Purchased a used car, told transmission had been replaced, drove fine on High Street test drive.  Next evening check engine light comes on.  Took it to a certified mechanic who stated that the car codes came up needing an oxygen senor, air intake issues, tank defect issues and transmission issues.  Tells me that the codes had been cleared from the car and that they return after one to two days.  He then proceeded to clear them and yes they did come back on the next day.

The car cannot be driven over 45-50 miles per hour (at this speed and taking back roads my commute has more than doubled).  We went to the dealer three times in an attempt to speak with the owner.  This last time we were told that he "was in the back asleep and asked what we wanted."  We told him the issue with the car and he just said (and kept repeating) "as-is—get a lawyer."

We are now stuck with a car that does not drive properly and I am fearful to even be in as it does not shift, that we still have to make payments on which negate us from the opportunity of finding a safer more reliable car.  This dealer preys on people and rips them off by misrepresenting the vehicles he sells and then to clinch the deal, he clears out check engine codes just to get it off the lot—once off the lot, he believes you no longer have any recourse.

 

 

Stop him please.

An unfortunate truth, Buy here pay here IS as is. Used cars are just that. For some reason the former owner No longer wanted that car. If you buy a car get a car fax report, or similar. Do some research on the car to know common issues. Try to go to reputable dealers. Even new car dealers miss stuff, or the mechanic after working on the car may reset the codes.

Some cars need 150-200 miles to get re set and broke in. Some dealers (mostly large and NEW) offer a 24 hour test drive. Do that! If you really like the car have a mechanic check it out. Look for  leaks, check fluids to see if clean, dont forget radiator. Check ALL the operations of the vehicles. Listen for rattles and clunks. Check tires for cracks or bad tread.

We nt to a New car dealer bought a used Ford escort later found out it had been wrecked, this dealer did not check the vehicle, I assumed they did, I did not ask, I signed off on the as is waiver. After finding a broken sub frame, wreck damage well hidden. I took it back, I got some refund, but was told I did sign off.

A coupe years later I bought a Merc. Sable it had 75,000 miles and was spotless, carfax was clear and had oil change records, i bought the extended warranty (that company was rated f by Better buisness) I went back canceled the warrranty, which they had no problem doing. They told me I saigned the as is waiver. I got an extended warranty else where but it cost $1200 (extra) no included in the price of the car. after one year my tranny went out, it was paid for -100 deductable. Shop said it would have been $2000 out of pocket. Little things like these cost extra but if you drop the motor or tranny it will save your day and car.

Again do research on the dealer and on the warranty company too. Today you cannot even trust a new car. The price to fix things just goes up and up, so a good warranty makes sence. Just watch "Buy Here, Pay Here" places. They mayjust be out to make some profit, and next week they have a new lot down the street. #1 bad car dealer buy here pay here JD birider.... IMO. Best Columbus dealer use car (buy the warranty to be included with your payments) Jack Maxton (3 cars for them now)

I'm just saying a legitimate business selling a car as is should not be clearing the codes so that you are surprised by them the next day.  That leaves you no way to make an informed decision on the purchase.  And right now the decision is do we make the payment or use the money for a trannie.  Can't swing both.  Just feeling used and abused.

I am sorry to hear what has happened.  It would be adviseable to take it to a third party mechanic before you purchase.  If they are reputable enough, they should allow that.

 

Did they make any promises on the condition or give any warranty?  You stated the owner said it was "as is".  If they didn't give any promises or warranty it won't  work to go through a lawsuit.  However, you may want to contact an attorney anyway to see if you have a case--especially if they did make any types of promises or warranty. 

 

In the meantime, you should get the repairs done to the car so you can drive it normally.

Did you get a warranty with this car?  Nope?  Guess what?  You bought it "AS IS".  That means you bought it with any and all problems and YOU are the one who is on the hook for it.  It doesn't matter what the salesman said...if its an "AS IS" sale, it comes without a warranty and you are not entitled to free warranty work.  Should he have lied to you?  Of course not.  However, did it not even occur to you if it was such a fine piece of mechanical beauty, then it wouldn't have been sold "AS IS"???

Let me save you the effort....I don't work for them.
