Ocwen Federal Bank FSB breach of contract unfair debt collection mail fraud overcharges wrongful foreclosure harassment health issues and slander Orlando Florida
I have owned my residence since 1988 and my loan was transferred to Ocwen Federal in 1995. Since that time I've received harassing phone calls demanding I pay the full loan amount ot multiple payments. They have overcharged me on mortgage payments, late fees, insurance (which I have alway's provided myself), drive by inspection fees, attorney fees, wrongful foreclosure, default letters, foreclosure letters and mostly they are saying that all these charges add up to $50,000.00 on top of my loan amount of $84,000.00.
Ocwen tried to foreclose on me in 7/01 in which they accused me of not making 4,5, & 6/01 payments. I have the cashed checks from Ocwen and I had been paying $100.00 over the actual monthly mortgage payment. Then they started accusing me of all types of things for a reason to justify a foreclosure.
Since that time I was wrongfully advised to file for Chapter 13 bankruptcy to stop the foreclosure and file a adverssary suit against Ocwen. After changing attoneys three different times, no one did anything to assist me. My bankruptcy is now dismissed with predjudice and I'm unpretected under the law in which Ocwen can now foreclose on me at any time. It has cost me $175,000.00 and I have suffered many health issues due to the undue stress Ocwen has caused me as well as I've lost my lucrative business that I've had for twelve years. No one will assit me because it would take too much of their time for not enough money (that's what they tell me).
All I want to do now is get rid of the bogus charges ($50,000.00), sale my home and move away. I can't make any money ofthe sale of my home unless Ocwen subtracts the bogus charges. I have many articles on Ocwen regarding thes exact practices against others and they can't do anything about it. Ocwen should't be able to get away with this and win in their pursuit to kick individuals out of their homes.
Please help me!! There was a local new station that just reported on several institutions that have done the same things to people. If you get a chance you can get it from their web site or I can fax it to you (www.wfaa.com news 8 investigates & it's Valeri Williams; Consumers fume over costly credit).
How do I sue them and what is my next step because I need assistance fast before they foreclose on me & they're wanting me to sign a contract with them.

My heart goes out to you for all your trouble. I too have a similar case and have already filed a report. I was forced to file a chapter 13 and then dismiss with prejudice. I have spent thousands on attorneys and had to see a psychiatrist for the stress. My advice is to is to refinance ASAP with the best offer you can get,even if it means you have to pay OcWen their bogus charges and get a higher than deserved rate. I went through at least a dozen lenders before I found one and was able to provide a very clear paper trail of all my payments. insurance, legal actions,etc. Try not to get discouraged. You will at least save your home. Document everything through an attorney and keep all copies. Then join the class action law suit posted on this site as soon as you can. Call your local congressman (or congress woman in my case!). I also sent an email to sixty minutes requesting that they do an expose piece on them. I have had no response to date. Contact Attorney Ashcrofts office with a complaint and your state attorney general office. Also file a complaint with the federal trade commission. If enough of us raise our voices, someone is bound to listen!They cannot continue to get away with these practices forever! Best wishes. I truely hope you can save your house!
