Yesterday, December 9, 2014, my vehicle was picked up by Avid Recovery and transport at about 5:25pm. The driver allowed me to grab my car seats out of the car but would not give me any information as to why they were repoing my car. All he would say is "call your lein holder".... I don't have a lein holder.

I purchased my vehicle from a reputable dealership in February 2014 and have paid my payments by automatic debit since then. The repo place closed at 6 pm and basically told me there was nothing they could do and that I just needed to call my lein holder again. I called the company I have financing the car which is Capital One Auto Financing and they said that my account was current and in good standing.

I called the police and they came out and said that there wasn't much they could do but that the order was for a man named "John Hall"? I have never heard of this person before. So, because of the time that everything happened there was nothing I could do until today. I have been on the phone back and forth on hold for 30+ minutes with this company TD Auto and nothing has come out of it.

I spoke with a Lauren Nichols and did a conference call with a sales manager at the dealership I bought my car from. Lauren told us that they have a contract with this [John Hall] since 2012 and that he wasn't paying. That they have no record of the car being sold in auction to the Chevy Dealership and that there was nothing they could do because the car was in a contract and it doesn't matter that I had purchased the car and that even the state recognizes that it is my car.

I am not sure what else that can be done, I am a working, single mom of two boys that needs my car to transport them to and from day care and I need to get to and from work. I have no other options, I am looking into legal advice by contacting an attorney but need this handled as quickly as possible.

NOT AGAIN!?!? Two Illegal Repossessions in 6 months!????

 So on December 9, 2014 my car was repossessed by TD Auto Financing - I filed a report here and hired an attorney because it was an ILLEGAL repossession. We settled the matter outside of court.

I was quite happy with how quickly things happened.

 

Fast forward to May 13, 2015 at 3:45 am-- my boyfriend and I were woken by a text and phone call each stating that my car was being repossessed....AGAIN. He told me and I brushed it off as "No, it's just a scam, couldn't happen TWICE!" and he said but it's for your car... I look out my bedroom window... to see my car being DRAGGED out of my driveway by the same repo company as before. He had already removed my car seats and things like that. Due to my previous experience with them I knew there was nothing I could do to rectify the situation at 4am. I had to get my kids to daycare and myself to work by 6am... Wow. Thanks.

 

Anyway. I contacted an attorney and am filing a law suit against the company because this is the SECOND TIME they made a horrible error and left me stranded and risking my job because they canNOT do theirs.

You would think after settling for pain and suffering/reimbursing me from the first time that they would get their stuff right but that would be just too much to expect from this company. It's horrible.

I will say - that I am assuming since they repo company billed them an $80 fee for me to gather the rest of my personal belongings that they looked into it and realized they made the error (let me say it one more time) AGAIN. The company sent over a release form to the repo company and actually had them tow my car directly to my driveway. They know they messed up big time.

 

This company has me in fear now that in another 6 months the same error will be made and they will do this again. I need this situation rectified - I am working with my attorney to make sure this won't happen to me or anyone else again.

 

STAY AWAY FROM TD AUTO FINANCING!!!!

So... my car was repossessed on Tuesday evening which left my children stranded at the daycare until I could arrange for my brother to go pick them up. 

Wednesday I had to call out of work seeing I didn't have transportation and I needed time to try to get things taken care of. Nothing was figured out Wednesday other than TD Auto finance company blaming the dealership for the mistake. The lady I spoke to Ms. Nichols was very nasty about it. I had her on conference call with a sales manager from the dealership and she told us that there was no record of the car being sold at auction and that they had a contract on that car and that the person they had a contract with did not pay so they had every right to repossess...

So I went and got a rental car on Wednesday because I needed to be able to get around without using other people's vehicles. I went to the dealership and spoke to a manager who had been helping me all along - he assured me that he pulled the title on it and that there was no lein ever on my title and that it was clear when they bought it from auction.

Come Thursday, I had to go into work stressing about the situation and unable to do anything about it to get it resolved. As soon as I got off work I called the TD Auto finance company and spoke with a Mr. Walters who was the first person there that seemed to know what they were talking about. He asked me for the last 8 of my VIN as did the lady from Wednesday. I gave him the exact same 8 digit number but lo and behold he has no record of that number in his system....... INTERESTING.

He asks if he can place me on hold because it sounds like a familiar story that he had been working on the day before.. So after quite a while of holding he comes back and says he's going to place me on hold again to discuss something with his manager... So another decent hold time and he comes back and says "my manager doesn't think this is an error on our part BUT we have your VIN number on all our papers except one..." 

Turns out - they made a clerical error and repossessed my car instead of the one that they should have taken. They placed a release order and I had to speed my tail over 30 minutes to make it to the repo place before they closed. The repo company was extremely apologetic and very professional about the situation but this is all on TD Auto Finance company... 

Now my next step is trying to get back what I paid plus the time and stress that it took for this whole situation. I am not exactly sure what would be a fair request but I just wanted to update that we figured out who was at fault and it was definitely the Auto Finance company and not the dealership.

 Think of contracts as a "Who is First" situation. They are partially right in the fact that the vehicle IS under contract BEFORE you had possession of it. I would be contacting the dealership and your bank. Somewhere someone screwed up. Thankfully this screw up is probably on the dealership. As THEY forgot to do some paperwork and it has led to this. I would advise you to contact a lawyer then contact the dealership as THEY the entity that sold the vehicle DID NOT do all that was needed to clear said vehicle for sale. Since this is CLEARLY their fault I would be hitting them up for a "Dealer Loan" or they can get you a rental car. GET A LAWYER!!!! Small fact: EVERY lawyer MUST do pro bono work. A fancy way of saying FOR FREE. Contact some lawyers in your area and maybe contact your local BAR and see if they have a list of lawyers still offering pro bono work.
