I am have been asked by a local business owner to help get him released from a FDGL lease agreement. Since the owner does not speak English well and has been scammed by Northern Payments and First Data Global Leasing. 

A representative from Norther Payments came into his store and advised him that he represented the EBT program for the State of CA and that if he did not update his credit card equipment by Dec 21, 2016 due to the SHA 2 update he would no longer be able to accept EBT cards.  The paperwork that was presented to him had an EBT logo at the top of the page with a web address of www.ebtprogram.com.  The merchant was busy with customers and the agent continued pushing him to sign the documents if he wanted to continue to take EBT cards. 

Ultimately, he signed the papers.  A few days later a new terminal and pin pad arrived at his store.  He did not install the equipment but immediately turned around and sent it back to company that sent it to him.  When trying to cancel he found out that he had been put in a lease and to get out of the lease he has to pay $4100.00. 

They take $79 per month for 48 months and although several attempts have to made to get out of the lease the merchant is still paying for the equipment that he doesn't even have in his possession.  The lease company instructs us to contact the sales agent and the sale agent refuses to take our calls.  The merchant just wants to get out of the agreement that was misrepresented to him from the beginning.

Maybe Some Light at the End of a Dark Tunnel

We may have some light at the end of this dark tunnel.  I filed a complaint with the District Attorney in the state of Floriday.  They did an investigation on First Data Global Leasing and FDGL is required to follow a process that was outlined in the investigation.  The DA's office sent my complaint over to FDGL and FDGL is required to report back to her.  We are waiting on their response and are hopeful this will resolve the issue.  Will update again once we hear back.

You May Be Stuck To Make All 48 Payments

What most people / business owners do not realize is the leasing company is nothing more than a financing company for the merchant service provider who uses them to help place terminals and make big commissions.   It is unfortunate that the business owner was tricked, however the business owner should always read and understand what he is signing. The reason the leasing company (FDGL) is telling him to call the other company is because they will need to agree to reverse the “deal” and as such the processing company will need to give back the commissions. 

In absent of a lawyer getting involved or some government entirety helping (good luck with that), the business owner will need to make all payments (48) and return the equipment. After this, put in a formal request to cancel the lease.  Since the equipment was already returned, get and keep proof & documentation the equipment was received by the leasing company. This may need to be provided when requesting the closure of the lease after all 48 payments have been made.
