Brought my car in on Friday 11/8/2013 for routine scheduled oil change, tire rotation & tire balancing.  Car is 2013 Kia Rio with just under 22k miles on odometer.  On Tuesday 11/12/13, I left work and the car was not accellerating properly.  It stalled about 2 miles from my office.  It started back up & went approximately 2-3 more miles before I heard rattling & the car would not accellerate at all.  Smoke came out from under the hood so I pulled over to the shoulder.

I called a friend to come help.  He came out within 30 minutes & checked under the hood.  There was oil everywhere.  He checked the oil guage and it was empty.  His first impression was that when the oil change was done just few days before, the mechanic either did not tighten the oil filter or the drain plug, hence the oil leak.

I had the car towed back to STS Tire.  They were closed but I called them this morning and spoke with Jason, the Manager.  I asked him NOT to do anything except to take a look.   He called me later in the afternoon & told me there was no oil in the car yet he wanted to start it so he put 4 quarts in.  He then claimed that there was a hole in the oil pan and that I must have "run over something".  He said the engine is definitely tapping which most like require a replacement. He further stated that they were not responsible.

I've since spoken with two mechanics who have both claimed that I would have had to run over a log to put a hole in the oil pan. They both also stated that if the drain plug was not tightened, it wouldve been slowly leaking oil. They further stated that when finally ran dry, that the piston would have surely gone thru the oil pan. They suggested that I check my driveway, which I did and sure enough, there was an oil spot. 

I have not gotten a formal estimate yet but both mechanics are claiming that a new engine in my 1 year old car will run approximately $5-6 thousand dollars.  I've already paid $133.72 for the intial service @ STS and $123.00 for the towing & now need to have the car towed to the dealership...aproximately 60 miles away to be properly repaired.

Any assistance/guidance that you can provide would be most helpful.

I appreciate your response.  Upon escalating this issue to STS's corporate office, they filed a claim with their insurance company, Zurich.  Their independant insurance adjustor wrote up a report on Wednesday 11/20. Theyve offered to pay for a new engine.  A new engine on a brand new car?  The negligence is unsettling but the fact that they took the liberty of attempting to cover up their faux paux by criminally tampering with my car by manufacturing a hole in my oil pan. That adds a new spin.  Expert witnesses including the mechanics & adjustor will attest.  That is criminal and no longer falls into liabilty of negligence.

This is very unsettling.

Sounds like you didn't see or ignored the warning light about the oil problem..

 Continuing to drive under the conditions you stated finished destroying your engine.  NEVER drive another foot and turn OFF the engine with a car acting like yours, it's always catastrophic.  Sorry you have a damaged engine now.
