Advanta sold my mortgage to Ocwen the lender from hell. I learned early when payments were not getting posted on time that payments had to be made by Western Union and even that failed.

For seven years I had an in home, large family childcare. Most of my clients were subsidized by the State of California. Vouchers were submitted on the 1st each month and payment mailed on the 15th each month. My house payment was made the first banking day after the 15th. I had a rural mailbox, quite a walk from the house and out of site, behind trees. The mail was tampered with two months in a row, removed from the box, gone through and replaced a few days later missing checks, credit cards and other important mail. It takes 30 to 60 days for a check to be considered lost and then rewritten.

I had gotten a mail box in town at the local Mail Box Etc. They could accept UPS, FedEx as well as mail. I selectively changed the address for only the important mail, creditors, accounts, credit cards, mortgage and vouchers. At first it did not upset me that my address was not changed on the mortgage statements.

Ocwen changed my legal name, it could not be forwarded as written. Ocwen sent billing statements to the wrong address for over a year. Since I paid by Western Union I had no idea what was going on with the mortgage until three payments were missing, one rejected and returned to the wrong address. This was the begining of the forclosure. I had the Western Union recipts but they were useless.

I sent lenghty letters of my complaints: Sorry to change you name but it does not fit our computer. Sorry to miss payments on your account but it will be corrected. Sorry that Advanta did not acknowledge late charges paid but not corrected. Sorry that we send your bills to 5051 instead of 505-1. Sorry that it takes 6 months to send documentation. Ocwen added insurance, I provided proof of insurance, three times over the course of six months.

The stress was to much I closed the home childcare business. I was smothered in paperwork and not one paperpusher would read their own forms. Working out of the home with 20 hours a week driving time made things worse. I was no longer available to harass by phone. I had changed the mailing address to the MBE address for safe keeping of the mail. Ocwen claims I abandoned my home, moved. Since Ocwen changed my name the Post Office would not forward mail as addressed. Once again sorry for the inconveince.

My house went into forclosure. I talked to the attorney for Ocwen, found out the amount necessary to clear the forclosure. I went to the bank to withdraw the cash to take to Western Union, the bank did not have that much cash on hand (it is a small town) and Western Union required only cash. The bank could only do a cashiers check for the amount. I called the attorney, got voice mail again, and again. I sent the cashiers check to Ocwen, next day service.

House was out of forclosure.

Four months later late charges and misc charges. The forclosure was not removed and the cashiers check was just applied to the account. The amount I was told to pay was not the correct amount. The attorney did not put anything in writing, everything is verbal except the forclosure notice. Ocwen does not put anything in writing, they will not fax any forms. Every customer service representative relates the charges differently. I had bounced check charges when I paid by cashiers check and Western Union!

This is isane.

In Dec of 2002 my paycheck ran a bit late due to the bookeeper leaving the business. I told Ocwen this and that I would include the late charge with the payment. I did that and made the next months payment as well. I paid by cashiers check once again, tracking and it still took a couple of days to be put on the account. I now have almost $300 in late fees added but not on the actual billing, only on an invisible account kept at Ocwen that comes up when you ask for a payoff or balance information. My billing statement showes me current but if I call Ocwen I owe additional charges!

I have found in research that Ocwen specializes in taking properties that are paycheck to paycheck by their owners and forcing them into forclosure. By the time errors are found the property has been forclosed upon and sold. They even brag about it in some of their documentation for investors.

I got my statement today for the March 1, 2003 payment due and once again they are charging a late fee that is not due. Two months in a row I am being charged a late payment befor the payment is even due. Ocwen claims it as a MISC charge.
