I have been in a similar situation as yours that has repeated itself over the past 6 years since Ocwen bought my mortgage from HUD. I can't count how many times my payment was "lost in the mail". As my checks were MIA, I have no proof that I sent them. You on the other hand have proof thru your bank that the check was cashed, and therefore the money disbursed to Ocwen. This can be verified not only by your cancelled check, but also by the Federal Reserve Bank's records as to when the funds were trasnferred from you bank to Ocwen. Your comment about the check having to be 100% readable or it will be thrown out strikes a sour note with me. They are currently holding an inspection report by a CONtractor I used to repair my home which they considered good enough to release over $20,000 to complete the repairs on my home. This inspection report was shrunken down so little you need a magnifying glass to read it. It sounds as if nothing you send them will be good enough short of the cancelled check itself, which you leave you defenseless against their false allegations. No doubt they have also been adding on late fees and accrued more interest for the one "lost" payment which they have more than likely credited to someone else's account due to their negligence. You stated you would be interested in hearing plans for a class action law suit against Ocwen. The class action suit filed in Connecticut and posted here covers the state of Illinois as well as Florida where they are based. Don't allow them to force you into bankruptcy to save your home like they did me.
