Complaint Review: Jeannie Tolbert - Pflugerville Texas

on August 17, 2013 I signed a one year lease on a small studio type furnished apartment attached to the owners ( jeannie Tolberts ) home. Shortly after i started having people who were listed on original application state that they were recieving phone calls from mrs Tolbert ( my landlady ) asking about my where abouts. Shortly after I came home from work to find mrs Tolbert coming out of my apartment ( no prior written noticed was given ) . Then I awoke in the middle of the night to find a bug crawling on me.

I took to bathroom, killed it & wrapped in tissue. The next day I did a web search for the bug & discovered it was a bed bug. I reported said bug to Mrs. Tolbert who appologized, blamed the last resident & did call Terminex. Who came , did inspection & confirmed my fears of bed bugs. I had to miss days of both work & school to deal with all that has to be done to even be exterminated. Cost me a lot of $ doing all laundry ( apt has no washer/dryer ) buy plastic bags & ect. cost of missed work, matress covers ( she refused to purchase from terminix).

Then I tried to leave for work one day & my car was blocked in by the people who live in the trailer in the back of the property. So I called mrs Tolbert to ask if she could speak with the neighbors. She did not answer so I went ahead & went back & knocked on thier door & spoke with the neighbor who looked like he had just woke up & I could hear a baby crying. He was very nice & asked if I could give him a min. I told him I would just take my other car ( that was parked in street ). I immediately left for work.

Upon my return I saw mrs Tolbert in front yard , when I walked up mrs Tolbert started telling me I'd have to give at least 12 hrs notice before I wanted to drive car in drive way ( my assigned parking ) I told her that was obsurd & went in my apt. I was laying down watching tv & could hear someone on my porch when I open the door I found a letter telling me I needed to grow up. I leaned out door & upon seeing Mrs Tolbert she started yelling obscenities at me. I came in got my phone & called the police.

As I'm on the phone with dispatch she is still yelling. I sat on my porch waiting for the officers As mrs Tolbert continued yelling. I then called my parents very upset. Mrs Tolbert over heard my conversation with my mother & asked to speak with her so I took the phone to her but when she started yelling at my mom I asked for the phone back. The police came & first talked to neighbor in the back. ( who Mrs Tolbert had went back & gotten)  As I sat on my porch I could hear neighbors conversation with the officer & I heard him say that Mrs Tolbert had came & told him that I painted his car with shaving cream. ( all I could think was "what ?" )

I spoke with officers as did Mrs Tolbert. I went back into my apartment after officers left & minutes later my power went off. ( breaker switches for my apt are in her house ) later I went bk to ask neighbor abt the shave cream. He said he knew it was Mrs. Tolbert cause he had already moved his car & in doing so also noticed my other car was gone ( I had left for work ) The next day Mrs. Tolbert called my parents home & left a message stating that I was outta control & had no respect for her has my authority fig. & asked my parents to call her so they could discuss what they were gonna do about me.

Then immediately called right back stating that she is an MHMR patient & it's nobody's business & asked them to disregard & erase prior message. ( of which I have recordings of both ) then about 10 days ago my daughter came to stay with me. I had explained to my daughter the prior issues I had with Mrs Tolbert & told her not to answer the door to her unless I was home. I left for work & after about 15 mins after arriving at work I got a phone call from Mrs Tolbert telling me that my daughter won't answer the door & the she believed my daughter to be in danger.

I explained to Mrs Tolbert that my daughter was fine & I could not talk I was at work. As I am talking to Mrs Tolbert my phone started vibrating that I was receiving a txt. mrs Tolbert just kept talking even though I had already told her I was at work. I ended up hanging up on Mrs Tolbert. Then I saw the txts from my daughter saying mrs Tolbert was banging on the door & front windows yelling. I told my daughter to ignore her. After i spoke with Mrs Tolbert & told her my daughter was fine she decided that wasn't good enough & mrs Tolbert went back to my apt & began bagging on the door & windows again.

And then walked into the apartment, This scared my daughter who txt me again saying that as soon as Mrs Tolbert left , she ( my daughter ) was going to leave & seek refuge at a friends home. Which my daughter did. Upon my return from work I then called the police again. Then 3 days later , I had just come in from work & revived a phone call from Mrs. Tolbert asking me to come over. I said no. She then told me I had 3 days to move & stated that I had stole an 840. Money order off her door & that she called the police on me.

I told her I had no idea what she was talking abt & that I would speak to police but not her. The police came again. I offered for them to search my home, my person & my car. he said no he didn't need to & asked if I knew Mrs Tolbert was evicting me. I said yes. I of course began to panic abt where I would go & what an eviction on my record would mean for me. Abt a week later I found a new apartment & signed a new lease.

the same day I went to ask neighbor in the back abt the trace on the stolen money order. He said to me that yes Mrs Tolbert had cashed it. Mrs Tolbert told him she had it & cashed it. i told Mrs Tolbert that I was moving to wich she  left a letter saying she is suing me & ect. But I am moving I can not live like this nor expect my daughter to live in fear. Do I have any defense on her suing me For breach of contract ? This 6 months has been a nightmare !!
