I owned a property @ 7th St In Ogden Ut. I was selling it in a few weeks but before I could sell it I needed an updated Pest control servicing.

I called Terminix and sent them out to do a one time service on the property. The called me a short time later and collected my credit card number and charged me $120.00 for the service which I happily paid.

Fast forward 4 months I get a call from a collection agency saying that I was being sued for breach of contract.  Rather shocked at this (Since I never signed a contract) I asked for a copy of it to be mailed to me.

I got the copy a few days later and lo and behold the contract has no where on it my signature at all. Its not even close to my signature. (Mine is easily identifiable)

I contacted their offices in SLC and explained to them that I did not sign the contract nor agree to any charges whatsoever for continues service (Especially since I had sold the property 2 weeks after they went out to do the original service.) After some arguments with them they agree to withdraw their collection attempts as they really had no leg to stand on.

Then 2 days later my card is hit with a $90.00 dollar charge for a quarterly service !!! I called them back and they said that is was for service performed already. I explained the whole contract thing again and they said that it didnt matter who signed it I was still liable for the money. and furthermore they said they weren't going to reverse the credit card.

I asked the person I talked to on the phone how I could be held liable for something someone else signed and he said it happens all the time. At whihc I responded "What If my wife signs a contract with me saying that you guys owe me $500.00 would that be legal?" He exclaimed that I couldn't do that but failed to see the comparison to his point.

Now I have a collection account open, on a contract I never signed, a credit card hit for services I never ordered, on a house i no longer own !!!!
