Our original mortgage company sold us out to Midland Mortgage Company in 2002. By the end of 2002 we had to file Chapter 13 because Midland Mortgage Company started foreclosure. In November 2003 they camed payments were not made and started foreclosure again. We had them this time, because all payments were made electronically through our bank with yards of back up paper trails that proved our case, though we didn't have to go to court.

Then once again they have tried the same thing on November 2004, saying January 2004 payment was not made and they even sent back our October payment but kept November & December 2004. We hired a darn good attorney (ex-prossecutor) and are going after Midland Mortgage for harrassment and fraud. Anyone interested in joining this lawsuit contact us by replying to this notice.

I would like to know more and find out how the law suit went or is going. My parents had a home that we lost to foreclosure through this sad company. We received notice about a pending lawsuit and then we had to move. I had all the records and we were in bankruptcy 13 but they still took the house. My parents paid $55,000 for the house in 1988 in 2001 when they house was forclosed upon the balance was $75000 how can that be they never refied or anything it is BS is what it is. I would just like to know more.

I just received a latter in the mail today from Aurora Loan Services saying that my loan had once again been sold to Midland Mortgage Co. First off Aurora is one of the biggest scams I have ever seen and now it looks as if I am being scammed once again! If all of you are going through the same things I went through with Aurora something has to be done. My family and I can not and will not go through this garbage again.

Please give me information on how I can be part of your suit. We got back on a couple payments and agreed to be on probation for 3 months by paying $930 which was $200 more. We were told that after we show them that we could do the probation that we may go back to our regular payment. But instead they gave us 3 options which ended up paying about $30,000 and 5 extra years for the payments that we were behind, which was about $7000 total. We were trying to make other arrangements to catch up on the back payment just so we didn't have to pay the amount mentioned above and they refused, so we are in foreclose and we ended up in bankruptcy this back week. All this for the american dream!!!!!!

Similar Problem - Mid First Bank

My father is in a similar situation with Mid First bank. Approx. 1 year ago Mid First purchased my fathers mortgage and he has had nothing but problems since.Mysterious fees and late charges , rude unhelpful and frequently unresponsive customer service and on Dec 28th , a 10 day eviction notice tacked to his door. Mid First has refused to return calls or speak to my father regarding his account and even refused to return calls from his attorney. Nobody is willing to tell him the specific reason for the forclosure, what he did or didn't do to cause this or why he wasn't notified sooner. To top it off an affadavit of service of a notice of eviction was filed claiming to have served papers on my father and his girlfriend on a day neither of them were even at the house.Currently we are trying to chalenge the legality of their actions in Buffalo housing court on Jan 21 2005. If anyone has any information about Mid First that would assist our cause it would be greatly appreciated.
