RE: Wrongful Termination

Sirs,

My wife and I have been with the Best Buy Dedicated Fleet in Dublin, Ga from the day it opened up in September/October of 2000. We have been one of the top Husband and Wife Teams in the fleet with no late deliveries, always on time, and always willing to do what is needed of us. That is one of the reasons why Koch Best Buy Dedicated ranks 100% in ontime deliveries...that is teams like us.

We were told false information upon signing on with Koch, however we have adapted to all and accepted all the promises that were broken and all the changes that have taken place since the beginning here at the Dublin OC.

We were told in the beginning we could have all 3 pets in the truck by Harry Wilson and Jack Kalsen.

An incedent has occurred where it was brought to our attention that we could not have 3 pets in the truck, after speaking with Dale Gouge, (Dublin Operations) and Pat Petty, Vice President, we "all" came to the agreement that we can only have one pet in the truck and that the pet was grandfathered in and this would be the one and only pet.

On Dec. 21st, 2001, I came to Dale, and told him that the situation was taken care of and that there would be only one pet in the truck....He said, " I can live with that.". Then he said, "Let's go inside and sign some papers that will deduct $500 out of our checks for deposit on the pet and would get $ 250 back upon dismissal or termination.

I asked Dale, "The pet was grandfathered in so, as per Pat Petey, there is no deposit.

Dale said, "Things in trucking change!"

I asked Dale, "Who emplemented this into the system?"

Dale said, arrogantly, "Just go take your stuff out of the truck, bring back the fuel cards, $50 dollar lock that was taken out, and keys to the truck, I will just terminate you today and be done with it."

I called and talked to Mark Davis about this and he said he would talk to Pat Petey. Several hours later I receive a phone call from Mark...he said, "Pat said Dale is in charge down there and his decision stands."

Mark also added, "I am not over the operation in Dublin, even though I don't think it is right, I have to tell you what Pat said."

I have investigated the Georgia laws as to how and when a person can be fired and found that in this state an employer doesn't have to have a reason.

But ask yourselves this, after My wife and I agreed to the terms, is firing us for asking a question fair?

Is firing an excellent, perfect record husband and wife team fair, because of one man's pride?

I hurt Dale's pride by going over his head, and he seemed to be determined then to let us go....BUT FOR ASKING A QUESTION?

Dale's attitude on asking questions is, (and we have been told this many times), "If you don't like it here, go find yourself another job."

My wife and I would like to have this matter reviewed.

My wife and I would like for you to ask the drivers here in Dublin about what we were promised and how we stood up in the Best Buy Dedicated Team.

If you investigate thoroughly, I think you will find out a lot more about the Dublin operation, that you don't like than you might think.
