Here is our horror story.

We are an elderly retired couple living a fixed income.

We met Max in April of 1997. He was the salesman assigned to our project by Armour Deck - a Phoenix Arizona concrete company.

Our project was completed in June of 1997. During this period, Max visited several times and presented himself as a nice, personable young man with a desire to get ahead.

While our job was being completed Max indicated a desire to start his own company in the same field. His analysis showed sufficient market demand to support another company.

Max presented a business plan in June and asked us to help start the new company. He wanted us to help fund the startup and to provide business guidance and counsel.

In July we loaned Max $31,000.00 to start Ultimate Concrete Coatings. This loan was set up to be repaid in six years, and for us to receive half of the company profit until the loan was paid. We received the title to Max's car, to hold.

For the remainder of 1997 we had numerous status reports from Max by phone and in person. While Max generally complained about slow progress, he usually seemed to be working.

In November Max gave us his records. They didn't seem to match the work he had described, and showed a heavy list of expenditures, He was also taking a large amount of company funds for his personal use. We complained loudly! Max became very defensive and told us very little after that. We never got to see his books again. Throughout this period Max showed no interest in following our business advise.

Shortly after the New Year ('98), we found that Max had left town. We were never informed, and only noticed that our phone calls were never returned.

We were able to track Max down through a girl friend, in Texas, that Max told us about. He had moved to Austin, TX (Roundrock) and was living with the young lady.

Upon reaching Max he stated he left Phoenix because we would not buy him a house, as he had wanted; and because he did not like my husband and his questions.

Over the course of several months Max described numerous hard luck stories, and in October of 1998 requested an additional loan to get out of his problems.

Max then made several small partial payments against his loan, along with requests for us to buy a house for him to rent in Texas.

On the checks, we received from Max; the name of SARAH LAGRONE appeared as though she was associated with the company in some manner. We were unable to contact her.

Max told us he planned to marry a Hispanic woman named Mary, She was a private care nurse for elderly patients. We tried to warn her, but were unable to contact her. We don't know if she even existed.

In the spring of 1999, Max again went silent. He would not return phone calls, nor answer letters.

We were unable to locate Max through any contact in Texas. We were able to get a contact through his first son who resides in Calgary, Canada with his Mother.

This contact yielded much information. We found that the business was quite successful. There was always work, and the company was clearing at least $2,000.00 per week. We also learned that Max had a history of taking peoples money. He had lost his first wife's parents retirement money. He was also over $30,000.00 behind on child support payments to his first wife. It came out that he wanted his son to move to Texas and that he would then put the business in his sons' name. It also came out that shortly after our loan to Max, he had purchased a car for his son.

Following this contact we had an angry and insulting call from Max, warning us to stop calling his son and ex-wife. He also told us we would never see a penny of our money nor would his first wife see a penny of hers. He stated he would just file bankruptcy if we tried to collect.

At this time we contacted an attorney. We were advised to contact the attorney generals office as they were after crooks that preyed on senior citizens. This turned out not to be true. The attorney generals office wasn't interested - told us it was a civil matter, and to contact an attorney; that they only represented the state. They stated that it did not matter that Max had not paid child support or that'he had fleeced his first wife's parents. We tried to enlist several collection agencies to help us but none was interested and attorneys said good luck some wanted over $10,000 in a retainer.

During this time we came across the real estate agent that had rented space to Max for a gym, prior to the time Max worked for Armour Deck. He informed us that Max had not only left owing rent, but he also stole the gym equipment. He informed us that Max had signed up customers while planning to close, and did not refund unused memberships. He further stated that some of the customers hired an attorney, and that the case was turned over to the attorney generals office. They dropped the case!

When I called the attorney generals office to inquire as to what happened I was told nothing, and essentially chastised for calling them. A supervisor was to return the call, but never did.

We continue to explore ways to recapture our money, but more importantly we want to prevent Max from taking advantage of others.

Max encourages his son to participate in youth sports, particularly baseball, soccer, and basketball. He likes to coach these teams. He is presently coaching the senior eagles basketball team in the golden eagles league in Texas. This is not the type of person who should be allowed to train children.

We are on a fixed income and counted on this money to support us.

*EDitor's Comment The reason why we have removed links, e-mail address or phone numbers from this report is because people have, in the past, attempted the following, ...all too often. Posting LINKS Many times links to unknown web sites will cause your pc to freeze up and /or cause you to get a computer virus, virtually rendering your computer useless. Most of the time, this is the work of a Company or an Individual who has been reported. Many Government links are no better than the BBB and are just a waste of time, giving you false hope. Many government sites (like the BBB) just collect all information from you, the consumer, but never make that information available, so consumers will NOT be educated as to what exactly they should be looking out for. On the other hand, many government agencies have and do come to the Rip-off Report for information. We have been assisting many government agencies for some time now, including the FBI and Attorney General offices from around the country.. Now that all these Rip-off Reports are out in the open for everyone to see, in a way, this embarrasses these agencies into doing something when they see so many reports on a Company or Individual, because they are now out in the open for all to see. Unfortunately, many (not all) Attorney General Office's and government agencies will not move against a rip-off unless there is going to be some sort of publicity on the rip-off. By reporting your experience on the Rip-off Report, is the next best thing to getting your story on TV or in a newspaper. Most national TV networks and many local TV stations from all around the country come to the Rip-off Report for information they will not get from the BBB, Attorney General office's or any other government agency. Rip-off Report has instigated many local and national stories, resulting in help for victims, in one way or another. Most government agencies will never even bother with rip-offs unless it involves $50,000 or more. Now that the government is cutting back even more dollars for these types of programs, this number will even get higher and we can expect even less to get done, by even less people to work on all these rip-offs. LAWYERS : We have also struggled with the following for a long time.. The reason why we delete phone numbers, ..all too often unscrupulous lawyers or individuals posing as lawyers are collecting victims information to only further victimize them. Many times, well-meaning consumers think they are going to collect names and get them to a lawyer who will do something. In every case we have allowed a consumer victim to do this, nothing has ever came of it. Consumers were under the impression that something will be done to get them help. In every case this did nothing but lead the consumer on, further victimizing them, and some consumers were mad at us. We feel it is our responsibility to check the legitimacy of the lawyer before advertising their service on the Rip-off Report. We will also not allow lawyers to use this web site for free when they will end up taking a large amount of fees, leaving the victim with very little. There are many competent lawyers out there that know how to get the unscrupulous Companies or Individuals who ripped you off, to pay their fees. Those lawyers capable of this can post their numbers after checking with us here at the Rip-off Report. POSTING YOUR E-MAIL ADDRESS: For similar reasons as mentioned above, we will not allow individuals to post e-mail addresses, so they can be contacted for more info they claim they cannot post. If that person can contact YOU and get the information, so will everyone else be contacting you anyway, and, if it's good enough for them to receive it by contacting you, then you should be able to post that information for everyone to see and know about. And, many times, in an attempt to get your contact information, consumers will leave an email address; this is just a ploy to sell you a product or some other service. Ted Bundy was the "Nicest young man," but he molested and killed over 40 young women. Jeffrey Dommer was the nice, quiet young man who lived in the neighborhood for his entire life. Everybody knew him to be hard working and honest. He took care of his parents while they were alive. It's just a shame they found all those bodies of young men buried in his basement.

WAKE-UP FOLKS!! Step back and take a long look. A leopard can't change his spots, and a pathological liar and cheat, can't go straight forever.

Why would someone in Arizona go to the trouble of looking for a guy who just happened to move to Austin at the exact time they said he did? Someone made the comment that after being ripped off for $30K, $10K shouldn't be much of a bite. You gatta be an idiot. Haven't you ever heard the old saying, "Why throw good money after bad?" The attorneys never guaranteed any success, they said they would look into it for $10,000. I don't know about anyone else, but I would be willing to look into almost anything for a $10K retainer. I could do it on the internet, and just say, "Oops, I couldn't find anything significant, but I spent all the money in the process."

I will guarantee this to all of you who are blindly supporting this guy. We are all humans, and we all have human frailties. Your's is to believe just what your eyes tell you. If you wait long enough, this guy will do something, sometime, that will immediately change your opinion, and will probably make you very mad at yourself. We all go through rough times, as he will surely do, and he will then show his true spots.

Was it Dan Morales?
Who was the supervisor who didn't return the call?
We need documentation and also need to stop giving
crooked politicians and bureaucrats anonimity.
Crooked and criminal-favoring, victim-ignoring judges also need to be exposed.

These individuals work for us, not the other way around, and it's time we forced them to account for their bahavior.

Let us all keep good records (logs) of all our
contacts with both the public and private sectors
and be able to document every phone call, date and time, names of all individuals contacted and those who contacted us and the promised outcome (if any)and whether the promise was kept.

I know it's a lot of work, but if this government
really is to be of, by, and for the people then WE
the CITIZENS must take ultimate responsibility
for policing our government.

I am responding to RIPOFF#1576; I cannot believe that someone would say these things about Max Ivany. Someone is sending our spam mail to parents associated with him team to discredit him for personal reasons. I spend about 3 days of out each week
with Max due to my son playing basketball for him. I have seen nor would I even consider the accusations that have been stated to be true. The kids are very fun of him and he certainly gives much more than time to these kids. he has yet to ask parents for a dollar and he presents records up front to show what expenditures are being made and taken. Regardless of his son wanting to play or not (which I can see in his eyes that he wants
to and loves it) he gives great time to helping the development of basketball players. Some of the children are very fortunate to have him provide this opportunity and it sounds to me that you are also unaware that he is also a father figure to a couple of these kids. Do all caring parents a favor, and give it a rest. It's obvious that this is a personal vandetta. You tell of all these horror stories above and yet everyone that you talk to for some reason couldn't help or wanting 10,000.00 dollars
for reporting him. Give me a break; if you have a legal binding document which I'm sure you do for loaning someone 31,000.00. certainly this would have been filed. Show you proof, put these documents on the web to be seen. No one believes this but you and will not because this is blasphemy by some one whose trying to get faith credit by all places the WWW. Must be a joke. Sounds to me like you've also been interrogating Max son,

I do not know anything about the charges made in this particular report. However, my son has been playing on a basketball team that Max is coaching and he has been very generous in the way he has supported us. He has never asked us for anything other than to help out in a fundraiser now and then.

I would be very surprised if this report were true because it doesn't seem to be consistent with the things I have seen and observed.

I personally investigated this report...

Would you like to call the victims and speak with them for your self, ..then make a judgment? These are not the only people he has scamed. Ask Max how he got the equipment to run his business. Would copies of the checks signed by Max help? Then you can ask him if he could show you how he paid the money back to these old people he scamed.

If you were telling us the truth and you were not put up to this by Max, and your child is hanging out in their home, you would not be taking this with such a grain of salt. .. your full of it!

If this were not true, Mr. Ivany would be filing a law suit. He won't because he knows this is the truth. He is a Rip-off Liar scum bucket. Yes, we know very well that Max is involved in the little league, he has friends in the neighborhood, that part of his cover. Their house being set back so far where you can hardly see it would make me paranoid if my child was back there.

But, we hold not grudges. When he rips off you or someone you know, you are welcome to contact us too. ..we know that can't be a true REBUTTAL.

I know the where abouts of Max Ivany but I am in no way associated with the company. My son and his son are best friends and they spend a lot of time together. I also know Max and when I found this article I was shocked and appalled.

I am truly sorry for the inconvenience that this has caused you and I truly feel your pain. My question is why would you do something like this and if you are trying to collect what is your plan of action. I cannot stand people who prey on such.

I hope that you find the light at the end of the tunnel on this and can get your life back.
