I just recently retired from the United States Marine Corps and while serving on active duty over seas, my account with Providian was given to a company called Emerge Mastercard with a interest rate of 29.99 percent. Before I deployed I made arrangements with Porvidian Card services by refercing the War and National Defense Act of 1940 aka Soldier's and Sailor's Relief Act Chapter 888, 54 STAT. 1178 Section 522. I was told that I would not occur any late fees or over limit fees during the time I was on active duty deployed over seas.

My interest rate at the time was 12 percent and according to the Relief Act of 1940 it was supose to go to 6 percent. None of this took place...instead they closed my account, ran several 30, 60 and 90 day lates on my account, closed it and gave it to Emerge who put a 29.99 percent interest rate on the balance of $1270.00 inwhich $800.00 of that was over limit fees and past due fees which should have never been applied to my account because even though I was over seas I still made payments when I could get to a stateside server.

I contacted Providian and they told me that they could not do anything about my account because it had been closed and I was stuck with the negative information on my credit report. Please Help me fight this giant...Military members give their lives in defense of companies like this who show no mercy to us....Thank You

The Fair Debt Collection Practices Act and the Fair Credit Reporting Act are specific. Regardless of who ended up either owning the original account or is collecting on the account, they are bound under the law.If you go to the Federal Trade Commission website and look at opinions written under the FDCPA and the FCRA, I beieve there are opinions already written regarding relief under the Soldiers & Sailors Relief Act. If the account was NOT purchased but is merely being serviced, then the original creditor is also bound under the FDCPA regarding the conduct of the collector. If you name both creditors/collector as joint defendants in a court action for their violation of the FDCPA,FCRA & SOLDIERS & SAILORS RELIEF ACT you should not only get all of the money back that you have paid un-necessarily but positive entries on your credit report. I have a son who was a Navy Jet Pilot during the Gulf Conflict and he also had credit issues. I would be more than happy to assist you (gratis) via email to resolve this issue. Good luck, R.P.

Actually, I think you are sort of lucky, in that as a serviceman your options are better than the typical rip-off victim. Providian was dinged in a class action suit for predatory lending. This sounds like more of the same. There is a lot of activity surrounding predatory lending in the legislative bodies right now, so your voice is important. Contact Providian's regulating agencies, the Attorney General in your state and anyone else you can think of. The fact that they are ignoring the military requirements when we are on the brink of war sounds like it is enough to get them fined even higher for taking advantage of servicemen and women. This sounds like more of the same. There is a lot of activity surrounding predatory lending in the legislative bodies right now, so your voice is important. Companeis like this push the limits of the law all the time. They make there money buy wieghing out the probability of the customers actually being able to file suit against them.This company is ugly. They don't care about human life at all. and i consider them like terrorist and the CIA should investigate where this money is going. There are laws that they are breaking and they know it. please pursue a fedral complaint.These complaints add up until a flag goes up and a lawyer will start a class action suit. They have had many already on them.THEY DON"T CARE and they account for all the money lost years befor it even happens. Dissolve this corporation !!!!!!!!!!!!!!
