They do not have to offer it. Some probalaly just to make it harder for people and some just because they know they are getting their money one way or another (garnishment, judgements, sale of home, ect) and they do not want to mess with it.
Even if they did offer it most people would not see it anyways..... right in the email you provided it stated "The funds may be paid to the borrower upon vacating the property or they may be used to pay off junior liens in order to clear a title." If someone had their house go into foreclosure more than likely they had other bills fall behind to and have judgements. It will go towards there judgements and they will never see 1 penny of it.
