Complaint Review: Law Offices of Phillip R. Sauer - Internet

The Law Offices of Phillip Sauer claim to be a legitimate law office but in reality they are a bunch of hacks who try and harass people into paying debts.  They employee these low level people who are instructed to repeatedly call you and harass you to get you to pay debts that are in dispute.  They use tactics like threatening to sue and they even represent themselves as lawyers in order to scare small business owners.  

They will call your business, send you emails and make claims such as the following:

• File a lawsuit
• Garnish wages
• Garnish bank accounts
• Penetrate the corporate veil to come after you personally
• You misappropriated assets 

THEY CAN NOT DO ANY OF THE ABOVE.  Do not respond to these A holes and my advise is to get a real lawywer and send them a notice instructing them that all correspondance must go through your lawyer. 

Here is a sample email that they send to their victims:

In the event there is litigation, we will attempt to recover not only the full amount of the account, but also, if applicable, all accrued interest, applicable court costs, attorneys’ fees, and other expenses, including but not limited to deposition costs and citation fees. In the event you attempt to defend this matter under a theory that you conducted this business as a Corporation, we would dispute. We also feel obligated to advise you that, in the event a judgment is awarded in our client’s favor, we would look for evidence that would pierce your limited liability entity veil, and enter litigation against you personally and all other potential principals, successors and affiliates. In doing so, we would look at the comingling of the business assets with those of the individual principals. Additionally, we would look at the reality of the corporate existence as evidenced by the keeping of minutes and other corporate records. We would explore the possibility of an obvious inadequacy of working capital, and would also determine the number of non-functioning officers and/or directors. The possibility of non-payments of dividends would be investigated, possibly coupled with payment of substantial salaries or other forms of payments to dominant shareholders. We would also look at all of your expenses to determine if your business was paying your personal expenses, such as excessive meals, travel, cell phone bills and automobile expenses and the legitimacy of employment of family members. We will seek Attorneys’ Fees against you for having to engage in all post judgment proceedings. 

In the even a judgment is entered against you, we will engage in every method of post judgment remedies to recover the amounts owed to our client. This will include, but not be limited to, the freezing of accounts, debtor examinations, levying against your real and personal property, and filing citations against any and all parties you transact business with. We will trace funds and if we find that you have transferred assets in violation of Fraudulent Conveyances Act, we will seek to have these assets re-conveyed to you and sold to satisfy the judgment. If you are directly involved in another business which is not in your name, we will investigate the business thoroughly and seek to have the business re-titles in your name and sold to satisfy the judgment. We will record a Memorandum of Judgment against you and it will negatively affect your credit, making it more expensive and difficult for you to borrow money.

As we have illustrated, the amount of our legal fees, the Judgment, court costs, interest and your legal fees would likely be very expensive for you. In order to avoid the time, expense, inconvenience and embarrassment associated with litigation, we strongly recommend that you timely pay the settlement amount.

ALL OF THE ABOVE IS BS!!  It would take them years to do any of this and it is purely a scare tactic.  Do not pay them or anyone they represent anything!!
