on Jan 29, 2004 while traveling to work on hwy 67 ( lakeside to el cajon) several rocks came from their ( superior ready mix) and damaged my car. I contacted them ( twice) they claim it could not have happened as they have "chute covers" on their trucks".

I know it happened as i saw the rocks comming out of the top part of the truck, not kicked up from the highway from their tires.

there were several other cars that swerved to avoid the rocks also.

I talked to my mechanic ( Deiter fischer car service) about cost of new windsheild, told him the problem:

He says this happens a lot ( cement trucks from various companies) Mr. fischer told me they rarely pay damages, but do all they can to avoid it.

see what you can do for me and alert others to this.

First of all, professional truck drivers are much safer driver than the average driver. Approximately 75% of accidents involving a car and truck are determined to be caused by the car. Secondly, I know many drivers who are not, as Paul wrote, "a bunch of lazy a*s uneducated truck-driving trailer park trash." I have worked as a paralegal, a police officer and a jailer. I have owned a restaurant and was an independent contractor for Federal Express. I own my own truck and gross $140,000 a year. I own a home near Los Angeles and various other property. I am debt free, drive a new Chevy Suburban and want for nothing. I work 14 hours a day (or more) and still find time to attend college online, studying 2-3 hours daily. I am only 33 years old and have more goals to accomplish. Paul evidently is an upset fast-food worker who has accomplished nothing in his life and will never accomplish anything. Therefore, he is lashing out at those who do work and have reached some level of success. He also lacks the ability to reason, and when someone confronts his narrow-minded views with real facts, he strikes out with insults and baseless charges. As far as truck drivers being useless, maybe one day Paul will look around and realize that everything he owns or will ever own is brought to him by truck drivers. Let's see how truckers affect you. You live in a house (maybe) made with wood, carpet, wiring, lighting, tile, concrete, piping, etc. all brought by a trucker. You typed your thoughts on a computer, at a desk, while sitting on a chair, again, all these things brought by a trucker. You go to the store, buy food and toiletries, courtesy of a truck driver. You drive on roads made with concrete, metal, etc., brought by trucks, and you drive in a car that was delivered via truck. Get the point? Without truckers, you would be sitting outside with your thumb up your a*s, getting rained on because you probably don't have the sense to do anything else. By the way, you shouldn't call people trailer trash when you live in SACRAMENTO!

I took superior ready mix to small claims court over this: breifly, they brought a pic of a truck ( not the one in question) to try and show they have safety shield to prevent spillage. their argument(S) did not go over in the court, so I got a $500 award/ so my advice to anyone that has this happen, take them to court if you think they are giving you the runaround when you give them the chance to make it right/

Had the same thing happen to me here in San Antonio. Called the trucking company and got blown off. They think that just because they have a little sticker on the back of their trucks that say STAY BACK 200 FEET it absolves them of all liability. I've yet to see a gravel/cement truck actually drive 55 mph. They're an outlaw bunch. I'm sure there are some good drivers too. But they fall in the category of pizzia delivery guys, try and get it there ASAP. Covers or not, the only solution is to stay as far away from them as you can.

It's so nice to see such an intelligent response from a third uninterested party. The spelling and grammar are impeccable in this rebuttal to the rebuttal. I was under the misunderstanding that this forum was to be used to facilitate settlement of consumer complaints. I had no idea it was for personal attacks on stupid, uneducated truck drivers. I only have a degree in Ornamental Horticulture, not truck driving, but driving a mixer pays three times more. The fact is that I do drive a mixer albeit for a different company than mentioned in this article and I do know a little about it. During loading operations, rocks do sometimes become lodged in the hopper area, and we make a diligent effort to remove them before driving. Invariably, some are missed and that is one reason we have tailgating laws, the other is safety. As for covering loads, our load is contained within a steel drum. There are no provisions or reason to cover this type of load. If you could read your DMV manual you would find that the only thing allowed by law to fall from a moving vehicle in the state of California is clear water. There are also laws concerning the covering of certain loads such as sand, garden waste, and garbage. If anything other than clear water is falling from a moving vehicle, than that particular vehicle should be reported to the company involved and/or the Commercial Enforcement Division of The California Highway Patrol. As for disliking all trucks and their drivers please consider this. If you have it or will get it, then at least one truck brought it to you and another will take it away when you are done with it.
