I must admit that I felt as if I was the only individual that was being harassed by these incompetent people.

I have been fighting with them since October of 2001 about a mortgage payment that was made to them. I have the canceled check with their endorsement on the back. I have talked with numerous telephone reps on the phone and they have all stated that none of these funds are posted to my account. They have said that it will be up to me to prove otherwise.

I was given a fax number and told to fax a front and back copy of the check. I have done so twice and my new statements continue to show me in arrears.

I decided to let it go and then the big dogs

in Florida threatened to foreclose on me.

Again I spoke with a rep on the phone and was told to send a copy of the check (front and back). She said the copy must be 100% readable or it would be thrown away and that we would have to start all over again. I don't understand why a legitimate auditing firm would not see these mistakes. It's obvious after reading all of these reports that we are not all liar's as has been suggested.

I would be more than interested in hearing plans for class action suits against this organization. I am outraged that this can happen in the United States.

"Lost" Payments Are A Favorite Tactic Of Ocwen's

#2Consumer Suggestion

Mon, August 19, 2002

I have been in a similar situation as yours that has repeated itself over the past 6 years since Ocwen bought my mortgage from HUD. I can't count how many times my payment was "lost in the mail". As my checks were MIA, I have no proof that I sent them. You on the other hand have proof thru your bank that the check was cashed, and therefore the money disbursed to Ocwen. This can be verified not only by your cancelled check, but also by the Federal Reserve Bank's records as to when the funds were trasnferred from you bank to Ocwen. Your comment about the check having to be 100% readable or it will be thrown out strikes a sour note with me. They are currently holding an inspection report by a CONtractor I used to repair my home which they considered good enough to release over $20,000 to complete the repairs on my home. This inspection report was shrunken down so little you need a magnifying glass to read it. It sounds as if nothing you send them will be good enough short of the cancelled check itself, which you leave you defenseless against their false allegations. No doubt they have also been adding on late fees and accrued more interest for the one "lost" payment which they have more than likely credited to someone else's account due to their negligence. You stated you would be interested in hearing plans for a class action law suit against Ocwen. The class action suit filed in Connecticut and posted here covers the state of Illinois as well as Florida where they are based. Follow this URL: http://www.badbusinessbureau.com/view.asp?id=24145 and then contact Mr. Hanson. You definitely aren't alone, and here is your opportunity to settle this matter. Don't allow them to force you into bankruptcy to save your home like they did me.
