I was contacted by first resolution investment by letter

claiming i owe them lots of money for a credit card
they are retreiving my income-tax payments
they took last yrs income tax from me
 they do not show proof as to why they are taking my money
i would like to see actaul documents showing i used a credit card
i had an attorney check into it
the attorney did not get nothing back as for proof
i cannot afford a attorney now
i need this solved
they are about to take deductions from my work pay and my incometax again

I am currently helping a friend with a default judgement that was 10 years old which he was never served for this case! He is much worst off than you and we could not find an attorney to help him in our county! So since I study law as I will become an attorney I figured it is good practice for me to help him with his case. The same name is the collection agency First Resolution Investment Corp. and the Law Firm is Called Brewer and Brewer.

There are a few things that I have found fishy about the them. When I mean them I mean the Law Firm, and the Plaintiff First Resolution Investment Corp.

After never being served for a credit card debt he never made, as it was a fraudulent debt! The case records showed that Brewer and Brewer never produce actual legal proof of the debt, as there was not contact in the exhibits, No staements proving the debt and they could not produce the actual letter which they aledge they sent him!

This has caused him and I much lost time, Loss of money, and much unnessasary stress and suffering! It was sad that no one wanted to help him! For him they could have attached his wages if he was working, but with no income and him being ill getting welfare, I felt the need to help him. I have seen simular complaints of other people having old debts of many years as old as 28 years and this same law firm coming after them too.

From what I have found the Law Firm Brewer & Brewer has a one page website. According to a report on the internet the law firm which represents this company make an annual income of $1Mil - $2.5Mil.

I do find it strange that they have two different addresses which I confirmed from their phone number! I have seen complaints about First Resolution Investment Corp. and I have seen many different court document with the same law firm. I am really starting to wonder if they are legitamate or not, since it is very simular where as some people never get served and they get a default judgement!

What ever you do do not agree that you have the debt until you contact an attorney and look at the court paper work! You may find out it could be a fraudgelent debt as it was for my friend. They might not even have the proof as they didn't with my friends case! By the way we are counter suing them!

They really should have served my friend in regards to this debt, the first time over 10 years ago. They are currently trying to extend the length of the debt, since it has been 10 years and they want to extend it another 10 years.

Sometimes I wonder if they actually ever really served him and the other people I have read about on the internet as they alledge they have! Remember you are not alone!

I get alot of help at the law library from the staff. They can help direct you to find the information in which you seek to help yourself. As for my friend he is not that intellegent to manuver the law library and understand how the procedure for court work, that is why I help him.

I would definately look into it and since your income is SSI you can get a fee wavier. First find the court judgement, them go to that court and get a fee wavier. You can get a fee wavier at the clerks office in the court. Ask them for one, you may have to wait in a line. That form is usually a fill in the blank and check the boxes which best meet your situation. You should qualify for the fee wavier since you are on SSI.

Next request all the document in the case and request minutes if there are any as well. This way you know what was said and done. You can request them by mail of pick them up at the court house.

Then read every document in your case to see if it is truely a legitamet debt you incured.

I have found that some people have stated that they paid the debt in full but they came back for the debt. That is why it is alway improtant to save reciepts!

It sounds like you were never served in your case, which legally you should be able to get the case dissmissed on thoses grounds. I would Motion the court to set aside a default judgement. If you can get it dissmissed with Prejudice, so they cannot bring it back to court to sue you again! However with out knowing more about your case (details) I as sorry that is about as far as I can help you! If you do nothing this can go on until the debt is satisfied (until they collect the amount found in the court judgement)!

I see it this way if the debt is not yours I would definately ask to set aside a default judgement with prejudice. It never hurts to ask!

Oh, if it is a fradulent debt, get a police report, contact your local police department and get a case number to give to the court in your exhibits, with a copy of the actual report, but mention it in your "Motion To Set Aside Default". Also mention anything else you feel is pertinate to your case! Remember if you can't find an attorney to represent you then go to your nears Law Library. Your court house should be able to dirrect you to it's where abouts, or do an interent search!

After you get a police report if it is a fraudlent debt go onto the FTC website :    consumer.ftc.gov/articles/0277-create-identity-theft-report

To create an Identity Theft Report with the Federal trade Commision (FTC). This is done after you get a case number from your local police department, which you will enter that number into the Identity Theft Report. This is done online. You will have to answer some questions. Use this in your case (metion this as evidence as another exhibit) (Exhibits are lettered a, B, C and so on) and mention it if you are a victum of identity theft (if you are/ were) a this will be turned in with your motion along with any other evidence you have to help support your case.

Go down to your County Courthouse and ask for a copy of the filing - If you were never served a summons for this "suit" then there are Attorneys out there that will help you without a cost to you unless they win.  I do not know if this is a third party debt collector or what but you do have rights.  Find a consumer Lawyer at www.budhibbs.com.
