I hope that I am not too late. I was served with foreclosure paperwork, just like you, only not just on my primary residence but also on my investment homes. You have 20 days in which to reply to the court and the attorney that sent you the papers. I have replied up to 2 months later. If you do not reply, then you basically forfeit your right to be present at the hearing and neither the court nor the attorney are obligated to give you the court date or any further correspondence about your home--except when to move out. After you submit your reply to the court, it may take several months to get a court date. Call the clerk of court for your county every month on the first to see if you are on the schedule for a court date. On 2 of my properties, I was never notified about the court dates and the judge set up the sale of the house for 30 days after the court date. I was able to call the judge's secretary and ask her what to do and she told me to file a motion asking for the judge to "vacate the judgment" because I was not properly notified of the court date and therefore not allowed the opportunity to attend court and defend myself. I was able to type it up and fax it to her and she delivered it to the judge. Immediately, the judge issued the opposing counsel (whom Countrywide had hired--some law firm out of Tampa that is basically a foreclosure assembly line for the entire state of FL) to tell them that he was vacating the judgment against me and to basically start the whole process all over again. It has been over a year now and Countrywide still hasn't foreclosed on the 2 properties! I have tried numerous times to contact them and have tried in vain to "work out" a payment plan but I really don't think they want that. I was told by an insurance adjuster and mortgage financier that if Countrywide forecloses on your house that the investors get paid because they have prepurchased an insurance policy on your mortgage. It's called foreclosure insurance and it actually pays the investor RIGHT NOW, if they foreclose on your property. That means that the investor would get their money immediately instead of waiting for your to pay your mortgage and then at the end of your loan, you would be paying your past due payments. There are a bunch of web sites to visit that will explain what you should put on your reply to the court. Please let me know if this was at all helpful. Countrywide has foreclosed on me twice once in 2007 and just last month. No notification. Found out by someone coming to my door wanting to purchase my home. I thought it was cute until I remembered what happened in 2007. Sure enough he said that I was in foreclosure. Counrywide had filed and I new nothing about it. I was on a repayment schedule with them never missed a payment. What happened was someone at Countrywide posted my home loan payment to my Home Equity Line of Credit. By the time I called Countrywide to find out what was going on they said I was in foreclosure and gave me a rediculas amount due. I am only past due 2 payments. Anyway If you are running out of time and foreclosure is right on your tale. The best alternative is to call them and say you want to set up a repayment plan. They will ask you all kinds of financial information. They will want to make sure that you can make the payments. You will have to make a full monthly payment and a partial paymet. But at least it gives you a little time to figure something else out. They are not moving on modifications, seems to me that they are trying to foreclose on homes. I have been trying since 2006 to get my payments straightened out with them. When I asked the girl to move the payment that they posted to my home equity to my mortgage. She actually said that I would have to prove it was Countrywides error. After faxing all info to her she still refused saying she was not sure if the last number in the memo field was a 3 or 2. And would not do it. Even with a perfectly clear receipt. I hate Countrywide they are crooks. Just make sure that you tell them you have enough income to make the payments. They will set you up.
