I recieved a notice of a class action lawsuit against emachines in January,2013, after researching what the action was about I proceed to file a calim and remain a member of the class action against eMachines.

On July 18, 2013 I received letter from the class action administrator; KCC Class Action Services in Providence, RI,(PH.1-866-381-9100). The letter stated the court had granted final approval of the Stoud v. eMachines, Inc. settlement and this certificate represents your award for your approved claim.

Mike from Sacramento, CA stated in his Ripoff report the the terms changed from the initial notification from www.secondipity.com to www.emachinesredeem.com, and effectivly limited what replacement computers would be available. I, like Mike had checked secondipity's web site before filing my claim for the same reasons he stated; a good selection of replacements- and not just limited to the brands Acer owns.

However I did check out the emachinesredeem wedsite and found a couple of computers that looked to be descent replacements for either a simple desktop, or laptop unit. The 'Certificate' states it valid for up to $365 in credit for any Acer, eMachines, or Gateway computer, laptop, tablet, notebook, accessories, etc.

I placed an order for (one of few) new Gateway desktop computers, this computer was priced at $349.99, shipping was quoted as $12.74 for a total of $362.73-slightly under the redemption certificates' $365 in credit.

At checkout you must provide credit card information to cover any cost that exceed the credit of $365.00, I did so even though my order was less than $365 ( you can't check out w/o doing so). While verifying my order at check out it showed "promotion applied", but only to the $12.74 shipping charge, believing I was getting free shipping I placed the order.

When I received a confirmation email it showed Total for this order $349.99, Now I'm Mad!, this wasn't supposed to cost me anything, how is it  a $365 credit is only good for the shipping cost of $12.74? Since I placed the order on a Friday the charge will not post to my credit card until Monday, I called my credit card company and they confirmed there is a pending charge of $349.99, since it is pending I'm unable to dispute the charge until it post to my account.

This ripoff gets even better!, I get another email from emachinesredeem saying my order has shipped, when I checked the UPS tracking information it shows the package weighs 8 pounds-the description on the website states it weighs 23 pounds. I researched this model extensively, every site, including Gateway's show this computer weighs 23 pounds. So what's in the 8 pound package that I'm being charged $349.99 for?? 

There is no contact information on the emachinesredeem website, other than to refer people to the classaction web site, the phone number only takes you to an automated answering service that provides frequently asked questions, there is a Mailing address for the Settlement Adninistrator; KCC Class Action Services-but it's a snail mail address, there is no email, or website, their phone number is also automated. (I don't anticipte a response to my voice mail anytime, well actully ever!).

I was considering cancelling the order before I was notified it shipped, but the terms of use state you can only use your redemtion certificate code One time, there are no returns allowed, and ironically the emachines redeem website directs you to the secondipity website for warranty information.

On Monday I'll call my credit card company to formally dispute the charge, I'll also contact UPS and instruct them I will refuse delivery of that 8 pound package. take my advise-Don't attempt to redeem your certificate unless you want to give these ripoffs your hard earned money! Acer(eMachines) may be setting themselves up for another class action suit!

I chose a computer that was about 335, added quick shipping, and the total came in at just under 360.  I didn't have to put any CC information in and I got my laptop just fine.  You probably forgot to click add for your claim code to be used for the purchase.  This is probably why you had to add credit card info.  You only have to add this IF the purchase exceeds the amount of the certificate, and if the total, including shipping, does not exceed the certificate amount at the time of checkout, there is no need to put your CC in.  It doesn't ask for it unless it exceeds it or unless you forgot to click add for the certificate to be used for the purchase.  This site is not a rip off at all and it works just fine.  My laptop arrived in a few days and I still use it from time to time.

My experience was very similar.  I agree that it is an elaborate scam except I never gave them credit card information but chose to only stay under the $365.00 so-called allottment, so what it did was create a glitch that would not allow me to place the order.  It decided hat there was no quantity available of "0" even though I entered "1" so what it does is not allow you to change the quantity and thus you can never place the order.  It is a cart design scam, like a maze, to make sure that unless you enter the credit card info, you can't go further.  It is a real serious scam!  Surely Acer, e-machines and Gateway have been informed, since theyy are using their names.  If not, they need to be.  They had to have gotten customer info from somewhere because I did have a worthless e-machine that never worked right. 

If crooks put this much effort into legitimate work they'd be Warrent Buffet!

 I too looked at the available laptops on secondipity.com before entering the class action and now I am notified that a new website with high priced junk machines is where we can redeem our certificate. What a ripoff on these machines. Where are the administrator's? They should make sure that a fair selection and prices be maintained for the plaintiffs in this case. Acer and/or Gateway should be trying to build a following to their brand, not discouraging and insulting potential customers!

My problem with the settlement is this. The units available for relacement are refurbished and only come with a 90 day hardware warranty. Am i right in thinking, hardware usually has a 1 year maunfactures warranty? I believe the limit of 90 days is because the units are provided not by the manufacture, but by a liquidation company, which has refurbished them. I don't think this settlement has done us any favors. I wouldn't buy refurbished in the first place. These units already have had problems.  What sounds good about this offer? I'll probably take the $62.50 cash and use it towards something new, which will give me some recourse if something happens after 90 days.

Hi! I got my redeem# and shopped around and I found a nice laptop for $349.I added next day shipping and it came to $363..Everything worked..Don't put your cc#down in the space,leave it blank if you stay under $365..Their is no funny stuff going on here.Just people who don't know how to claim their voucher.

I had a hard time finding a way to contact someone as I ran into the same problem for submitting a credit card when the amount didn't go over. But I found it. I wrote them today and told them I had been charged the full price. She told me to reply with my certificate number and pin number and charge it to the certificate and reverse the charge to the credit card. Now I am waiting to see how soon that will happen. I just wrote her about a half-hour ago and gave her the numbers she requested.

evidently if you enter your credit card, that overrides your certificate if your under $365

If you have an issue with a recent purchase please email [email protected] with your name, order #, issue, and contact information and they will reply to you at their earliest convenience.

I too signed and returned my class action forms in Jan. and got my certificates this week  I had 2 since I had 2 emachines back in the day.  Just ordered a new Asus Iconia W700-6831 64GB 11.6" Tablet.  

I used both certificates since they were only for $365 and the Tablet was $689.  I used the balance for one day shipping.  $12 bucks leftover but you dont get the leftovers  

No credit card info needed since my certificates covered the total due. I just skipped that part completely.  Got a confirmation e-mail after submitting my order.  Waiting for shipping now. 

If it is a scam, it's an elaborate one.  I will update after shipping and after I recieve my new Tablet.

Just wanted to note, that I have received a tracking # via UPS on my order. There are no charges posted to my MasterCard... not even pending (although I entered my credit info.). My email receipt states "gift card applied". Not sure why your credit card company would post a charge even pending if you did not exceed the amount of the credit. For what it's worth, I think things will work out in your favor. That said.. I do feel sorta of stupid not doing more research "Before" I submitted a credit card #. Fortunately, if the credit card company is informed of a concern,  as you did; you should not be financially liabile. If I wake up tomorrow and discover a charge for  a yacht in Brazil, I'll post here. Although I truly expect a "free" computer at my door. Wish you the same!

Hello, I just wanted to say that I was granted a certificate of value worth $365 also. When i ordered my pc I left the credit card information blank and it processed my order fine. You do not have to enter your credit card info. I think that was just an option if you were going over the price of $365. When you entered your credit card info it charged it instead of using your certificate. At least thats what it sounds like to me. Also i already have my shipping info via UPS and the package weighs a little more than it shows the pc to be on the website. I'm not sure what happened in your case but I hope you get it resolved. Yes, yes, and yes. I've read all , and I mean ALL the informtion, called all the phone numbers, listened to all the automated phone messages, etc. I really hope it's not a scam, your'e right it would be pretty elaborate.

More likely what has happened is a giant corporation (Acer) is just running blindly down the road not monitoring how the claims and the web site is processing all of the claims . I certainly hope so.

And yes it was a pending charge-that was posted to my credit card first thing today!, and one of the first things I did was to call my credit card companyand place the charge in Dispute status.....now I'll wait for my 8 pound package that's supposed to contain a 23 pound computer .

I have reviewed the court documents extensively. All are available from the web site. If this a a scam. it is the most detailed and elaborate ever performed. The webs sites both the KCC Class Action Admin. and the E-machine selection site are far too sophisticated. Did you call the toll free number if you had questions are concerns.

Scams tend to be rapid, get in and get out. The initial contact and time to settle has transpired over a year. The time to redeem extends for 1 year... if you are a scammer you would limited that to few days, knowing full well that someone (like you) would blow your cover. Almost immediately.

My guess, the credit card company is holding the charge as pending... that the certificate will be applied and you will get a free computer. If we both find out otherwise... then a follow-up here is essential!
