The Fair Debt Collection Practices Act and the Fair Credit Reporting Act are specific. Regardless of who ended up either owning the original account or is collecting on the account, they are bound under the law.If you go to the Federal Trade Commission website and look at opinions written under the FDCPA and the FCRA, I beieve there are opinions already written regarding relief under the Soldiers & Sailors Relief Act. If the account was NOT purchased but is merely being serviced, then the original creditor is also bound under the FDCPA regarding the conduct of the collector. If you name both creditors/collector as joint defendants in a court action for their violation of the FDCPA,FCRA & SOLDIERS & SAILORS RELIEF ACT you should not only get all of the money back that you have paid un-necessarily but positive entries on your credit report. Actually, I think you are sort of lucky, in that as a serviceman your options are better than the typical rip-off victim. Providian was dinged in a class action suit for predatory lending. This sounds like more of the same. There is a lot of activity surrounding predatory lending in the legislative bodies right now, so your voice is important. Contact Providian's regulating agencies, the Attorney General in your state and anyone else you can think of. The fact that they are ignoring the military requirements when we are on the brink of war sounds like it is enough to get them fined even higher for taking advantage of servicemen and women. Companeis like this push the limits of the law all the time. They make there money buy wieghing out the probability of the customers actually being able to file suit against them.This company is ugly. They don't care about human life at all. and i consider them like terrorist and the CIA should investigate where this money is going. There are laws that they are breaking and they know it. please pursue a fedral complaint.These complaints add up until a flag goes up and a lawyer will start a class action suit. They have had many already on them.THEY DON"T CARE and they account for all the money lost years befor it even happens. Dissolve this corporation !!!!!!!!!!!!!!
