My husband and I bought a car from Drive Time back in April 2008. My payments were set at 400 dollars a month. They sold the car to us for 14,000 dollars before financing. I asked them before we started signing papers if something was to happen at my job and I had to get a new one if we could refinance the car. They said "sure anytime something happens we will be more than willing to work with you on your payment arrangements". So we agreed and I signed all the paper work.

Well, I was making payments on time up until June of 2008. I got layed off my job in texas and we had to move back to Kansas with my Mom. I got a new job and I only work 24 hours a week because I found out I was pregnant and my husband was still looking for a job! We took the car all the way back to Texas to turn it over as a volunteer repo before we could get behind on the payments because there was no way with a baby on the way that we could afford the car in our predicament. The dealership REFUSED to let us turn in the car, knowing well that we couldn't afford to keep it.

When we got down there they said that they would not take it back and that we could send them what ever we could afford whether it was $25 a week or $50 a month! So we took the car back home and we sent them $20 that Friday. Then the phone calls started piling in. So we took the car to a local dealership to trade it in for a different car with lower payments. They came back and told us that the car was only worth $3,000 in GREAT condition. So we then went online and looked at the carfax report just to see if they would lie about that to and what do ya know, Drive-Time's car fax said that there was only 2 reports but the carfax on the computer said that there was 15!

They have harassed us for 4 months now, June-Sept, swearing to repo the car, calling us at all hours, have refused payments from us and EVERYTIME we have told them to come and get the car because they sold us a lemon! We have a BIG list of items that we have found wrong with the car, one of them being that the bumpers have been ZIP-TIED so that it stays on! That's only one of many things wrong with this car!

We have a list of complaints that we have written down and are going to talk with a lawyer. This company needs to be shut down and never be allowed to do car business again!

You had better figure out a way to keep it

If they repo it they will probably sell it for $2,000 bucks or less since it is in such bad condition and will happily sue you for the balance. They probably got their money out of it from your down payment and the $400 a month is just gravy. You can bet though that they will take you to court and if you can't afford the car you probably can't afford a lawyer. They can.
