Anatomy of a Computer Betting Software Scam - Nu-Tech Advantage

Can a computer program predict the future? A handful of Queensland based companies peddling betting software programs believe their programs can see into the future and identify the winner of any horse or greyhound race.

Identified by the Australian Competition and Consumer Commission as one of the top 20 complained about matters, the betting software scam has become as Queensland as XXXX and cane toads.

Preying upon bus loads of cashed up Japanese tourists whose only English consists of waving peace signs before a camera flash and asset rich retirees riding the waves of the sea-change exodus, betting software scam companies are extracting between $1,000 to $18,000 from each victim.

At an age when young girls are swept up by strident legions of omnipotent Hiltonism and Lohanism, Denise refuses to leave grandmothers fairytales, let alone enter the world of horse race gambling.

Estranged from rudimentary adolescent angst by the prospect of talking frogs and giggling rabbits, Denise solicits refuge in tales of elegant princesses roaming enchanted forests at the bottom of grandmas overgrown garden.

In the garden, in her impenetrable solitude, a downpour of roses gush cacophonies of crimson red as a torrent of petals caress her bare shoulders. Fear and insecurity are buried beneath the earthly bones of bulbous oaks whose leafless tentacles fracture into the undulated sway of the dark blue quilt ceiling.

A damp forest scent modulates through dark shadows, licking the moss-covered floor and wraps its body around water stained bark. In this place Denise is crowned a princess. The predatory shards of reality - a world in which she is labelled special - could not disconnect her from the embrace of Grandmas garden.

The secret garden world evaporates into the jostling clutter of Westfield Parramatta food court and Denise's crown becomes a visor emblazoned with the logo of a multinational fast food chain hugging her matted blonde hair, sewn together by sweat and grease.

The sales representative from Nu-Tech Software Pty Ltd leaves Denise wondering. Wondering how proud Grandma would be if she could earn all that money.

Some more updates on Nu-tech advantage (COns) Pty Ltd - www.nutechadvantage.com I recently got a call from one of the Sales cons who first gave me all the information (false promises) about Nu-tech advantage horse racing software! THat guy called me on my mobile and was trying to sell me this new software called "profit performer" which worked on the same principle. I heard him through just out of curiosity to know what these cons are doing now to other innocent people. He tells me that Nu-tech advantage is now their competitor and all that BS* He tells me that he can show me a demo of how it works and the market value of their software is some $30,000 (HAHA). I told him that I had Nu-tech software and they have stopped sending any feeds into my software. I also asked him to ring back within 15 mins for the demo. He must have spoken with his boss and found out the history of my case with their company - so he never called back... The point is that it is operating under the same principle and probably under a different name. Whether it is the same boss who is operating Nu-techadvantage and the so called, "Profit performer" software, is irrelevant! What is relevant is that they are all operating under the same scam principle and looting all the innocent people! Their guaranteed profits is just a scam! How can one guarantee profits through horse racing betting???? I was a bloody fool to believe Nu-Tech advantage. I just wanted the readers to beware of this. One thing that I fail to understand is - why is the Australian police and the Government not auditing them and doing something about the complaints they have received from so many ripped off people. How can such company rip off people, use all the profits they have earned by ripping people off, then make their "ABN" COmpany name Bankrupt and have no personal liability as the company is Bankrupt,,,,and then float the same product again through a different skin and a different company name????? I hope the police does something soon before many other innocent people are conned. Beware guys...I have learnt my lesson a hard way.

Dear Brenton, I was so confident that I would win the case when I appealed for it, but unfortunately they rejected my appeal request. The judge during the first hearing of the case didn't see anything my side for some reason. I felt I didn't get justice and the other party's word was taken over my word due to total lack of written evidence of the refund policy that they had explained to me verbally. The judge has asked me to resell the software and the Nu-Tech people have been asked to help train the person I sell the software to. I was given only two option by the judge, to either try and resell the software or just use it myself and be happy with it. No other options...At the end of the day I said I actually have no other option but to choose to resell the software. The judge then wrote something, the other party left laughing and I was left crying. I am so so disappointed that the judge took their word over my word. When I applied for an appeal I got reply for them that I cannot appeal because the judgement in the previous hearing was taken with my consent (I was shocked, as one can imagine). It seems that because I was helpless to choose one of the options out of the two options that the judge had given me, I had consented to a judgement and thus I cannot appeal no matter how much more evidence I have accumulated. My $17,000 went down the drain...Goodness, why didn't I read this article of yours before I purchased it? All my curses to those people who run this business of ripping others off their hard earned money. I don't even want to resell it to any other person and accumulate the bad karma...what can I say now. A lesson learnt a hard way; a $17,000 lesson that will haunt me all my life.

These are just general comments about the legal strategies adopted by companies such as Nu-Tech. The first questions to ask is 1) Did Nu-Tech provide you with third party finance to purchase the software? If they did, they need to have complied with Consumer Credit Code and made the appropriate disclosures about interest rates ect. The main line that the company will most likely run is that the product works and that you are not properly applying the method taught in the training sessions. Section 42 and 43 of the Fair Trading Act (NSW) 1987 maybe relevant to your case. But I suggest that you obtain legal advice whether from a private practitioner or a community legal centre in your area in order to get assistance in drafting up your submissions and claims to the CTTT. But I suggest that you approach a Community Legal Centre with your problem. Best of luck.

Bretton, thank YOU soooooooooooooooo much for this article of yours... I just wished I would have read this before I got scammed by the same company you are mentioning. The sales consultant of their company told me that it is a "sure thing" and there are "guaranteed profits" to this. He also told me that if I am not happy then I can always ask for a refund during the training sessions. Thats it! he kept quiet with the refund policy at this point. Then I got interested because I thought they are genuine to give such a offer of refund as well. I got interested because he showed me the so called "profits" that he had made only during today's race After purchasing the software I realised that even when I click a button on past won races and not the lost ones, then the software paper trades and shows up those profits which were not "real" time profits but just fake manipulated by the software to help them sell it. THEY NEVER GOT ME TO SIGN ANY DOCUMENTS ABOUT THEIR REFUND POLICY...LIKE CAN YOU BELIEVE THISSSS??? NO SIGNATURESSSSSSSS, NO FORMAL DISCLOSURE OF THEIR REFUND POLICY WHEN THEY PORTRAY AS IF THEY ARE ALL PROFESSIONALS....WOULD A PROFESSIONAL COMPANY DO SOMETHING LIKE THIS????? I asked them for a refund and they showed me their "CLAWS", their true colour... Now all of them say that their refund policy was such their I can ask for a refund on during the first three training sessions....CRAPPP...NO one ever told this to me... I lodged my case with the COnsumer Trader and Tenancy Tribunal. The sales rep who now tells the judge that he explained everything clearly to me, even the three training session refund policy and also that it entailed "RISK" and that it was "NOT a sure thing"... Because I didn't have any papers to prove my point, the judge settled the case by saying that they are not to give me a refund on the basis of everything being vague on both sides and he said that I must try and resell my software to some other person for which Nu-tech advantage will help me....GOODNESS! I cried a lot even in the hearing room and after coming out of it... I could see the wicked smile on Nu-tech people's face. JUSTICE, I didn't get... BUT AFTER READING YOUR ARTICLE, I GOT HOPE...I WILL NOT LET THIS TO HAPPEN TO OTHERS NOW... I HAVE JUST CHECKED WITH CTTT THAT I CAN APPEAL THE JUDGEMENT AND TAKE IT UP...I WILL ALSO GO TO THE SUPREME COURT UNTILL I GET JUSTICE... I WANT MY FULL REFUND AS THE SALES REP HAD TOLD ME...
