I own a small business in Trenton, NJ and accept credit cards in payment. On 12-4-14 a customer used a PayPal credit card to make a purchase. Merchant Services part of First Data, and my credit card processing service made a remittance to my bank account a few days later for this particular credit card purchase. Over the next five weeks this same customer returned and purchased a considerable amount of items from my store using a phony credit card ... all charges were submitted and paid through First Data Merchant Servies into my bank account,this action lead me to believe that the credit card being used was valid. 

It was fifty four (54) days, (1-27-15) later that I began receiving charge backs from First Data Merchant Services for the very fist transaction that turned out to be fraudulant. 

 If I had been notified sooner that the card used was not valid by First Data Merchant Services ... not almost 2 months after the fact ... I could have protected my business from subsequent credit card fraud.

 I hold First Data Merchant Services negligent and responsible for my loss.

This is a waste of my time ... you have no idea what you're talking about. You don't know anything about the case in detail ... you need to annoy someone else unless you have had a similar experience with First Data I would ask you to please stop sending your inane comments.

After you provided a great deal of detailed information you refuse to answer the question that is at the core of your loss.

“The purpose of this forum as I understand it is to alert others to potential consumer problems not determine who ultimately bears responsibility”

Well ok but you wrote, “I hold First Data Merchant Services negligent and responsible for my loss.”

When I initially read your complaint I knew you had failed to verify the signature. I’m sure your merchant service provider told you the same thing.

Friend ..... I have absolutely no idea who you are or who you represent therefore I will not answer your question on advice of council and common sense, The purpose of this forum as I understand it is to alert others to potential consumer problems not determine who ultimately bears responsibility for the results of actions taken or not taken. Your querry therefore is questionable on at least two levels.

1. You don't have to identify yourself here as I did. Therefore a prudent person sees you as a potential adversay and would not provide you with any further information not already contained in the problem description.

2. Your "conculsions" placing responsibility are not founded in fact. Therefore can not prevail.

You never responded so it is evident that you failed to verify the signature. “I hold First Data Merchant Services negligent and responsible for my loss.” Your neglect as a merchant caused your loss.

My attorney discovered that the agreement that I signed with Merchant Services included a clause that all lawsuites must be settled in Ontario Canada .... wow ... we will file a motion to change the venue to NJ, for this is a very real problem for US business' that need to litigate against them.

Also, I found that First Data security department placed a hold on my business bank account for the full balance available in the account at that time, not the amount of potential chargebacks still to come. I spoke with their rep and finally got the account hold removed. He did tell me that they would be canceling my account. Should I experience any fees for closing the amount will be included in my lawsuite as well.
