It seems clear to me you have a strong basis for a lawsuit. Have you proceeded with one? I would imagine given this info that there is an attorney who would take it on contingency. If you have all of the documentation there's really no way for them to win. Good luck.

i have had lots of mortgages with escrow account,never had a problem with them untill gmac in 2003 -2004 and up to 2008. As i stated before gmac had customers insurance,taxs etc files and monies with zc sterling they transfered them to balboa, FILES WERE LOST I HAVE A RECORED MESSAGE THAT THEY NEVER RECIEVED THESE FILES AND DIDNT KNOW TO PY THEM????. The transfer was in jan of 04 my probs happened in may of 04 ,so you say they didnt know to pay them its 5 months to find the problem . I belive GMAC and Balboa had some scam going to forecplace insurance on loans so they could get extra funds from home owners.I have just started sending out copies of this recording to several congressmen/women and several state attornys who are sueing GMAC . when this gets out and i hope it does it might be the end of GMAC/ALLY by the way lets change our name so people will not know its us lol If anyone wants a copy and lots of evidence i will be glad to give it to you . Question for anyone. GMAC had my account with Balboa, and zc sterling, i never knew this no notices were ever sent to tell me this fact, so is this a fraud,a breach of contract or what and if this is what they are doing and no one knows this would this be an important fact in your foreclosure case?

These kinds of situations are why I tell homeowners to NEVER escrow property taxes or hazard insurance. Even if you are paying PMI you can get a conventional loan without escrowing these items. I simply do not trust the mortgage servicing company to take care of insurance and tax payments on a timely basis. I had done a refi with Quicken and the loan was sold to GMAC. First thing they did was tell me I didn't have insurance. Bullshit. I called my insurance company and had them make sure to change the mortgage holder to GMAC on the policy and immediately fax it to GMAC. I then followed up with a phone call to make darn sure they had it. I saw 3 missapplied payments on my account right from the beginning. Not my mortgage payments but where they had applied some other person's payment to my account. Good God I hope the other person wasn't penalized for their incompetence. But I guess what can we expect the US Government now owns this company. Geez shees.

GMAC Mortgage is unethical. And our government gave them our tax dollars so we can pay GMAC Mortgage to lie to us. However, with all the noise I've been making and after filing a complaint with my Attorney General's office, the Office Of Financial Institutions, the Better Business Bureau, and others, I now have contact information for real, live people that are not customer service reps. GMAC Mortgage has an Advocacy Resolution Specialist and you can reach this department at 319-236-5373. I would urge anyone that has a dispute to call this department and let them assist you--I'm sure GMAC Mortgage would be delighted to hear from all of their dissatisfied customers.

What everyone is telling you is to fight this thing has been going on for years with us and we are fighting everything they are doing so dont give up hope GMAC will get their day in court or in the eyes of god. Yes they are messing with you now but fight and fight to get what is right. So far things have been a little bit differeant with them so keep up the fight to keep your home.

Due to this Memorial Day holiday I wasn't able to get the information of who was servicing my account. But I do believe it's Balboa when GMAC had my loan. My home equity loan was taken out on Feb. 2004. My loan was sold 4x's between, Feb. 2004 to August 2004 when GMAC took over my loan. Countrywide was only servicing our loan for about 3 months prior to selling the loan and transfering the servicing rights to GMAC on August 1, 2004. Countrywide says that they sent a check for my insurance premium in June 2004, but it never was received by Exclesior Insurance. By the time I found out about the pending cancellation GMAC was already the servicer and would have nothing to do with my complaint of the pending cancellation and would do nothing to help me get the premium paid to save my homeowners insurance from being cancelled. I called Countrywide about this as well when I found out about the pending cancellation and they told me it wasn't their problem because now GMAC is my loan servicer. According to them, (2) weeks after my homeowners was cancelled they put a stop payment on the insurance premium check and they said they sent the funds to GMAC. I find that odd my insurance company was never paid because as I investigate this insurance procedure, I was told that when mortgage companies send insurance premiums to the insurance companies for their clients, it's done in (1) large lump check for many of their mortgage holders. For a while I was going back and forth between the (2) companies. Countrywide would say talk to GMAC, GMAC would say talk to Countrywide. I was bounced back and forth like a ping pong ball. Then on Sept. 21, 2005 GMAC sent me a notice that they obtained insurance coverage from Balboa Life and Casualty. It seems bizarre to me that they are all working together. But in a way it makes sense, as I feel this is collusion between the two companies. As hard as I tried to get GMAC to fix this, with faxes and phone calls nothing got done. Not one of these companies would step up to fix the problem or take credit for the mistake. I still blame GMAC because they could have done something to prevent the cancellation, they had plenty of notice.

GMAC is BADPRACTICE and all the info @ AOL is showing that when you look them up its just all part of their game to ripus off they charge us tripple and send us to companys that they own to keep profits up for their stock holders did you find out who was servicing your account when all this happened and also i just came across something that says gmac has had a lot of accounting errors going back to 2000 and that most was in their mortgage area

On Sept. 21, 2005 GMAC sent me a notice that they obtained insurance coverage from Balboa Life and Casualty, 6/18/05 - 6/18/06 for $2,196.00 for my mortgage amount only which was $270,486.00. The insurance I had on my home which covered everything was only $583.00. (See attached) At one point in this mess, I had insurance from them and got my own insurance with a new premium for $1083.00 due to my HIGH RISK grouping. So then I had double insurance and never got credits from GMAC for that either. Need to know more about Balboa Insurance. Thank you.
