I was contacted at work on 3-10 at 3:20 P.M. by a collector names Jemiel Sample. My coworker took a message, as I was in a meeting. When I returned to my office, I was informed that I got a call from a lawyer, calling about "a legal matter," and that I needed to contact them as soon as possible. Leaving a message with someone saying 'legal matter' is a violation of the FDCPA, as it implies legal action and is a hint to the person taking the message, that the person owes a debt or is being sued. I called them back to see what the debt was, because I am sure I probably do owe. I requested not to speak with Jemiel, since he had violated the FDCPA. I spoke to two people, one being Sheila Bohanan, that both refused to tell me what the call was pertaining to. This is also a violation of the FDCPA. The final violation that NAR has committed is harrassment at my place of employment. NAR calls my job at least 5 times throughout the day. Even after they have left a voicemail or a message with a secretary, they still call. They have also been asked by myself, as well as my supervisor, not to contact me at work, but obviously their collector did not note that to my file. I am aware of the laws of the FDCPA, as I used to teach the FDCPA class at the collection agency that I work for. I do plan on filing complaints with the FCC, FTC, and the ACA, and the BBB. I just want people out there to know their rights as consumers under the FDCPA. If anyone has any suggestions as to how I can sue this company for the FDCPA laws they violated, please respond.

Ashley, You can have some fun and get some payback on these idiots, and then still sue them for the FDCPA violations. Don't get mad, GET PAID!! Here's how: Make up a CEASE COMMUNICATIONS request as previously suggested, but don't waste your time and gas and your 6 bucks on these tools. Make 150 copies or how ever many the fax machine you have access too can make. Wait until about 1 hour after the collections office closes and send them the whole stack. Then send it again. Keep sending until you get a send error, which means the recieving machine has either run out of paper and/or toner and/or has filled the memory. Now they cannot say they did not get it. Continue this every day until you feel good about yourself. Then, call them to confirm they got your cease communications request. Now, get signed notorized statements from your boss and co-workers about the nature of the messages and number of calls they made to you at work, and that you requested that they stop calling and they ignored your request. Sue them in District court. You can get up to $1000 in punitive damages, plus costs.

First of all, if you think that the claim is bogus, NEVER say that you owe anything and never agree to make payments. The burden of proof is on THEM to show that you owe a debt. If you have told them either verbally or in writing, not to contact you re: the matter then they are supposed to stop. You should probably also send a "cease communication" letter certified return receipt requested. I found an excellent resource for dealing with these things at www.budhibbs.com. He's a consumer advocate who can tell you how to deal with debt collector harassment. You can even email him personally regarding your problems. He has helped me greatly. Also, if you look up the National Association of Consumer Advocates (I think it's naca.net or naca.org), you can find an attorney in your area who specializes in dealing with these matters and they will also be able to help you.
