Complaint letter submitted on June 18,2005 From: Orfa Rodriguez worked in the HR department

To Whom It May Concern:

My name is Orfa Rodriguez. I worked for Fred Insurance Agency, for the passed 2year and 10months. Let me start of by saying that I know that that Fred Loya has is a great company but its management is bringing the good name down. For the pass two yeas I have been humiliated, verbally harass, sexually harass by some of its employees.

Last Wednesday June 14th I decided to quit because of the way Edgar treated me for the pass few years. Trough out 2 years I heard Edgar Fiol curst at me screamed at me, watch porn in the computer that was assigned to me, leaving porn down loaded in the desktop of my computer, ect.

Recently on June 6th, 2005 my friend Margot Terrazas submitted a letter to Benjamin Salazar via-email; which I had nothing to with. A few days later Mr, Fiol got Jessica Quintero and me on a conference call. Mr., Fiol was really upset with me because according to him I have guide Margot to send the letter to Benjamin just for the fact that Margot and I are good friends. I explain to Mr. Fiol that I had nothing to do with it but I that knew that her wanting to write a complaint letter to (EEO) because she was unfairly terminated. Mr, Fiol asked me asked me why didn't I tell him anything about the complaint she was trying to do. I reply to him that the reason I didn't tell him was because I didn't want to be involved the complaint she had submitted few days ago. I also made Mr, Fiol aware that they Margot had submitted that letter to Mr, Salazar because she had already submitted a complaint letter to Mrs, Quintero and she never replied to it. Mr. Fiol confirmed with Mrs, Quintero that the letter was sent but that she didn't respond to it because she thought it wasn't important!!! To my understanding every single employee complaint is important because if the employees are not happy their performance is not going to be satisfactory. And according to the employee handbook MR. Loya want all his employees to feel happy at work when asked on the employee handbook to LOVE OUR JOB, RESPECT THE COMPANY AND MAKE SURE EVERYONE DOES AND FEELS THAT SAME WAY. And to Mr, Fiol and Mrs, Quintero the last thing they care about is if the employees feel comfortable at work!!!

However, Mr, Fiol insisted that I had something to do with the letter Margot Terrezas sent to Mr, Salazar. I explained Mr, Fiol in many different way that my personal relationship with some of the employees never affected my job because I had my boundaries set up and they knew that. After a few minutes Mr, Fiol asked me that if in the future I knew about any employee complaint to let Mrs, Quintero to take care of it and for me not to get involved in any way.

On June 14th David Garcia sent me an email, which I have a copy of telling me that he had gotten suspended for 2days a week later of been tardy. As I instructed by MR, Fiol I forward that email to Mrs, Quintero and C/C Mr, Fiol on it, a few hours later I got a phone from Mr., Fiol and advised me that Mrs., Quintero was on the line with him. He started screaming at me and the conversation was a follow. Edgar: Orfa, didn't I f***end tell you to stay away from the employees problems? Orfa: what are you talking about? Edgar: the f***end letter you send Jessica Orfa: well, I'm just doing what you told me to do Edgar: Orfa, somehow every time an employee has a complaint you are involved in it!!! Orfa: what do you mean my name is involved in it somehow? Edgar, well, yeah, first Rudy then Margot and now this f***end fagget (David) Orfa: well, I'm just doing what you told me to do!!! Edgar: I never told you to do should thing. Did we Jessica? Jessica: I don't remember Edgar, but what if something important that we really need to know about? Edgar; yeah, that's true Edgar: Orfa, you got to understand that your friends are not sent you any complaint because you are not on the chain of command!!! Jessica put that on the meeting. Orfa: I'm sorry Edgar, didn't have nothing do with Margot's letter and the only reason I was involved in Rudy's situation was because he was going to suit the company, and I put my friendship with on him aside because I cared about the company!!! That was the only reason. Edgar: Well, that's fine. But I want you to call this idiot (David) and tell him that if he has a problem he needs resolved it with Diana Fiol. Orfa: I'm not going to call him because I told you that I don't talk about work when I'm not at the office and he is not at the office at this time. Edgar: (screaming) I want you to f***end call him now, because if you don't f***end call him I'm going to f***end think that you are the f***end problem!!!! Orfa: Sorry, I'm not going to call him. I'll tell him whenever I see him. Edgar: No, I want you to f***end call him right now Orfa: no, I'm not Edgar: fine don't f***end call him besides I don't f***end need to kiss your a*s!!! Hang up the phone on me.

As you can see I can't allow Edgar or anybody else in your company disrespect me. I had already submitted a complaint to Edgar a few months ago, which it ended up on Ben Salazar's hands by accident a few months ago I didn't see the big picture at that time but now I realized why the rest of the managers were disrespecting me; now I know is because they knew that Edgar treaded me bad and with no respect. Whenever Edgar found out that Ben had read the letter of my complaint, he called me at 10:30pm to guide on what to say on the following meeting, which Ben and Fred were going to be in. He also told that if they pulled me to the side and asked questions about it to tell them that Edgar had already taken care of it. I was scare of getting fired that's why didn't bring any issues in that meeting and pretended that everything was okay.

In the pass two years I witness how the employees were not treaded with respect. And I witness how Houston doesn't follow the (EEO) rules. I can mention some of the unfair things that they Houston region does..

Employees got suspended after a week after the offence is made Play favoritism with in employees when Houston makes a procedure it doesn't get follow equally. Deposit error. If there is a deposit error on each employee pays $25.00 for the error. Well it didn't get follow all the time. If the manager would call Edgar and cry about, he would okay it. Payroll deductions: as I was in charge of scheduling employees to take the limited lines test. I would send you an email to the manager to inform them about the dates and locations. Well one I sent out an email and Diana Fiol failed to informed her employee.. I asked Diana for a payroll deduction as it was procedure a few minutes Edgar called me and told me that it was okay just to reschedule the employee again. Well, a few months ago I sent out and email which it wasn't received because there were some problems with email. Well, to Edgar that was my fault because I didn't follow up on the email and I ended up paying $250.00 because they email didn't work!! How was that my fault??? I sent the email and the only difference that I saw was that Diana is his sister. Dating with in management: On September of 2003 Jessica thought that Timothy Castorena and I were dating which it was incorrect. Well, she embarrassed me in front of the managers saying, if I f***ing find out that you are dating any of the employees your a*s is getting fired!! Well, since last year Priscilla Rodriguez has been dating Hector Garcia one of her 2nd at Houston-18 which she moved him from office to office in till she made him a 2nd. I found out about that trough a few employees from Hou-18. Hilda Renteria having an affair with Rudy Albarran, it affected the entire office and the customers and Jessica didn't do anything about it in till I brought it up. Ones again procedure was not followed. According to Jessica Quintero if a manager dates an employee they get terminated and in none of cases happen.

As you can see I have many reasons on why I ran away from Fred Loya Insurance. I'm not saying Fred Loya Insurance is a bad Company, because I know is not. That's why I'm writing this letter because I know that there are a lot of angry employees and ex-employees just like me.

I have been verbally harassed, sexually harassed and (EEO) right were violated as well as have been affect emotionally. I could write a whole of all the thing that Edgar would tell me and that made feel bad. I just don't want to get a headache. And I was going to submit this complaint to (EEO) web site but I remember that there is an arbitration that needs to follow as well as I know that you have 15days to reply to my letter. I would really appreciate a response to this as well as I would really like to know how am I going to be compensated from all this harassment.

Their Response was....

Good afternoon Orfa,

In regards to your complaint, it is unfortunate that this issue was never brought to the attention of higher management, or that the proper chain of command was not followed, prior to your resignation. The company would have done everything in their power to attempt to resolve the issue, and keep the employer-employee relationship. Please understand that we strive to keep a Harassment-Free environment as noted on pages 32, 33, and 34 of the employee handbook which is issued at the time of hire. That allows the employees the opportunity to get familiar with the procedures and what they must do in the event the employee feels their supervisor has violated such policy.

Since the complaint, the company did conduct an investigation on the matter and has properly reprimanded the supervisor in question. Again, it is unfortunate that the issue was not brought to our attention prior to your resignation.

Well, Tommy how can you tell me that when I was told many times at the managers meeting by Jessica Quintero that the company will always back higher management instead of the employees and this were her exact words.

The company will always back higher management because we don't care if an employee doesn't like the way we run things. If they don't like they can leave.. Well I wasn't the higher management Edgar was!!! She told us this when she found out that she was been suit for discrimination!!! And bragged about it stating that the company will back her up.. So now let me ask you Tommy how could've I complaint about my boss??? When I know that even though you are saying that the company would done everything that existent with the company it would turn to hell just like Rudy Albarran's became!!!! I know if I would d! one what you are telling me if would gotten FIRED anyways because unfurtunatly for the company I know how their games works

I understand your concern; however, those are only assumptions on your part. The company does have a Human Resource Department. You had every right to go through the grievance procedures. Remember what the policy states, page 14 of the employee handbook, The Company does not tolerate any form of retaliation against employees availing themselves of the Complaint Resolution Procedure.

At this point, there is really nothing else we can do.

There were similar situtations of hanky-panky going on with FDL staff ..managers were having affairs with clerks and adjusters. Two prime example are Edgar meza. and rick trevino . I still believe they are running FDL office and are up to their old tricks again.

back in 2005 fred loya started a new rule that if you did not meet the quota of closures u had to stay late on wednesdays , come in on saturdays or even sundays. Later on they implemented a new rule that if you made a mistake on a check , you had to sign off on a document from HR allowing them to deduct 25.00 from your payroll. we were salaried employees , if they deducted from our paychecks and we were working more than 40 hours than we we not be salaried employees.

by 2006, a new document came out and every adjuster had to sign it. we could not forward it to a lawyer or take time out to read it, it was a form that again would  allow payroll dept to deduct from your paycheck if you made any errors on checks. A manager and her staff refused to sign it and all of them were fired. I still recall the day that they brought in security has a precaution when this happened.

I was fired back in oct 2006. I was fired because a male employee was granted a team leader position ( only having been there for 5 months) I complained to my manager in an email and was fired because of that.

it took me a 2 yrs to find employment again. I'm not sure if the FDL office in San antonio continues this practice. if they do , they need to seriously discontinue this practice.

Hello, my name is Manuel Briseno, and I too was unfortunate enough to work for Fred Loya during the time you worked for the company back in 2004-2005. I know all these people you talk about in your complaint. Edgar Fiol, Jessica Quintero, and I remember you too. Allow me to update you on the sad fact that Fred Loya Houston is still run by the Fiols and that not only have they completely corrupted everything the company stood for but they continue to do so in the face of so-called corporate. Edgar Fiol has married Roxanne Garcia, who was (or still is) manager at the old Gulfbank office. This was rumored back in the day many times but now is something that goes on without El Paso saying a thing about it. What you say about Fiol is completely true. He is an extreme of poor professionalism and ethics. Jessica Quintero is not far behind. They all are another example of people who have their positions just because they happened to join the company at the time it was starting up in Houston. Edgar engaged in sexual acts over at the office in Hollister and the one in Gulfbank. My cousin, Priscilla Elizondo worked in the Red Oak office in FM1960 and complained several times about Fiol's harassment to upper management only to be told that Edgar was not to be messed with as she was less important to them because she was a mere CSR. Fiol and Quintero run a mafia in Houston, make no mistake about it. I too had to quit because of their constant harassment and their decision to move people to places where they could obviously not travel. I know that you were in charge of the "training" to punish employees for forgetting to sign in or out of the time system. I know that you were in a position in which humiliation was a daily ocurrence. All I can say is be glad you are not there anymore.

I used to work for FLI in san antonio, during our unemployment hearing by phone he was their spokes person. funny he can tell them all about what happened in sa when he's located in another city! needless to say everything that came out of his mouth was hearsay.
