Editor’s Comment: 04/19/2019 -.  Ripoff Report believes in transparency and the more information the better.  In this instance, there has been court action regarding this subject Report.  We believe it important to note that not all Court Orders are alike.  Many court orders are absolutely legitimate and we make no representations about this court order situation However, we want our users to be aware that sometimes courts enter orders based upon default which typically means that the defendant didn’t show up.  Sometimes a defendant won’t show up because they didn’t even get notice of the case proceedings in the first place and other times defendants may not show up because they don’t necessarily have the knowledge and/or the financial resources to fight.  Still, in other instances, a defendant may simply appear only to stipulate (settle) the case by agreeing to stipulate to a court order because they are being bullied by the plaintiff and whether what they said was true or not, they just want the matter to go away so they can move on with life and make the plaintiff go away.  Again, we make no representations about this particular court order situation.  We are simply providing you with additional information so that you may be more informed and, coupled with any additional research you feel is necessary, may make your own informed decision regarding the validity of this Report.  As always, we encourage our readers to do their homework and not just rely on one single source for information.  Google, through the Lumen Database, has provided the following document relating to this subject Report:

Contacted David Chupp to purchase a mini schnauzer puppy for our 4 children for Christmas! We set up the pick up & purchase for the day after Christmas 2016. When we arrived, David came out, ran to the barn & returned w/a puppy. We went inside his house to pay & David proceeded to tell us that the puppy had an ear infection & he had just put drops in his ear,& that's what was causing the dog to have a tilt in his head! He also told us that the puppy had never been on grass before so that's why he was acting skittish! The puppy would pull back each time you went to pet him! He assured us the puppy would be fine once we got him home and he got acclimated! We payed & left! The whole process took about 10 minutes! We left David's w/the puppy we called Martin! During our 3hour ride home the puppy got sick & vomited all over my wife. We just chalked it up to car sickness. We stopped one time to clean my wife up from the vomit, I took Martin & set him on the ground just outside the car, my wife was afraid he would run if I did so,but he never moved an inch!! We got him home & he finally came around and was a great addition to our family! (5months old at time of purchase). Everything going well, fast forward 4 months. My wife came home for lunch to get Martin & take him to work with/her as she always did daily, found Martin covered in vomit! She immediately scooped him up & took him to our local vet 2minutes away! The vet said Martin was having a seizure! She treated him for that & said it may never happen again or it could happen periodically! Once Martin was stable enough to bring home, my wife did so! Martin's condition never improved! I came home early from work to find Martin w/a severe head tilt & could not walk or maintain his balance! We continued to watch over him & in the next 3 hrs he had gotten dramatically worse! My son & I rushed him to the Emergency vet in Indianapolis! They took him back & got him stabilized! After being checked, the vet came out to tell me me he did not know what was wrong! I paid $1000.00 to them to keep him for up to 3 nights! They said they would keep him stabile through the night & see if he would improve & call me in the morning w/an update. So, the next morning they call my wife to tell her he has not improved& they recommend we take him to a Neurologist in Fishers Indiana. My wife drives to the emergency vet to get Martin to take him to the neurologist. She arrives & tells the technician she is there to get Martin, so the girl goes to the back to get Martin & comes out to tell my wife that he just stopped breathing!! So, as you can imagine, we are devastated! We tell our 4 little children that their puppy has died! The most heart wrenching thing ever! I called David to see if here were guarantees w/his puppies( I acted like I was interested in another puppy to get him to answer my questions) he said yes,& that's when I proceeded to tell him I was the owner of Martin & that he had passed! He said I would have to have an autopsy done to prove that it was genetic. He then tells me that he will give me a discount on another puppy! I would never buy a puppy from this guy! He is a wolf in sheep's clothing! Be aware of David Chupp! He is a heartless thief!

There's always two sides to a story. We in fact did sell the schnauzer puppy to this family. However when he called me to act like he was interested in purchasing a puppy from me I was not too impressed. We always answer our phone calls and stand behind our puppies that may have health problems that are or come from genetic disorders. All he needed to do was tell me why he's calling instead doing it the way he did. I discussed with him what happened and since we as breeders never know exactly what happened with a puppy, we needed proof with an autopsy from a veterinarian stating the cause of death.

If it was his fault we can't be responsible for it. However if was something genetically wrong with the puppy I told him we'd either refund his money or give him a replacement puppy. However if he chose NOT to do an autopsy I'd still give him another puppy at a reduced cost to help him out. He said he'd let me know but never got back to me. I assumed he chose to not get the proof I needed, and any breeder needs, so that we can fulfill the warranty on the puppy.

It's unfortunate that he chose this route instead of trying to find a workable solution. He also mentioned that the puppy wasn't used to the grass. It was mid December when he picked him up so yes he'd not been outside much do to the weather. As he mentioned he turned into a nice companion for his children and it was a very unfortunate thing to have to happen to them. We've bred puppies for 10 years and we stand behind the health of our puppies but can't do anything without some evidence that it's our fault. There's multiple reasons a dog can die including eating something that is toxic to their bodies. I wish the family the best. Dave.
