In December of 2000 my husband and I needed to purchase a new vehicle. We came across Ugly Duckling as a last resort. Due to lack of "car credit" we were not able to purchase a new car from a reputable company.

We were aware of the possible problems we might be facing, and we thought we covered all of the bases. The manager seemed sympathetic to our situation, and seemed genuinely concerened about helping.

He gave us his word that the car had no major problems(he said the transmission had been rebuilt) and he would fix any mechanical problems present at the time.

There were a couple of leaks, so we wrote down everything that needed to be fixed before signing the contract. The manager gave us a rental car while the car was being fixed and told us that if any problems should arrise that they would be more than willing to fix them at the cost of the parts.

Not long after the air conditioning unit in the car went out. We fixed that on our own. Then the transmission that they claimed was rebuilt started leaking and then the air conditioning fully went out. After being looked at by a mechanic, it turns out that the transmission is original, never having been rebuilt. It will now cost us almost $3000.00 to fix the car.

We have always paid on time. We have paid more than the car is worth. After bringing this to the attention of the new manager, he originally agreed that these things were said to have been fixed. He said that they would work with us and to come back after the weekend, but to call first.

When we called the manager claims now that he never said that he agreed the cars problems were reported as fixed. He now says that they will agree to trade this car in and we will have to be placed on another financed purchase with $1000.00 down. Why in the world would he think we would want to screw ourselves again???

Now we are faced with a voluntary repo being placed on our credit report with possible legal action.

Do I have legal recourse? Can anything be done about this type of legallized criminal activiy? This is fraudulent, they are able to swindle people because they finance their own loans. They take advantage of people in desperate circumstances.
