I started the program with Gibson Trust in 2001 to consolidate my bills. Payments started out going to the companies on time but I was still getting repeated calls from creditors. Everytime I called Gibson--I was put on hold for long periods of time or disconnected frequently. It would usually take me a few days of trying to actually talk to someone. I was never allowed to talk to the same counselor more than once, when I asked why I was told that they no longer worked at the company (and, I was calling at least once a month).

My first tip-off that the company was trouble was when one of my creditors called and said that they would not accept the terms of the proposal because Gibson Trust was not licensed to practice Credit Counseling in Michigan (which is required in Michigan), and I was a Michigan resident. It wasn't long after I called Gibson to take this creditor off the program (when I told them why--they actually admitted that they didn't have a license to practice in Michigan)that I noticed that the creditors were not showing payments on their bills. When I called Gibson Trust, I was told that the creditors were lying that they showed payment to each creditor every month. As the months went on, I started getting phone calls from the creditors--in many cases they hadn't received payments for three months or more.

At this point, I decided to quit program--when I called to notify Gibson Trust I was harassed and threatened that my credit would be ruined by leaving the program. The person that I talked to kept me on the phone for twenty minutes trying to talk me out of leaving. I was glad that I put stop payment on their ACH debits at the bank because later, I found out from my sister that Gibson had continued to debt her checking account after she discontinue their services.

Both my sister and I filed a report with the Florida Attorney General last year (2002) but I received a letter stating that the Attorney General could not do anything because Gibson Trust claimed that they paid the creditors (and paid them on time). The two of us have not filed a report with the Michigan Attorney General as of yet. Between the two of us, we have been swindled out of about $5000 and we both have bad credit histories as a result of Gibson Trust's actions.

My sister and I are very glad that a lawsuit has been started, and both of us would like to thank those who have posted information about the lawsuit.
