We ordered a grill from them in April of '06 and sent them the color choices in June 06. We paid $2200 as a 50% deposit. They called and gave me a delivery date of Sept. 21, 2006. Exactly one week before delivery they called and said that they were merging with Paradise BBQ and that the delivery would not occur.

We called them in Nov. 06 to request a refund at which time we were told that no refunds would be given. He said "your only option is to cancel your order." We replied that we would not just cancel our order. When we told him it was an unacceptable business practice to which he hung up the phone.

We did say we would have to get an attorney to which he said "Go ahead".

If they are not going to deliver said item at a later date, then why not cancel the order? If the order is not canceled and sometime may come to you then why would you get a refund? It's just confusing as to why you would need to cancel your order if it has already been canceled due to the merger if it has not been canceled yet then you probably cannot get a refund yet.

They have $2200 of your money, are not going to deliver your unit, and refuse to give your money back? That doesn't make sense, merger or not. File a small claims case in their jurisdiction. It should take about 2 seconds for the judge to rule that you get your money back!
