Okay, I don't even know where to start. My husband and I have been looking into buying a car for a few months. We are young college students with kids. We would be trading in one of our beaters and using a portion of left over Student Loan money to get the vehicle. We both work full time but have 4 young children. Money at times is a sparse commodity. Anyway we went to Joe Cooper Ford in Midwest City for a browse. Weren't exactly ready to commit to anything but just wanted to look. We where helped by an Amanda Knox. She seemed nice enough and we thought we had the trade and then we had money coming the next week that would be fine. Of course she couldn't get us into what we were looking at so she brought out this 2000 Ford Expedition. It's nice and seems to run but we both have long commutes and it already is over 100,000 miles. Well we have dings on our credit so we kind of have to take it up the rear and go on. We drove it but still weren't sure. She asked us about a downpayment. We were upfront and honest. We had the car to trade and money next week. "Oh that's no problem" She makes the 9 million trips into the sales managers office and says "that's great here's what we can do" Shows us payment's terms etc. Sounded good so we went for it. Well it came time to sign the papers and the finance manager asked about our downpayment. We said you already have our car and we will have the rest of the money next week and we specified the day. He said he had to have a check in hand to complete the deal. We said fine we don't have the money and we will just come back next week. They were persistant we not leave and said just give us your check and we will hold it til next week. Sounded good because we had done this before and nothing bad came of it. Now here is what 's happening. Of course the bank is not honoring a check they presented for payment because my balance wold cover just over 1/2 of the check. Duh!!! We told them>... He calls and wants the money. I told him we will have it next week. He is talking now that we could be in forfeit of our loan...What?? We told them and we were honest.. we even got up to leave. Crazy thing is they had already made off w/ our car that we were trading in. Can anyone help w/ suggestions??

I missed the tail end of your report. The fact that they had already wholesaled, sold your trade-in vehicle retail without the loan being approved, or flat out lied when they said they already had done something with your trade-in (you were still in the finance office!)also is a huge no-no and probably illegal. You could have really held their feet to the fire on this one by demanding your trade back and if they had already sold it, either get a price that you demanded for your vehicle or talk to a lawyer. That is something you'll have to check into with the appropriate state agencies or your attorney to determine a course of action.

The line from the F&I (f-ing lie) person saying that you could be forfeit on your loan is total BS. The fact is that they needed the down payment right then and there was because so they could get the funding of the loan for the vehicle from the bank financing the note. To implicate that the loan was already done and financed and that you could be forfeit was total misrepresentation. It is likely that this person used this tactic to get the sale of the car to you closed out by month end to get it on the books. I'm a former employee of this dealership. The sales people who sell the vehicles for the most part are all right. However, the finance department is a different story. I can't count up the number of how many sales I saw blow up because people who initially were very happy with their experience with their salesperson quickly soured when they got into the business/finance office. Also, the tactic of trying to hold you in the business office when you told them you would come back the following week to give them the down payment is also typical. By them cashing your check right then and there instead of the following week, in reality they asked you to write a hot check. They are afraid that if you walked out, you'll go buy somewhere else. Never go shop for or buy a vehicle unless you have all the necessary elements in place at that time. Trusting the finance department to be reliable is like trusting in a house of cards. It's just not safe. Hope this helps
