I got a Spiegel Credit card with a credit limit of $400.00

the issuer is First Consumer National Bank. It has a high

interest rate of 27% I need credit so I used the card to

buy clothing.

Anyhow, other than FNCB I was overwhelmed with debt so

January 29,2003 I filed chapter 7 bankrupcy. I wanted to

reaffirm my debt, that of $123.00 with FCNB not including

them in my bankrupcy, but as soon as they found out I filed they closed my line of credit and refused to let me reaffirm my debt.

I have always made my payments on a timely manner with them only once my payment arrived in the mail 1 day late and they ate my $30.00 payment as a late fee. I wrote them a letter trying to get them to waive the fee and put my payment towards my bill but they sent me a letter refusing too..

When I found out my credit line was closed I called FCNB's

customer service line @ 1 800 925 4976 and spoke with a Marcella who was extremely unsympothetic and rude. She told me my account is closed and will stay closed and that my account is being reported to the credit bureau as a charge off, without giving me a chance to explain my side, she kept yelling and talking over to me till I was in tears, I did use vulgar language when she drove me to it, she refused to get me a supervisor because she is insisting they will not listen to me..I have

since sent the company a letter of complaint..

I am writing to you because I am being treatly unfairly and I hope something can be done about this..I don't care if I ever get another credit card from them but they have ""NO RIGHT"" reporting me as a ""CHARGE OFF""when I continue to pay my bill

on time..

Their nasty operator Marcella told me after sending in

a recent payment of $30.00 that I will not get any money

back I send..

I want to pay off my debt with them, however, I don't

want them lying to the credit bureau about me..What can I

do?

Sincerely,

CaroL A Newcomb
