I leased a motorcycle with the option to buy with the last payment. I set everything up over the phone,and had to drive 3 1/2 hours to pick it up. So I was very clear that all details needed to be dealt with before I came. When I got ontrack motor sports I signed a contract for $13,000 and they took down payment of $2,400 out of my debit card.

The first thing wrong was the payment was more than we had discussed. He told me because of my credit they had to go from a 5 year to a 3 year. I didn’t really care, and was fine with paying it off sonnet. At this point they then tell me there is a recall on the bike and I can’t take it with me. They said they would have it fixed, and delivered to my house. They promised all details were in order before I drove all that way,but I had signed and paid already.

Now for the scam they tell me someone is going to call me from the finance company(motolease). They called and said you understand this is a lease with the option to buy ,and I said yes. That was it,and then 4 hours after leaving the dealer I get an email from motolease. In it is a revised contract with all the same numbers as the copy I have. That I had physically signed. Except now they had added $10,000 leasing fee, and electronically signed it for me.

I actually didnt even see this email until about a month and a half after the fact. As it turns out it was still a 5 year lease and my payment was so high because of this. When I contacted them they just said it is what it is and there is no cooling off period. also Going back they had delivered the bike to my house like they said. Problem was it was still in the same condition, and I had to ride the bike 6 hours to dealership that could fix the recalled part.

Then to make matters even better at the one and a half month point I get a registration letter in the mail saying my tags are due. This is when I looked at the email because at the time I couldn’t find my hard copie. All this time I had thought they just sent me a copy of the contract and that’s why I never looked at it. That’s how I found out they scammed me. When I called about the tags they said it was there fault and they would take care of it but never did.

I have found my original signed copy, and can definitely prove that it was signe and money taken from my account 4 hours before getting the revised contract. The revised contract does not have my signature on it and I can prove that I never opened that email until a month later. So how could I have electronically signed that cataract just 4 hours after actually signing the original one. I have been unable to find anyone to help with this and can’t find any laws about it. This place is horrible and just another example of Corparate America stealing from poor people in hard times. Disgracefu.
