I recently made payment arrangements with NCO over a Capital One credit card. I set up 3 payment plans and paid the first one and contacted them today to let them know that I would not be able to make the second payment. I was transferred to a very rude Don Martin in the legal department. He asked me why I got behind on the payments with Capital One in the first place and I explained to him that at that time, my son's (who was 9 at the time) father had passed away and that I was off of work and did not get apid for the time that I had to take off therefore, I was unable to pay the bill. He stated that a death in the family is no reason not to pay my bill and continued to say that you have paid all your other bills and I told him that I feel gas, electric, water and rent are more important to me then a credit card bill.

I never disputed that I owed this bill but they certainly do not have to treat people the way that they do. I will not pay this off even after him threatening me with a lawsuit including attorney's fees. He also stated that he will be doing an asset search on me to which I stated, go ahead, I have nothing!

Why has nothing happened to this company if there are so many complaints against them?

Katherine. My suggestion would be to continue to pay the bill since you have already made one payment, and that way you may avoid future fees, interests etc. As long as you send them money and continue to pay( any amount no matter how small) on what you owe, NCO can't really do anything. My understanding is they are not a true collection agency, in that they are third party (although if they are the issuers of the credit card not sure what in's and out's of that are. Why has nothing been done to stop the company? My opinion is not enough people have pushed backed yet and NCO is wise enough to know if they make this a continued habit it will blow up in their face. Fortunately for us consumers, the very nature of NCO and other companies like them means they will slip up at some time and be caught in their own rope, so keep reporting and each reports adds weight to what will eventually pull them down.
