well the frist response is accurate, be advised that the credibility of the parties is what determines the outcome. If your child is credible, you can certainly win. Of course, supporting evidence makes it more likely you will win. You should check the employee's records for any similar complaints.

I hate to be the bearer of bad news, but.... I honestly don't thnk you would have a case, and here is why. I'm assuming you didn't have any of the following, because I didin't see it mentioned. #1 - You don't seem to have a witness, and #2 - You have no evidence, (i.e. - someone caught it on tae or happened to film it) So the problem you would face is you have no way to prove it and would be in a case of "your word against mine", and therefor you would, unfortunatly not get far iin court. The other thing is that if you werre able to prove it, I'm not sure what you would get as far as a settlement. Certainly the employee would face criminal charges, and woud get fired without question, but you would have to show damages, in other words, was yhour child injured, and how badly.
