The Cherry Creek Tree Farms in Brighton, CO is now called Harmony Gardens. I emailed Harmony Gardens and asked about getting some value for the gift card I have. I got a response back from Todd Seufer stating Cherry Creek Tree Farms did go bankrupt and that they purchased the farm in Brighton in October and had nothing to do wiht their business.

Cherry Creek Tree Farms was owned by a different member of the Seufer Family. Seems Shady. Any business owned by this family should probably be avoided.

I went into Cherry Creek Tree Farms to redeem the balance of my landscaping gift card and I was told that they wouldn't honor it since they are in the process of going bankrupt. Here is the letter that they gave me which provided the details(see image1.pdf). They didn't even have the decency to let me know until after I spent over a half-hour shopping. If you talk to the people at Cherry Creek they make it sound like DR Horton is not paying them. However, when I spoke to Bellann Raile (the author of the attached letter) she stated that Cherry Creek got paid when we redeemed our certificate for a gift card (which doesn't expire).

So, for those of us holding gift cards to Cherry Creek we are considered an unsecured creditor - bottom line, we got screwed. Bellann Raile is suppose to send me the court docs for this case. When I get it I'll post it here.

I was able to get a very small fraction of the $1,300 they still owe us... and I am talking small. Apparently they consider any returns you made and applied back to your gift card as money you can still get to - at least that was my case.

If anyone has any luck getting money out of Cherry Creek or DR Horton, please share. Thank you. You can call the number on the letter and talk to Bellann and she'll put your name on a "list" of other pissed off folks that Cherry Creek owes money to.

Any word from CC about what this means to customers under warranty? They just planted two trees for me 2 weeks ago(with Erie Tree Certificate credits -- it should also be noted that the Town of Erie endorses them as a reputable company by listing them as one of the places you can redreem a tree credit).

I understood from them then that because I paid 50% of the price of the tree for them to plant it (no small fee), that the trees would be warranteed for a year... How could they promote this if they knew they were going out of business?

We are in the exact same situation. I spoke with Bellann today, but did not tell her we had the gift card - I just had some other general questions. I will obviously be calling her back tomorrow to follow up on this.

This is just one more thing in a long line of landscaping frustrations!!!!

I just went in the other day too and they for certain gave me the impression it was DRs problem now. Until we got the letter in the mail yesterday. They have about $2,400.00 of our promised money that they have deleted from their records!!! The gal spent 15 minutes looking up my gift card and couldn't even locate anything about us in their computer! We finally got the rest of our yard done and was about to "finish" it up with flowers and such. Wow! what bankruptsy does is affect so many little people it's crazy.

I have not heard anything from Cherry Creek about warranty issues. I expect that as soon as they get rid of their inventory they will be completely shutdown. I do know they are still accepting the Town of Erie's tree certificate while they still have the trees. I agree that the town should take them off their "approved nursery" list.

Bellann told me yesterday 6-3-08 that she would email me the court docs but she did not do it as promised. I wonder if she is promising everyone this???? I went to Cherry creek tree farm on May 6th and picked two large trees and arranged to have them delivered on June 9th. At the time nobody mentioned the issue of receivership. Then I get a call that they are canceling the deal even though I have a Bill of sale / Receipt. We stand to lose about 2300.00 of our original 2500.00

We just got hit with the same thing. We got a $2500 Git certificate from DR Horton, and redeemed it for a Card about two months ago. We went in, bought trees, and they were supposed to be delivered today. When they didn't come, we called Cherry Creek and that was the first we heard of the Bankruptcy

I spoke with Bellann and I too am waiting for these court documents (i just left her a message to follow up on this). The information I did get is that the secured lenders are two banks who stand to take a significant loss on their debt to Cherry Creek Tree Farms so us unsecured creditors are out of luck. She did mention something about a tree farm in Colorado Springs honoring recent gift cards. Unfortunately I am past the 1 year mark but those with recent unused gift cards might look into this.

They are not honoring warrentees. Our tree that was planted on the 18th of May is dead and in fact it was well on its way to death when they planted it. We are trying to go through our credit card company as they give us some buyer protection. They probably were about to go into receivership right around the time we bought our tree - April 26th. They all knew and di not tell the consumer.

We have unused portions of our "gift card" too, and are now out of luck. if anyone has information on the Nursery in Colo Spgs, please share so we can at least use some part of the $600 + we still have on this card.
