Over a year ago I filed for custody of my daughter because of some things going on in the other household that I did not agree with. I had good hard evidence and this was in agreement by the guardian ad-litem, and several others involved with my case. My goal was not to alienate my child from the other parent but to keep her out of a dangerous environment. Early on in the case my X's lawyer suggested we have a custody evaluation performed by Dr. Joseph Frey III. I agreed no knowing what I was in for.

Dr. Frey misquoted me in information that I gave him verbally not knowing that I had email to back up what I said. In his report he used his misquotation to show that I lied or stretched the truth.

Dr. Frey changed what I stated to him in my initial questionnaire not knowing that I had copies of my answers to prove it. Dr. Frey evidently changed the information so as to possibly "set me up" for cross examiniation by the other lawyer. This would in fact prove me a liar if I had not had documentation to prove that Dr. Frey changed my answers.

Dr. Frey suggested in his report that my mother be limited from seeing my daughter without interviewing my mother.

Dr. Frey ignored DUI and drug use information provided by me.

To all that have a custody evaluation by Dr. Joseph Frey: Bring a recorder and record every meeting with him and for God sakes document and copy every document. This man will change information to get the results he wants to achieve. Thank God he did not get away with it this time!

Frey, you initially responded to this complaint but now after the evidence was posted, you went into hiding and never responded to evidence proving where you changed information. Also you never showed your face in court. Was this because other psychologists were waiting on you? Dont you know when you are dealing with children that you better get the facts right? Do you not know that it is a crime to change testimony of information given to you? Explain to the viewers why you changed information given to you.

Here is one of many examples of where Dr. Joseph Frey changed information to get the result he wanted. First I will post an email about something that happened: Here is and email I sent explaining a situation I witnessed where I was scared for my daughter's safety.*** 'I took my daughter to her mother a little while ago. Her mother met me in the garage and acted nice but a little funny. I did not think much about it because I only ever see her or the grandmother when I come to get my daughter... rarely bother come out. After I left I came back to the office...started thinking and realized only the mother's car was in the garage. I drove back down to Rammy Dr... back up Cantwell and looked up at the mother's house. The new husband's SUV was now in the driveway and it looked as if the grandmother was just pulling in. Once again even if for a little while, the mother had my daughter unsupervised.'*** Second here are 3 paragraphs Dr, Joseph Frey put in his 'custody evaluation. Dr. Frey used this throughout his evaluation as justification... Here are the following paragraphs from Dr. Joseph Frey's custody evaluation : ***Page 7 paragraph 3,' - The mother, her child, her husband, and her mother were scheduled for their final visit with the evaluator at 1PM on May 18. at 12:55PM, immediately prior to their arrival, the father called the evaluator to inform that he had just seen (or been informed) that the mother was in a car by herself with her daughter and this was not supposed to happen under her supervised visitation guidelines. He asked the evaluator what he should do. The evaluator informed him that it was 'not his call to make' and that the father had to decide whether he wished to inform the court through his lawyer or not. As soon as the phone call ended, the evaluator was notified that the mother and her family were in the waiting room. The mother stated that her and her family had all come in the same car and left at the same time from the house. To emphasize the point, they pointed to the car they had come in as it was parked right outside in the office parking lot. *** *** Page 15 paragraph 3, - The mother's mother was asked about a phone call the father made to the evaluator's office at 12:55 for the mother's 1PM appointment with her daughter. He stated he was concerned that the mother had left for the office with her daughter without being supervised. He requested that the evaluator provide him with guidance and how to handle the situation. The evaluator informed him that he did not provide guidance or direction regarding the handling of any legal issue and was advised to call his attorney. She stated, 'the father is a liar and that is a lie. We all came in the same car. We left from the mother's house where we all met.'*** *** page 18 last paragraph. - This was even true up to the last phone call the father made in which he accused the mother of taking her daughter by herself to her last appointment with the evaluator. - The father is confident to the point of being narcissistic and rigid to the point of being narrow minded. He also has no insight into or awareness of his interpersonal life to the point where others probably feel he does not listen to or care about their feelings and opinions. He does not seem to be able to go below the surface of issues in order to understand what is happening and their implications. These traits were observed in every aspect of this evaluation, from the video the father and his mother brought in to the last phone call he made alleging that the mother was alone with her daughter on the way to the appointment. To sum up what happened, Dr, Joseph Frey changed what I stated in phone conversation and email to show I am a liar.. He went on to use it all through his evaluation. It is important to document everything and to not be taken by a fraud. 3 paragraphs used to show me a liar but unbeknownst to Dr. Frey.... and email proving he changed or misquoted the information given to him. Frey basically said I said my X wife was in a car by herself on the way to his office when in fact all I said is that I realized she was home alone with my daughter for a short period of time. Tough to follow but important because someone like this guy could sway court opinion with lies or sloppy work... In the contect of a custody evaluation, this incorrect information was published as fact when in fact it was a complete lie that is 100% documented. Small incident used in a big way to make one side look like a liar. How would I look if the other lawyer cross examined me on this and I had no way to prove otherwise? Frey would have really done a number if you would have taken the stand and got cross examined by the other lawyer. If an evaluator changes information on you like that, and you don't have anything to prove otherwise, you would have been "railroaded" because of a liar.

Dr. Joseph Frey asks everyone who comes into his office to fill out an initial questionnaire. Usually these are done by hand at the office. I took mine home and filled it out then typed and saved it on the computer. In this questionnaire one of the questions (number 10) asks if you have ever been arrested. My answer was "yes". I went on to explain the details... which was many years ago back in college. I have this documentation and a copy was given to Dr. Frey prior to the evaluation starting... In Dr. Frey's custody evaluation (page 8, last paragraph) Frey states, "The father has had no history of being arrested. These facts seem small but in court and on the stand, I would look like a liar once again because Dr. Joseph Frey changed information to make it appear that way. If I did not have the documentation I would really be in trouble. This man sometimes has say-so into where people's children get placed yet he himself changes information to get results he wants. Wow.

I stand by what I stated and I have the information/documentation to prove this. Other psychologist have evaluated this evaluation and say it violated APA standards. I am a licensed psychologist who specializes in performing court-ordered custody evaluations in Augusta, GA. I am used to having at least one, but often, both parents upset and angry with me because by the time two parents fight over children and the court becomes involved, neither one is going to get his/her way. This is such a customer. As charged by the court, my job is to do what is in a child's best interest. The choice is often very difficult and it takes many hours of interviewing, report writing, and consultations with other court personnel (lawyers, guardian ad litems) to reach a decision. The complainant believes that his allegations of child abuse were correct; however, I was in disagreement with him as were others involved in the case (he is not correct in stating that others agreed with him). In fact, DFACS and Child Protective Services did not have substaniation that abuse had occurred. He states that I purposefully misquoted him to have the evaluation turn out like I wanted. This is also untrue and I was prepared to testify to the accuracy of my report in court. Also, the complainant has one of the best and most respected lawyers in Augusta. I would never expose myself to providing him with falsified testimony as it would make a mockery of me on the stand and endanger my reputation. His complaint that I ignored DUI information is correct, but only because I was also lied to about that. However, faith in the legal system finally disclosed that piece of information. Finally, the complainant states that I "got caught." This is untrue. The complainant filed a complaint to the Georgia Board of Professional Psychologists. Their findings were that I engaged in no wrongdoing or unethical behavior and cleared me of the complaint. In summary, the complainant is unhappy because he did not prevail in the child custody evaluation and feels that I misrepresented him in my report. In my opinion, I did a professional job, provided the court with a valuable report, and met the Court's order for recommendations.
