Where do I begin, this has been going on for the last 6 years! They are still not done with us. It started in June 2000, with our mortgage company going Bankrupt on us, they had contacted us saying our mortgage was not up to date, and we were 3 months behind.

HA HA cancelled checks, western union payments, were sent. Still to no avail they persisted that we were behind, 1st convesation $1,200, 2nd conversation $1,700, seems to be going up every time we contacted them. Sent the $1,700, they sent it back, saying were now $2,500,+ behind. Starting foreclosure procedings. Contacted someone to help A (Robert Kline) Financial Assitant. Made Payment of ($2,586.49) they cashed it.

This was a matter of 3 weeks all payments were sent western union. We were told we were fine. And next payment not do till Sept. 4 2000. Yea right. June 27, final bankruptcy notice from Conti came, we were told we that we were being sold to Fair Banks Capital. Send payments to them. No Problem, so we thought.

Next notice was from Manufactures Trade & Trust ( Whom ever these people were, we still are not sure). That they had filed forclosure notices with Trott & Trott ATTY, because we were 6 months behind, Go figure, we couldn't. Called again, Fairbanks that is, the one we thought had our mortgage. They said they did, and that Conti never recieved any of those payments, and we were behinde. Did not matter what we sent them. They did not believe us.

By October we were forclosed on, being sold in auction in Jan of 2001. Contacted a lawyer, started paying him our house payments, had him contact them, trying to straighten this out. Even he could not get know where with them, to many people involved already I think.

In the mean time they were charge us late fees, mis. charges for god knows what, oh example Home inspection, $295.00 per pop, think there is about 10 of them or more. They have never been inside our home. NEVER. Property inspections yes someone was always driving by takeing pictures. Those were $95.00 a pop. Oh and how about this one Hazard ins./Flood ins. for Michigan. Per our state where we live we are not required to carry it. That was a whopping $738.00 per year.

These charges were charged to an escrow account, which we never established with any of the mortgage companies.

Well by March of 2001, we still were not getting anywhere, so our lawyer told us to file bankruptcy. This is a nother nightmare. The Bankruptcy lawyer was just as bad as the mortgage compy. When we had our first meeting with him and tried to explain what was going on, we were pretty much told to deal with it. In those exact words. We are in the processing of sueing him, as I am writing this. When we had our meeting with the judge and all our creditors, and tried to object to some of the amounts that they were saying we owe. Our lawyer told us to be quiet. We still tried to say somthing. But know one would listen.

We were charged for 3 forclosures, which there was only one. Their lawyer fees, over $6,000.00 of late payments and misc. charges, even the ones we had proof that we paid.

Any way to try to shorten this up a little. We ended up in Bankruptcy and are getting ready to be discharged, we were only suppose to be atit for 3 years, but we had to hire another lawyer to get them to stop taking our money. This has been more than a night-mare. This is a never ending story. Everything was paid in Sept of 2004. They did not release our checks till Nov 2005. And come to find out, when your in a bankruptcy your creditors are suppose to notify the courts if there are any changes, to our mortgage, or any other bills. Just like we are suppose to. ITS THEL LAW. As we are trying to get this bankruptcy discharged, we are finding out some more problems as we even come out of this.

Whey you ask! Good ol' Fairbanks Capital sold us to Select Portfolio SVC, back in 2002. Just recently when we asked for a payoff on our home, they sold us again to Owcen Loan Servicing.

They sent us a letter stating we still owe over $4000.00 in late payments, ins chgs, lawyer fees, and misc inspections of the property. ANd that this has to be paid before they will re-instate our loan. Ok now in a bankruptcy you are not allowed to accure any added chgs unless they are ok'ed throught the trustee that is handeling the case. THey never were.

And come to find out as our lawyer does more checking, our trustee has been sending all the payments to Manufactures Trade & Trust, Whom has long gone as our mortgage holder. We thought.

We have just found out, that conti, was bought out by them, who also, somewhere on down the line is linked to FairBanks, who is linked to Select Portfolio, who is linked to Owcen in some way or another. ? What is this the mafia? (Sorry my spelling is not that good) We have just asked for another payoff and I will bet you we will be sold again before it is all over. And we still do not know who we are suppose to paying. Seems like everyone wants a piece of the action. And Guess what, they say that we still owe the same thing on our home, (that is the same amount), as we did when this mess all started, go figure, the bankruptcy courts have sent our normal paymens for the last 5 years and we still owe the same.

It just don't seem possible that these companies, can treat people this way. Not a lawyer will touch them. The goverment has not got the time to follow them or baby sit them. And this is happening to alot of people, not just us. I just don't understand how much more we as people can take. Is their nothing we can do to stop this. These companies are railroading us right out of our homes and for what, the almighty dollar. They don't care who's lives they ruin in the process. If any one has any suggestions let me know. And don't do any of this who's fault it is, or proof stuff. We have every piece of paper from day one on file. We just wanted to put our 2 cents in, and let everyone know, how crooked these companies are and that in some way they are connected to each other. And maybe find out some new ideas about how to solve this problem. thanks

Ann, I'm also a victom of these scam artists in Pa. However, I've turned there own game on them. First I forced Select Portfolio Servicing in to filing Foreclosure on my house by refusing to pay them a dime ( Crazy) not really. Because I used there filing against them as a clear attempt to obtain my property Illegaly. I've prooven that the mortgage contract was ILLEGAL.Oh and you should know that they got Manufactuer Trader & trust to file the foreclosure papers. The Illegal contract showed multiple areas where they Illegaly inflated amounts such as Former mortgage pay-off amount,The amount between amount borrowed listed on the Truth and lending Statement and the principal listed on the contract,The amount listed as amount to borrower on the Title insurance papers listed as Settlement costs,They also included costs of Items which I payed in advance such as property insurance,Then the contract it's self didn't list all forms of repayment as required by Federal law, They also performed other preditory actions as they have done with all of you. Therefore, since the contract is ILLEGAL they have NO legal claim to the property. Presently Manufacturers Trader & Trust has gone through multible attornies trying to challenge me. I do mean me too I'm going after them my self no lawyer.There last attorney has conceaded the contract is Illegal. The settlement on my case is the deed to my property and 750,000.00 Dollars plus other stuff. I'm hoping they want to take this in to a court room because when they do ( They are going to get Bared from the state of Pa.forcing them to forfit ALL mortgages in the state.)So check your contracts very closely and check the required 3 day waiting time required by law they violate that too.

Ann, I wish there was something I could say that would be of help. Unfortunately, nothing appears to work against these scumbags, because no one with any real power is willing to take any action. And beleive me Ocwen is one of the worst of all. For now... all I can suggest is: if you haven't already done so, write to your State and Federal Representatives as often as possible, as someday it just might end up with somebody who actually cares. Also, you may want to check the MS Fraud web site. There's a lot of excellent posts there. For what it's worth, I beleive every word you have written, as I've seen the same story written just too many times not to. Good Luck and Keep Posting!

Thought I just might add, that I was not sure which company to post this under since, their are so many invoved. And that I am sorry for any mis spellings. And yes Owcen IS Ocwen, I have had problems with this one. Trying to put this in perspective is very hard, and trying to explaine every thing is even harder. There have been alot of discriminating things going on with these companies, and it is not nice to repeat what they have said. Ocwen seems to be in the lurch over this all, cause they just got involved recently. But they are the ones who is trying to collect all these late fees. And not willing to re-instate our loan.
