Old National Bank charged me a $38 fee on a penny transaction. On top of another overdraft and $8.00 a day until positive.

So you had your account down to $0.00 and then decided to use your debit card or send a check through for $0.01.  Okay, and I have a bridge for sale in San Francisco.

I could be wrong. Perhaps you are extreamly detail oriented and know your balance to the penny to the point you would be called OCD by many people about how well you keep track of your balance and this was a mistake.  But I don't think so.  It is more likely that you don't keep a written register and this "penny" wasn't just a penny.  I would not be shocked if you had SEVERAL transactions in the negative and for some reason this $0.01 also came through.

However, even if this did happen the fact is that the written terms of the account specifiy the fees if you overdraft, unless it says there is a lower fee for over drafting a smaller amount, then yes even if it is only $0.01 it is something you agreed to. The time to think about how "fair" this is or is not is when you are opening the account.

One other thing.  Many banks are lienient in cases like this. Where if you call them up and talk to them in a professional way. You may find that they will waive this fee as a courtesy.  Now, it may not happen, and this courtesy tends to run out if you have a history of overdrafts.  But it is something you should try.
