Our loan was assumed 5/1/01 or 6/1/01 depending on whom you talk to at OCWEN.

When we got the address to mail our payments to - we were late with the June payment. They claimed because we never marked it for June they credited as the July payment.

OCWEN never told us they did this until December and claimed outrageous late fees. When questioned they said we should have specified on the payemnts what month they were for.

(I have been on Workers Comp for 1.5 years!)

Also in December, we received a letter from their attorney about foreclosure - being 3 months late - this is how we found out about the June '01 payment being missing!

They also claimed we had never made our November payment - paid by a USPO money order. We got proof from the posat office of it being cashed and when - they finally agreed that they had received it.

Tried to charge legal fees for the attorney, to prepare foreclosure notice.

Since I was disabled - we have not had a checking account - my father-in-law used his legal account to make the payments (we gave him the cash)- they have been reluctant to challenge him.

BUT now they are tring to say the checks were for less that the amount they we cashed - ie: a check for $150.00 posted as $100.50 - they want proof from his bank about these checks but expect us to front the payments until we can prove that we have overpayed our account - (actually) what they are saying is we are late.

Also they started escrowing our account for our FIRE INSURANCE - when we had our own policy. Then they claimed they would use our company. OCWEN claimed they had paid our insurance policy - but our insurance company sent us a cancellation notice for nonpayment. All this after numerous phone calls, faxes, and letters stating we were exercising our right to purchase our own policy.

By the way everyone should keep all correspondence - pehaps we can get them by using the postal authorities - ON CHARGES OF WIRE FRAUD - "TAPE" all phone calls - it can provide evidence of "INTERSTATE WIRE FRAUD". "Legally employed individuals acting for/in the interest/representation of their employer obligate their/that employer to honor all agreements and are responsible for the statements/actions of said employee."

*When taping a call always get the person on the other end to commit to the "DATE", "TIME", "COMPANY NAME", and "IF" possible "THEIR NAME". This can then be used legally.

Instead of just going to the individual "State's Attorney's General" - let's file charges or "racketeering" with the "US ATTORNEY GENERAL" AND THE "US BANKING COMMISSION".
