I was contacted by Fresh Student (herein known as "The Company") on June 11, 2014 in regards the $62,000 roundabout in student loans that I had been scheduled to start repaying the following month. The man (name was Jay McNue) told me that according to my income the previous year (they already had that information from my W2 I guess) I was going to be paying around $350.00 per month but that the company could consolidate my loans and get them lowered to about $25.00 per month until my disability kicked in which I was at the time waiting on a decision. When I told him that I was only a month or so from recieving disability benefits on a permanent basis He assured me that as soon as my disability was established with the courts that he would get the loans forgiven completely.  Two months later I sent the company my decision (which was favorable) and waited for some kind of notice or paperwork in the mail but it never came.  I called them again in October and inquired as to the status of my loans and the consolidation and was told that I was not even in their system.  When I insisted that he research it further he gave to his supervisor (Ceasar Fratini).

Ceasar did some searching and found my file, told me that the consolidation process had not been started yet and in order to do that would have to call the DEpartment of Education myself and ask them for a 6 month deferrment.  He said that it would take the comapny about 6 months to get all of my records in order and begin the consolidation process.  I also notified him that I had started receiving disability (SSI payments) in October of that year so he told me that my loans would be forgiven completely but that it would take some time.  I hired this company on the premise that I would not have to deal with the government or the University once I signed the contract and paid the $600.00 startup fee.

Needless to say, after I received my deferrment on my own I was prepared to wait for the paperwork to come in the mail regarding the forgiveness of my debt and I never heard from them.  I was still getting the $34.95 per month taken from my bank account however and all the while I was receiving no services.  What I did have happen with my case I did on my own.  In January of 2015 I was notifed by Direct Loans (Nelnet) by mail, that they were handling my student loans, the repayments, and the consolidation so I calle dhtat comapny immediately and asked how they had my account when I had hired Fresh Student to handle it.  The lady with Direct Loans then told me that no other firm or consolidation had filed any paperwork on my behalf.  I then called Fresh Student back and spoke with a supervisor (supposedly) again.  I told this gentleman that I was pissed off, tired of them taking money every month and they did not even file the contract with the DOE yet so I wanted to cancle my account and retract any permission for them to use my bank account for any further transactions.  At the end of the conversation I was told that I would be receivng no further debits from this comapny and He apologized for all the trouble. When I asked if I could have a refund for the services I paid for and did not receive He told me that the $600.00 was to "open" or establish my account with them and the cost of filing etc.  I argued that in 8 months since I had been paying them they still had not filed my case yet with the Department of Education therefore there was nothing to pay for but it was not working and He would not return my money but assured me that no more would be taken.

After 2 months of not receving any debits from this comapny, out of the blue they took $65.00 out of my account yesterday.  Now I cannot get through on the phone and as of yet nobody is calling me back.

If this was just $50 or even $100 bucks I would let it go but this is $600.00 up front and $34.95 per months for the past 8 months and I am LIVID!  I am interested in filing a class action suit against this company.  If anyone is interested in filing or has a claim already please message me and let me know what I can do or what We can do.  Beware of scams like this....I prided myself in the fact that I could spot a scam a mile away but in this case it was not true.  These sales persons are good at what they do.  They can convince you that without them you will be bankrupt from student loan debt, and they use other fear tactics to make people like me fearful that I cannot take care of this problem myself.  I hope that they are caught and shut down soon.  Thank you.
