My account with Aria (Providian National Bank) was paid in full back in 2002 and the account was closed. On Monday, July 7, 2008, I was told that Midland Financing had frozen my checking account due to an unpaid balance with PNB. I then went to civil court to get a copy of the summons that they claimed they served me. Midland Financing had sent the summons to an old address, therefore, granted a default judgment. I also filed an "Order to show cause" indicating that I did not receive the summons due to not being properly served. PNB has my correct address because I still have the letter that the card was mailed to me from PNB. I need some legal advice in this matter.

Damage Resulting - I am the sole provider in my household and my funds have been frozen. I am losing time from work to go to court for something that I had already closed. My next court date is 7/22/08.

For all who have been effected by Rubin & Rothman LLC- Midland Financial. Please note that by filing "Order to show Cause" proves that you have now found out that these sewer servers had gotten a default judgment on you. First, order a copy of your credit report, fill out a change of address at your local post office even if you've moved from an old address years ago and get old addresses removed from your credit report ASAP. Collection agencies may serve summons at your old address, but they must also mail a copy to your address. If you still communicate with the owners of your old address, pay them a visit and leave your telephone number just in case a summons appears. Check your credit report for any collection agencies and call them or write them regarding an account that you thought was paid in full or closed. You have the right to send them a letter of settlement if you owe the debt or if you dispute the debt. Keep all copies of letters that you send, therefore, if you are summoned to court, you have proof that you tried to work something out with them. Also, get a custodian account and keep your money moving until all debts are cleared. I'm sure that a relative would not mind you keeping money in an account that belongs to a child - creditors cannot freeze custodian accounts. I hope that this information is helpful for many. By the grace of GOD the bank had to honor the checks that came into my bank before they put a hold on my account. Good luck to all.
