I am writting the report being completly annonamous as I am scared for my life and my entire familys life disclosing this information to the country and the world but feel if it isn't done, things will never get changed and alot of innocent citizens could go thru what I did!

I will start at the begining and will be changing names to protect me and my family. I grew up very poor in Lafayette Co Missouri. We had no running water, my parents worked very hard for little to nothing, we lived on a farm around lots of mid-classed people with very s****..

I know first-hand what it is like to be the victim of a crooked justice department.  I am sorry that you have had to go through this.    The police, law officials, and court systems know exactly who to go after--the poor!   The poor can only accept a public defender, which means they will usually be DOOMED to lose their case.  The lawyers and justice department knows that almost ALWAYS, a poor person will take what PLEA DEAL has been laid out before them, because they don't stand a chance in court with a public defender.  

From my own experience, I have found that the best thing I can do FOR my son is to search the internet for information and for government addresses of place / people who MIGHT be able to help in some way.  The U.S. Marshal's have been wonderful!  I have written to State Representatives, Governor's, various board members, etc....   and usually get a response.   Some of them send me on wild goose chases, but after much letter writing and phone calls, once in a while I meet someone who is willing to help.

You cannot give up!   You have to keep researching, and writing letters, and making phone calls.   Keep the letters as short as possible and have someone edit them to make sure your spelling is correct.  I had a problem with the Sheriff's department in another  county once, and looked up the Attorney General's contact information on the internet.   I sent him an email, and before long, they had contacted the sheriff and TOTALLY TOOK MY SIDE.   The Sheriff had to make amends with me.  PROOF that IF we do NOT give up, and if we keep making some noise (respectfully, of course) about it, someone WILL hear us, and something will be done.   Don't give up!!!

I read your article and I am reaching out for anyone to help my family from this evil county up there and the prosecuting attorney.
My husband was in his work close helping someone when they got arrested and they thought he was a nobody. we didn't hear from him for 5 days and when I finaly found out where he was I called the jail and they said he refused his phone call. Come on why would someone not take the opportunity to let his family know where he is.????
He got arrested at night around 9 pm.. yet finally  days later pictures come into play, but taken with the sun at full noon with this so glad stolen goods in the back of truck.
How can they do this legally and get by with this.
There has to be accountability to the justice systm somewhere.
They set the bond high - CASH ONLY.. now we find out it was supposed to be a cashiers ck.. but on 3 separate times when they trumphed up new false charge we paid cash ... NOT a cashiers check required by the IRS.
last bond was $100,000.00 cash. like people have that kind of cash.
but if they can bury him in the legal system and mess up his head by putting him in solitary , dirty and no running water in this year 2010 and 2011 and won't even let his family talk to him.. stating he knows what he did... his family filed complaints against that county and took it out on him.
They don't like people that stand up for their rights or the right things.
How did the law give them people up there so much power to do what ever they want  to people.
They have humilated my husband and my family.
This is not right.
I refuse to live in our home, it has been broken into 2 times, so I put in on the market to sell it and live somewhere quiet till this is over.
We are trying to get this in the appeals court.
they may have gotten rid of my husband... but not his family...

There has to be many other people due to this seems to be standard procedure to treat people innocent or guilty up there like dogs.

My husband tools in the back of his  truck he uses for his job ... he was charged with buglary tools and we can't get them back.

Why did the only witness claim he couldn't write and the police office wrote out the complaint for him...
why wasnt he in court that day.
and why didn' t the court make my husband pay restitution???? why because then they'd have to have a real victim to pay and they would have to be accountable to show there was no real person.

That prosecuting attorney has lied and we have proof and also how she falsified legal documents to satisfy her agendy at the expense of my husband's life.  this is so wrong. SHe needs to be called out on this by a higher court and investigated.

This night mare has brot my family closer together.
I did mention the 3 weeks they had him in lock down... only because he has the guts to stand up for his rights and to call them out on what the prosecuting attorney and judge is doing up there.  they have an attitude we will show you. THis is so wrong.

This 2 year nightmare has to come to an end when they rule in the appeals court. but that can take up to 2 yrs.
We have had 3 attorneys that has tucked there tails in and did what ever that county wanted.
They gave my husband 27 yrs for a non-violent... no victims crime.
He is in with hard core criminals. 
AND THE TRIAL... i rememeber the comment from the county clerks office when I called up there... " oh that is that unusual case that went straight to jury trial"
The attorney made out like there wouldn't be a trial. it was never posted on case net until that morning. They already had 30 jurier to picked from.
13 of them a cop or related to a cop, and 2 of them had cases before the judge in the past 6months yet no one spoke up. THIS is considered a rigged jury and we have filed a noitce in the file of the jury's name and 5%  of the population has to be at least be on list to choose from.
And the jury instructions....state if he was just even at the scene, they have to vote guilty.  Is this legal.
Someone out there has to know how to help....
We plan to file complainst when all said and done... but until then my husband is sitting in prison, with his family out here trying to pay for the outrageous legal fees and trying to support our family at the same time.
THIS COUNTY NEEDS TO BE INVESTIGATED.

   WOW, what a story. I believe you have been wronged by THE LAFAYETTE COUNTY sheriff's department and I hope you have found or find an attorney with the balls to fight the system. I am aware of curruption in the Sherriffs department and from the same officials that accept our tax dollars to pay their salaries. My situation is different from yours, and the end result has not yet been determined, but I can assure you I have retained one of the best criminal attorneys in the state.

   Lafayette County investigators/detectives do not follow the rules of criminal procedure. They feel they are above the law and their system of investigation better meets their agenda. I would encourage anyone to contact an attorney before talking to an investigator/detective from Lafayette, County Missouri.

I understand that you are taking civil action against your husband's sister. While you may obtain some satisfaction from penalizing your sister-in-law,the secondary cause of so much pain for your family is the unprofessional conduct of the local sheriff's office and prosecutor. Your husband stated in his first post that the prosecutor dropped the charges. Prosecutors do not withdraw charges unless the investigating agency (i.e. the local sheriff's office) made substantial errors that would create weaknesses in the people's case against you. It is because of this that I strongly suggest you take civil - and possible criminal - action against the local sheriff's office and/or prosecutor. You have lived through hell. There may be others who have suffered or may in the future suffer - break the cycle of suffering by taking action. I also strongly agree with Melanie. Get the body exumed and examined by a private entity. Please keep in mind, however, that this may be costly, and you may have to demonstrate the uncle has no wife/children who would object to the exuming of the body. Please understand that while your situation is very heart-breaking, do not rely on others to take action on your behalf. While it would be nice, the possibility of this happening is not in your favor. The process is going to painful, take a lot of energy and money. However, keep in mind while you are going through this the potential results. First, if you win a civil case against the local authorities, the punitive damages should recover all of your costs and provide income for the future so you can move out of that county and move on with your lives. Second, you will be helping others in your county by stopping the cycle of inept officials running the show. Third, the case will most likely receive national attention, so others who have been in similar circumstances elsewhere may have a gimmer of hope. And nothing makes an individual happier than being able to tell a person that you have been down that road before and give them hope. I wish only the best for your family.

You said that they did not do an autopsy on your uncle. You can talk to a lawyer about exuming his body and having an autopsy done. Make sure you ask that they test for substances that may not show up if you don't specifically look. I.E. Arsenic poisoning cannot be detected unless u look for it, and it can show signs of heart attack.

Thanks for the help!! Thank you for your replies.. We would like to hear and get help on anyway anyone can help us out.. We do have plan for civil action, agianst his sister.. We hope and pray she pays for her lies and games, that she plays with us as well as the law.. It is really sad that they took this case with no evidence at all besides her word.. She had nothing, but we had all kinds of evidence.. The detective who did this case didn't listen to a word we had to say.. He was a real a*****e I must say. He didn't do any investagation at all.. The funny thing is, during her depision she called him a lier, and she also stated that he fausified the first statement she gave to him.. And she also admitted how she lied to an officer in Branson Mo because her husband had a warrent, so she told the officer he was her brother, my husband, and gave his ss number to the cop.. So she plays with the law.. And she should pay for this crap. The sad thing is that when a girl really does get raped, they want proof.. Example.. When I was sleeping in my home in my bed, a man came in to my room and touched me and did his busniess on my body.. We lived in lafayette county, at the time.. My bestfriend called the police, they pick him up and he told them he did this to me, but you know what they told me.. He wont get no time for it so we are going to get him on buying alcohol for miners, because i was only 20 yrs old.. Remind you this was Lafayette County, the same county that arrested my husband on rape, with no proof.. Tell me what kind of county that is...... I hate them. And they are sooo very corupt.. They took a girls word that she was raped 15 yrs ago, her word only, no proof and arrested my husband,in front of my 6 yr old and 1 yr old, that is so close to their daddy, put him in that hell hole, no phone calls, spread lies to others, he got beat on and threatened.. He was so skinny when he got out that my one yr old didnt reconize him.. Had three bad teeth, that was so infected when he got out, that they had to be pulled.. They gave him no medicine for it,or no doctor visits.. He was not the only one who went thru hell, Me and our children did too.. I was only making $6.00 an hr making nothing, It was cold outside and we was having electrical truobles we all had to sleep in one room to keep warm, with a space heater because if we turned on the heat, a fuse would blow, so we had to use the space heater.. Our children had no x-mas in 2002, because their dad made the money in the family. Mine was just pocket change really. I really didnt have enuff to pay for gas back and forth to work, plus to drive and see him once a week.. We had to sell our home when he got out just to pay for his attorney because there was no way in hell we was going to take Lafayettes public defender.. the sad thing is his bond was only $50,000.00 cash only to start and when we asked for ten % to the court they said yes but raised it to $100,000.00 . They had people in there for murder who had less bond then him. We know that his sister and or her husband killed his Uncle, but they wont do anything about it.. Which is so sad.. He was a good man, honest man, and never hurt anyone.. He always help us and the rest of the family..To find him past away in his home just killed us, and to have them say heart attack, case closed with out a corner to check is just wrong.. We, i even told those deputies about finding his cat dead by his bedroom window and the break in to his shed, the fact that the side of his head was bruised and most inportant he was a witness on a 6 count felony case, in which was released 1 month prior to his death, plus the f**k you spray painted on his trailer, just days after the release of the witness list. If anyone reads this and has any power to investagate this please do so. He desirves to have whom ever (sister) killed him behind bars.. Please let us know of more help..

Do whatever it takes to make your case known

First, I empathize for you and your family. You have experienced a horrible situation, and have been damanged emotionally. Please know that you are not alone; many others have lived through similar circumstances when dealing with completely unprofessional law enforcement and prosecutors. I hope knowing this brings some comfort to you. Now, you beleive you have been victimized, and I agree with you. Because you were able to post on this site, I am running on the assumption that you have reliable access to the internet. If not, please spend some time at the local library or other organization that is able to provide internet access to you at no cost. You need to hold the local officials in Lafayette County accountable for their actions. Here is what I would recommend. 1)Make a copy of all of your court documents, then place your originals in a safe place that only you and your wife know about. Use the photocopies for your research and work. 2) You and your wife need to sit down and write two documents. The first is a listing of all factual information - leave out all emotion on this fact list. The second is a listing of information that you beleive or felt, and how it relates to your factual list. The reason I suggest you take this step is because facts prove the case, and emotions influence the punishment the defendents will receive. 3) Find every personal injury attorney in your locality who provides free initial consultations. Meet with them. Bring your working copies of the court documents, and your lists. Tell your story, answer the attorney's questions. Please understand a couple of things here. First, there are attorneys who thrive on holding public officials and entities accountable, so I beleive you will find an attorney to represent you on a contigency basis. Second, it is going to take time to find the right attorney for you; you will speak to a lot of attorneys, and may end up finding one who is not located in your town. 4) Do whatever it takes to make your case known. Write letters to editors to local papers. Post on multiple web sites. Contact investigative reporters. Seek support groups, or start one of your own. The more people you can find who have had similar treatment by the local officials, the better stronger your case may be. There are many organizations that provide support to those victimized by our judicial system; seek their assistance. 5) Be cautious about mentioning the purchase of your story for publication. Readers may perceive that you have a motive behind sharing your story that is not of good intention. Also, I ask that if you decide to persue a legal case against the local officials, please keep us updated at Rip-Off Report.com. I, as I am sure many other regular observers to this site, will offer suggestions to help you along the way. I do ask, however, that you understand that I am not an attorney, nor am I in the legal profession. I am simply a regular observer of this site, am an observer of our government and public entities, and simply desire to offer assistance when I beleive I can help. I want to start out saying how truly empathetic I am for you and your family. I am sorry for your loss both with your uncle and your sister. I'm not quite sure about the laws where you are, but here in PA we have laws that protect prisoners. It stats that we must have food, water, and "exercise." I think that you NEED to start talking to lawyers, state legislature, gov't officials to enforce a change. You might also want to look into seeing what you can do about the releasing of a witness list. I think that is an inappropriate thing to do, and the example unfortunately is your uncle. I know my next suggestion may be hard for you, but you should look into either some kind of charges against your sister and her botfriend for falsely accusing you, and get a PFA order for you and your family or sue her for defamation and falsely accusing. If she knows where you are- you should relocate and make sure she cannot locate you. I.E. do not be in phonebook, don't tell ppl who may tell her, etc. I wish you luck with this mess. Your in my prayers.
