the input that has been expressed by everyone. In the meantime my Grandson has finished his second year at University of California, and has not been able to recieve his money (needed to continue his education).. All I can say is, anyone holding an old C.D. issued by Wells Fargo, may want to attempt to cash it if they can. Really amazing that both the bank and the Government don't appear to find this an issue worth reponding to.

Have contacted Comptroller's office (over a week ago) by e mail. You can never really get to speak with a person. Have searched two state treasurys (unclaimed property divisions) both California and Nevada. Have written a blog on Wells Fargo's blog page. Wells Fargo does not seem to take the matter seriously. When I return to the states, will probably have to hire a lawyer.

They handle consumer issues with banks. You can contact them the following ways. Toll Free: 1-800-613-6743 TDD Number 713-658-0340 FAX: 713-336-4301 Hours: 8 a.m. - 8 p.m., Eastern, Monday-Friday Mail: Customer Assistance Group, 1301 McKinney Street, Suite 3450 Houston, TX 77010 The other way is to go through the Unclaimed Property division of the State. You have said you have done this with NV. If this account was opened in another state, or you have lived in other state(s) it may be with that State's unclaimed property. Basically check EVERY state it COULD be with, and check under your name and if your Grandchildren were on the account under their name also. While the bank is headquarted in CA, you may want to check with the CA unclaimed funds division also. So if you opened it in NV it should go to NV. If it was under your Grandchildren's name and they are in another state you may want to try that State also.

Yes I have the original CD. signed in live ink by an officer of the Meadowwood Mall Reno branch.. Wells Fargo asked to fax that original, which I did on 5-4-2009. I have e mailed FDIC..There response was that this was NOT their department..This REALLY SURPRISED ME ! They did however say that it was the U.S. Comptroller's department. I forwarded copy of FDIC's response to the U.S. Comptroller's office about a week ago (by e mail) still NO RESPONSE.

file a claim with FDIC say your money has beed lost or stolen by the bank certificates of deposit are cover up to 100,000 by the fdic as it is a bank deposit. also if they cant work this out with you call a lawyer and sue the hell out of them as long as you have paperwork showning the original deposit it shouldn't be that hard!
