I am an employee of Felix Construction Company. In 2002, Felix Construction Company used Human Resource Syergy (HRS) as an employee leasing company. HRS was legally my employer during this period. HRS charged a fee; plus Felix Construction Company paid for all employees wages (including FICA & Employer FUTA & SUTA) to HRS in addition to all administrative fees. HRS then issued paychecks to Felix Construction employees.

In 2003, when employees from Felix Construction Company received Social Security Statements, no benefits were listed from HRS for the 2002 year. This company is no longer in business. Syergy Seven was established by the same director(s). When Syergy Seven was first contacted in August of 2003, I was told that they were late in filing their 941 & W-2 Forms. In July of 2004, Social Security Statements were again received, and showed no benefits from HRS for 2002.

I contacted Brandon Rasor in August 2003. He said that he would call me back, but never did. When I spoke to him again in July of 2004, He said that it's possible that the Employer ID number was incorrect, and he would get back to me. He never did. I also spoke to Micael Barrett, who said that there was nothing that he could do for me. He said that he thought that all paperwork was submitted. When the IRS was contacted, I was told that no 941 form was filed for this year. I was told to contact the Social Security Benefit Administration again.

When I contacted them, they said that there was no information on-file, and that it probably should have been posted in they were submitted over 1.5 years ago. I am not the only personally affected by this. Felix Construction Company alone had 40-50 employees, not to mention all the other organizations that used HRS's services. I was told that I would need to send in copies of 2002 W-2 Forms, and Social Security Administration would credit my account... even though HRS never paid the benefits. These taxes were withheld my check and paid by Felix Construction Company, but never paid to IRS / Social Security Administration.

Did They Say They Would Investigate?

When you forward the information to the IRS and SS Administration, enclose a letter requesting that the investigate this company for tax fraud. They should do so automatically, but it never hurts to request an investigation in writing. You should also check your state's unemployment division to make sure they were covering unemployment insurance, if applicable.
