Complaint Review: Richard A.C.E.Siebold III - Red Wing Minnesota

NOW not only is he in the arrearages of $ 41,045.60 in child support to me and my 2 children he is also in arrearages to his other ex whom he has a child with. He refuses to see any of his children, which is a great thing for the children's welfare, and he refuses to pay his child support obligations. He is currently once again sitting in the Red Wing jail awaiting a court hearing for interfering with another 911 call after he THREATENED to RAPE AND KILL his newest victim in front of her child. He also tried to run an officer off the road while drinking and driving. But hey guess what, even though he has a violent history in both Goodhue County and Dakota County, Goodhue County is going let him walk! They rotate the judges so you never get the same one and they are so hurried they don't take the time to review the criminal background. The judge let him go on his own Recognizance. Thank God he has the 3 Felony Warrants in Pierce County for Manufacturing/Dealing Meth. He's being held for Review July 18th, 2008 pending on what Pierce County does. As of today I know they were filing a Governor's Warrant to get him back over to Wisconsin. In the meantime he was originally set for a Jury Trail for June 16th, Nothing came of it, When I SPOKE Cathy Hendricks about the 2 Warrants in Dakota County For His Child Support she said she was unaware of them. Once again the Counties will receive their fines well before our Children see any monies owed to them. GO FIGURE. I'M GLAD GOODHUE COUNTY LIKES TO TAKE MONEY AWAY FROM CHILDREN. You Would think Since Chris Schrader has been dealing with us for years, IF HE CARED ABOUT CHILDREN AT ALL, HE WOULD BE SURE TO MENTION THE $40,000 + RICHARD OWES HIS CHILDREN AND WOULD DO SOMETHING TO INSURE THE CHILDREN SAW THE MONEY 1ST. NOPE, HE JUST ROLLS OUT THE RED CARPET FOR THE CRIMINALS! HE'S REALLY GOOD THOUGH AT PROSECUTING INNOCENT PEOPLE AND FINANCIALLY BREAKING THEM! WHAT A GUY, WE SHOULD HAVE MORE JUST LIKE HIM.

To whom it may concern: I read this rip-off report and the rebuttal, I must say it never ceases to amaze me!! Not once, in the rebuttal, did I read anything about CHILD SUPPORT, or the non-payment of it! These children don't need to have you degrading their mother, they need you to send them money. They might be small, but they have needs; clothing, food, medical needs, etc. Not to mention the fact that they are just children-they need money for FUN, too!! Your exwife and her husband aren't your responsibility, but these children are! Are you a man or a mouse?! Grow up and pay up!! Cons come in all forms, most of which portray themselves as helpless mistreated people who were far too good to the ones THEY left behind, and left them with much more than they deserved. We have talked with the Dakota County Sheriff's office, and as you might guess.... THE BIG RUN AROUND!!!!!!.

When we talked with D.C. attorneys office about pressing charges of contempt of court for nonpayment, they said we need to file a report with the D.C.S. office, so... we call, "you need to call the civil division, we can't send a squad out for that," now, we call them, and once again as you might guess, "we will do some checking, and get back to you.... and oh, ya... have a nice day" In the mean time, our child support case worker, informed us that, and I quote" The post office in Red Wing returned the address verification form back to them stating that he does not live there and there is not a forwarding address" This, I am sure, was to justify putting "address unknown" in the file. However, this was to easy to verify... We called down to the Red Wing post office and spoke directly to the supervisor (Chris), which he, in turn, talked to the letter carrier........Richard A.C.E. Siebold III is still receiving mail at 312 Tyler ST. South. NOW... CALL ME CRAZY,,,,,,,,,,,BUT I REALLY, REALLY, REALLY THINK, SOMETHING IS WRONG HERE!!! Oh ya...did I forget to mention she said, and I quote" I can't call Goodhue County and discuss this with them because of data privacy law's" This has got to be the most stupidest case on the planet... It's' not like we can't find him, Richard will be having a probation officer soon in which he will have to report to and we believe he may have paid some money for his fines. Hell...I even called the local video store in town and verified his address.

EVERYBODY KNOWS WERE THIS GUY LIVES, EXCEPT DAKOTA COUNTY CHILD SUPPORT, EVEN THE d**n JUDGE WHO CONVICTED HIM LAST MONTH WAS A DAKOTA COUNTY JUDGE, SHE KNOWS WHERE HE LIVES, who, by some astronomical chance, happen to be presiding in Goodhue that day when Richard turned himself in, who also happens to be the same judge who signed our harassment-restraint order against Richard's mother (that's a whole different story), who now, has that judge's order in the appellant court's..... something is very wrong here... call us paranoid, but.. when you call every Dakota County Government agency and not one person is willing to help and when you call Goodhue County and they won't acknowledge, after they have been informed, that there is a court order for child support and that Richard is in the arrears to the tune of $10,611.41 and they say "that's not our problem, we will get our money"....you to, may get a little upset.

We are now trying to talk to the Dakota County director of child support enforcement and at the present time, this to, looks like a dead end..They told us that a case of $20,000 or more takes top priority. We have no choice!!!!!

TO WHOM IT MAY CONCERN:
IN THE EVENT THAT NO ONE HELPS US IN U.S. POST OFFICE, DAKOTA COUNTY CHILD SUPPORT, DAKOTA COUNTY ATTORNEYS OFFICE, DAKOTA COUNTY SHERIFF'S OFFICE, STATE REPRESENTATIVES, GOODHUE COUNTY ATTORNEYS OFFICE, GOODHUE COUNTY PROBATION AND RESTITUTION OFFICE OR THE DIRECTOR OF CHILD SUPPORT LAW ENFORCEMENT.

WE WILL HAVE NO CHOICE BUT TO TAKE THINGS INTO OUR OWN HANDS AND START HOLDING PEOPLE ACCOUNTABLE, PUBLICLY.

ALTHOUGH WE HAVE GOTTEN SOME RESPONSE TO THIS GOVERNMENT BLUNDER, IT IS IMPORTANT TO NOTE: "IF RICHARD A.C.E. To whom it may concern,
We have found out today that Dakota county child support has now put in the files "address unknown" for Richard A.C.E. Siebold III. We know where he lives, they know where he lives and Goudhue County knows where he lives!

IT IS VERY OBVIOUS THAT SOMETHING IS WRONG!!!!!
We have now started the process of contacting goverment officals in office(state rep's), one office asked us to send a statment to have all information in dakota county child support and Goodhue County offices be released to them and we are now waiting for other offices to respond.

Also, we are now talking to the Dakota County Attorney's Office to see how willing they are to help us.

I called my attorney 02/26/01 in regards to Richard (my ex ) regarding the fact that he is in arrears of $10,611.41 and that he is now court ordered to pay Goodhue county $4037 restutition for unemployment fraud. My attorney advise me that being I have a prior court order and any monies owed to my children are to come first and that child support can capture any monies that he pays to get current before it gets applied to the fines.

Today, 02/27/01, I called Goodhue County Court Collection and spoke Andrea, the person in charge of court collecting. She informed me that she is not there to collect child support that any monies will be applied to his fine, that it is up to the child support worker to try to collect any monies owed.

I then called my child support worker and she stated that she can not call Goodhue County (courts, restition, or even his probation officer)and inform them of the court ordered Child support because of confidentiality reasons. Just to give you an idea as to how rediciolous this is, he turned himself in and gives his address to where he lives in Goodhue County, the same address that Dakota County has, yet no one in Dakota County can find him, even though it was a Dakota County Judge that Convicted AND Sentenced him.

Goodhue County (where he lives) is less than 45 mins from the Child Support Office, but because neither county wants to act for whatever their reason, there he sits. It's apparent that one side wants to line their pockets while the other wants to get paid for sitting behind the desk letting the custodial parent do all the work besides work and suffer for the lack of support on their part.

Regardless of Child Support Recovery Act 1998(CSRA)found at title 18, United States code,Section 228, #2)the willful failure to pay a past due child support obligation for child support for a child who resides in a state other than that in which the Non Custodial Parent resides, if the obligation has remained unpaid for longer than 1 year or is greater than $5000; the willful!

Failure to pay a past due obligation may qualify as a felony if it has remaind unpaid for longer than 2 years or is greater than $10,000. Child Support will not act on this law for it makes to hard of a case load according to the proscuting attorney in Red Wing, MN.

Honestly, where is it law that if the case is to hard for a case worker they can put your children on the back burner and say tuff? It's to much work for us? I can not find one, and if i'm wrong please refer me to this law so I may apologise. So my conclusion from the last two days are the Government gets there money, Child Support gets paid for nothing and OUR CHILDREN RECIEVE $0.00 Makes sense to me. Call me irrate but I have every reason to be, NOBODY wants to do anything for working families to keep them that way, I can almost bet anything in the world if I ever had to go on welfare today and sign my arrears away at that point in time they would act!! They want their money!!! It is apparent Child Support is not there for OUR children, that this WELFARE REFORM will not work in the long run, that our government has nothing better to do but to get rich off Custodial Parents when they fall to hardship!

The saddiest thing is that in Janurary, when he crawled out of the woodwoork, turned himself in, he called me at work, claiming he wanted to speak with our children, I allowed it with the condition I would listen on the other end, he made more promises, stated more lies and glorified his unemployment fraud that it was ok because it was not a violent crime.

I have now stopped that because I believe a crime is a crime violent or not and if he truly wants to be a dad, he can take me to court for the visitions as stated in our court order July 20th, 2000. (Remember to avoid his warrents, he disappeared for almost a year without any contact until I started Termination of his Parental rights)
