This type of lawsuit has been done before.
I am sure that the great legal team that this Coffee Megacorporation has amassed learned from the McDonald's debacle and managed to prevent any lawsuits like the one that cost McDonald's a few shekels.

Im not sure what you mean by the cup exploded, but I find it hard to believe that the cup just would burst open without warning or agitation. As for the temperatures of hot drinks you have several options when ordering. You can order your drink at kids temperature (no hotter than 130), no specification (coffee 180, milk based 150), or extra hot (milk based 170).
As for tea I can only assume that the hot water is around the same temperature as the coffee (May I suggest you ask for ice to be added for a quick cool down).
This is where you as a person are responsible for your own safety. I say this because there have been similar complaints like this in the past that have resulted in Starbucks and other companies to use warning labels and phrases such as Careful, the beverage you are about to enjoy is extremely hot. I know every Starbucks may be different but at my local store, you, the customer has to request a double cup. There are also things called sleeves that surround the outside of the cup so as to not burn hands if you are sensitive to heat.
So if you are trying to point out a breach in duty of care or negligence, Starbucks has taken all reasonable measures to dampen the possibility of foreseeable harm. It is then put in the hands of the customer to decide whether or not to use these safety features for lack of better words.
If you are seeking monetary compensation you should consult with a lawyer who can investigate policy and procedures for making and serving hot drinks at Starbucks specifically.
Dont think that I have no remorse for what has happened, because I am truly sorry for the pain your daughter has went through and may go through in the future because of this. I would just like for you to be aware of preventative measures that you or your daughter may take in the future to prevent this from happening again.
Remember the people behind the counter are real people. They are caring and willing to help you when the help is needed. Make good decisions and live your life responsibly.
