on the 30-th ,carmax has called me for a recall on the model I purchased and the following day,they have notified me that the car is being confiscated by the selling dealed,carmax,because AMERICAN CREDIT ACCEPTANCE ,based in Indiana,had a change of heart regarding my loan,originating in a "rumor".I have not lost my job and I have not missed a payment. carmax has lured me into the shop under false pretense and also carmax refuses to aknowledge in writing that the vehicle was retained,so I can not even cancel my insuance and tags,which cost me on the day of purchase a hefty $4200.

on november the 15-th,I have purchased a car from sample road carmax of pompano beach,florida.two weeks later,the dealer called me about a recall on the model I purchased and the next day I was notified that my car has been confiscated due to an alleged change of heart by AMERICAN CREDIT ACCEPTANCE out of Indiana,based on a "rumor" about my credit score. the car remains at carmax, and this dealer not only acted outside of the law,but as cowardly as it is,refuses to even aknowledge in writing that the vehicle has been retained,as I have requested,in order to cancel my insurance and tag that cost me a needless $4200.

you seem not to grasp the issue of carmax pompano beach:my loan was approved,I drove the car for two weeks,done deal,contract finalized,but two weeks into the contract american credit acceptance heard a runor about my credit score and instructed the dealer to lure me into "service"and confiscate the vehicle so the dealer assumed the role of a repo agent without a reason to reposess.you're d**n right I need a lawyer,I will sue both their asses to the limit for breach of contract.

I would find it very strange for the dealership to keep the entire $4200 based on a "recall".  It actually sounds like the finance company tried to do an employment verification and they were unable to verify your employment as stated in the loan application.  In any event, I am not saying that the dealership handled it the right way at all.  I am saying to check your contract.  For sure you would be allowed to cancel the car insurance and receive the unused premium back. I would also think that the dealership would have to refund some of your deposit with a deduction for the time you had the vehicle. I don't know that amount, but your contract should specify what the deductions would be if your financing is not approved. Don't let this go. You may need to have an attorney contact the dealership to make sure they conform with the terms of the contract.
