We received two cash Advance checks from First Consumers National Bank, signed by President and CEO, James E. Huston (Parent Company-Speigel) at 5.9% through July 31,2003.

We met all the of the Terms and Conditions for using these checks, including calling the 800 number to verify available funds on March 7th. She told me I could write the advance check for$1400.00, which I did and deposited it into my checking account.They then closed the accounts (on that VERY) DAY and the check was returned to my bank as NSF!!

We have been slammed with over $350 worth of NSF fees for checks that I wrote to different merchants against this "Cash Advance": The rep at Spiegel told me they were "sorry for the trouble" but the accounts were closed on March 7th!

They sent the letters stating the accounts were closed AFTER THE FACT, I rcvd my letter March 18th!!!!! I have called 800-211-7340 numerous times (the same number you call to verify the amount that was avail to write the check for) and was told they did not have the funds, or they 'THOUGHT" they had the funds for this promotion. My bank is not willing to waive the $308 NSF fees and SPIEGEL/FCNB does not have the funds to cover the fees. Somewhere, SOMEONE must assume responsibility

somehow..... it's like they ran a lottery without having the funds to pay the winner. When the lawsuit is filed against this company, I want my name FIRST on the list...I'm tired of being s...t on!!

LAURI UR ALL WRONG ON THE ACCESS CHECK

UNFORTUNETLY, IT IS A SHAME UR ACCESS CHECKS WERE REVOKED BUT TO CLEAR UR MISUNDERSTANDING ABOUT THE CLOSURE AND OF THE "WE THOUGHT WE HAD THE FUNDS TO COVER":, FIRST OF ALL THE ACCOUNTS WERE MANDITORY AND OFFICIALLY CLOSED AS OF MARCH 11TH OF 2003, THE ACCESS CHECKS WERE NOT BEING HONORED AS OF MARCH 7TH PER SPEIGAL FILING BANKRUPTCY, THE FUNDS WERE AVAILABLE BUT AT THE TIME THE ACCESS CHECKS WERE SENT (FEB 14TH) AS U CAN CLEARLY SEE WAS BEFORE THE CLOSURE HAD TAKEN PLACE. NOW UNFORTUNETLY WHEN THE LIEN HOLDER OF UR ACCOUNT (FCNB) WAS NOTIFIED OF THE CLOSURES (WHICH WAS ON MARCH 11TH) WE HAD SENT THE LETTERS TO ALL CH'S, AS WELL UPDATED THE ONLINE SITE, AND HAD ATTEMPTED TO ADDRESS ALL CH ASAP TO CEASE ALL ACCESS CHECK ACTIVITY DUE TO THE CLOSURE. AS PER FROM UR AGREEMENTS ON UR CARD IT CLEARLY STATES THAT FCNB HAS THE RIGHT TO CLOSE OUT UR ACCOUNT FOR ANY REASON WITHOUT NOTIFICATION, SO WITH THE LETTER THAT YOU HAVE, YOU ARE ABLE TO PRESENT THAT TO UR PERSONAL FINANCIAL INSTITUTION TO SEE IF THEY WOULD BE WILLING TO CREDIT THE NSF FEES. ALSO TO CORRECT UR OTHER MISINFO, THE CEO OF THE PARENT COMPANY SPIEGAL IS NOT JAMES HUSTON, HE IS THE CEO OF FCNB.

FIRST, LET ME TELL ALL OF YOU THAT FCNB WAS NOT AWARE THAT THE ACCESS CHECKS WERE GOING TO BE CEASED HONORING AS OF MARCH 7TH AND WE WERE UNAWARE THAT ALL OF THE SPIEGEL, NEWPORT NEWS AND EDDIE BAUER ACCOUNTS WERE GOING TO BE CLOSED EFFECTIVE MARCH 11TH...U KNOW, WE FOUND ALL OF THIS INFO OUT THE DAY OF MARCH 11TH WHEN BEGINNING WORK... HOW DO U THINK WE FEEL??? COMING TO WORK AND HAVING TO FIND OUT ALL OF THE ACCOUNTS R CLOSED AND THEN HAVING TO DEAL WITH PEOPLE LIKE YOU FOR 8HRS..LISTEN HEAR...WE R HUMANS TOO AND UNFORTUNATLY R ON THE OTHER SIDE OF THE PHONE..WE DIDNT HAVE TO NOTIFY U OF THE ACCOUNTS BEING CLOSED OR THE ACCESS CHECKS BEING CEASED PER INFO IN YOUR ACCOUNT AGREEMENT..WHICH U DID AGREE TO B4 USING THE CREDIT CARD... I DO REALLY FEEL BAD FOR ALL OF YOU THAT HAD THE ACCESS CHECKS RETURNED...THERE IS NOTHING THAT FCNB CAN DO FOR YOU, SO U WILL NEED TO MAKE ARRANGMENTS WITH THE MERCHANT U WROTE THE CHECKS TO...AND CALLING IN AND YELLING AT US AND USING PROFANITY ISN'T GOING TO CHANGE THE FACT...IT'S A SAD THING, BUT U LIVE AND LEARN....
