As I am doing my research, it seems that we were not the only ones misled.

This company contacted my husband late in the evening and told him that I had told them to call him back. They said they were a Fresh Start program thru MBNA and that for a one time fee, we could get the MBNA credit card.

They set up the ammount to be withdrawn and said we would be receiving paperwork in 7-10 days to look over and we could get a refund if we weren't pleased.

We didn't receive the information after about 3 weeks and called them. The apologized for the delay and said there had been problems with the information packets, and they would be sent out in about 2 weeks.

We finally received the information packets conveniently after they had taken the money out of our account. And relized this wasnt a credit card it was a "stored value" card and it wasn't MBNA.

We contacted them telling them we didn't want or need this and wanted our money back. The very nicely said they would send us a request for refund form and we would need to fill it out and send it back in.

When we received the form we had 3 days to fill it out and send it back return receipt requested. I overnighted it. They receive the request form (Ihave the receipt) on 9/21/02. We have been told that it was being processed to check back in November. I called in November,December, 3 times in January, February, and plan to call once again tomorrow.

Each time we called there was a reason that the check had not been mailed. They changed banks, "Oh, you didn't receive that let me put a stop payment on that and we will resend and when I called back the same day another person told me it had never been issued and put me off again.

I have been put on hold (long distance) for 20 minutes or longer each time I have called. I have been hung up on and then disconnected before my call has been answered when I have gotten irate. The last time I talked to them the lady slipped and said there are people that have been waiting longer than you.

Same story different people. Here is what I plan to do and if you have any suggestions for me please let me know and please contact the people I am suggesting also. Maybe if enough people complain they will be shut down and imprisoned. At this point it is no longer an issue of getting my $221.95 back. It is about shutting these people down and seeing them thrown in jail and unable to ripoff any more innocent people.

In my endeavors of speaking with an attorney, and contacting his suggestions. This is what I have found out. I plan to contact all these tomorrow.

Bank- fraudulent withdrawal form. (I didn't authorize them- authorized MBNA.

Post office- mail fraud.

Consumer Compaint- 800-621-0508.

I also plan to contact MBNA and let them know what this company has done. Hopefully they may help me, or at the very least file suit of their own. They have legal representation at their disposal and it isn't the expense to them that it is to the everyday person.

I am very interested in a class action suit and will willingly testify to all that I have presented here. It is time this company is stopped. I am hoping the FBI will research the matter and do something.

They will overlook negative things on your credit report and give you a card at low interest rate 13.99%. After a consumer has a balance over $1000.00 they will change the interest to default rate based on the negative items on your credit report. If you pay double the min. payment they will increase fees. I escaped this predatory lender with a refinance for 11.5 vs. 23.99 default apr. even though I was on time or early. STAY AWAY FROM MBNA!
