I received a letter from Greene & Cooper LLP representing Midland Funding LLC. This is a debt I owe, but my issue is that on my credit report the debt is being collected by NCO Financial Systems. I don't want to pay one company when I might owe the other. I've already done this once. I thought I was making payment on a debt to get it wiped clear, but a company called ARS National Sercvices, Inc. was taking my payments on what I found out later was a debt that had been written off and I didn't have to pay.

I am also dealing with Midland Funding, LLC right now.  They are taking me to small claims court over...get this... $250 from an old credit card that I had 6 years ago.  These scumbags are nothing but bottomfeeding debt buyers who will sue absolutely anybody over any amount, no matter how big or small.  I have been in contact with their attorney today and I now have to request a motion to continue with the small claims court for 90 days so that I can get this paid off and avoid going to court.  Midland's attorney is going to see if they will be willing to settle for an even smaller amount, but the fact that they would waste the time and money to take someone to court over an amount as small as $250 from a 6-year-old debt is absolutely insane, but that's how these people operate.  

 

Anyway, with your situation, I would demand them to validate the debt in writing.  In my state, we have a consumer credit protection bureau with attorneys who will assist you at absolutely no charge.  They can communicate directly with the attorney representing Midland on your behalf and they can actually request them to provide you with a debt validation and make them prove that it is in fact your debt and that it is something that you legitimately owe.  They will also make sure that everything they are doing is legal, which, if your situation is similar to mine, it sounds like they are.  It doesn't matter how it shows up on your credit report.  Old debts are bought and sold all the time, so what probably happened is that your debt was originally with NCO, but then was sold to Midland for pennies on the dollar and now they are coming after you for that you owe the original creditor.  That is how these dirtbag collectors make their money, by purchasing massive amounts of old debts from other collectors for a ridiculously low amount and then try to sue you for the full amount.  It's disgusting, but that's how it is.  Good luck! Iknow I'll be glad to be done dealing with these scumbags!

It is good that you are cautious about paying on a collection account because it is entirely possible that the collections agency is not legitimate or the debt doesn't belong to you. There are procedures for you to verify that the debt is your debt and not someone elses debt. Check out the various credit and collections websites for consumers so you can get accurate information directly.

However, the part about the debt being "written off" by the creditor means you don't have to pay is not correct. The original creditor has a time frame in which to write off the debt. It is an accounting mechanism. Writing off the debt does not extinguish the loan balance.

It just means you have a couple of extra steps to go through to make sure the debt being paid is yours and the collections agency is legitimately collecting for the original creditor. Good luck with your research.
