In preparation for the birth of our daughter in June 2008, my wife contacted Countrywide in Feb of that last year. They told her that they could put us in a Hardship/Forebearance program that would delay our mortgage payments for 4 mos. while she was on Maternity leave.

This sounded great as we are a dual income family and without one income it would be hard to make payments. The rep told us that after she went back to work we would negotiate how to catch up. Whether that be adding the amount to the end of our loan or making larger payments.

We jumped at the chance for this.

When my wife went back to work in Sept. the top item on our list of priorities was to get our mortgage taken care of. We called Countrywideand they told us that a negotiater would be in contact with us. About a month later we called again with the same answer. This is the same thing we have done for the past several months with the same answer every time. They said not to make any payments that it would go to the principal and not to the past due balance. The last contact before now was in January. We were told that they were so busy with the Mortgage Crisis that we would be dealt with soon.

On March 17, 2009 my wife was in a Head-On car accident. Luckily by the hand of God, my wife was not hurt. The accident was not her fault, but the car was totalled . My wife called the bank to see about getting a loan and because of this mortgage thing our credit is ruined.

At this time she decided to got to a Countrywide branch and sit until she got it taken care of. When she went of course nobody at the office could do anything but her on the phone.

The rep informed my wife that our home is in foreclosure, and would be sold May 5, 2009. We were devistated of course. We have the money in savings to pay the arrearages. We just have been told not to pay. Over the past few days we have spoken to an attourney, and contacted several different people at Countrywide with no help.

I told them "I want to pay my mortgage. I don't want to file for Bankruptcy." I asked for them to tell me who , where , and what to pay. They can't give me any info. They claim we were offered modification. Which we never received. They claim that we were sent notices of foreclosure which we never received.

I read that it is the law to send certified mail(signature required)before foreclosure can start. When I mentioned this to the Countrywide rep she agreed then when I told her that we never received it, she changed her story saying that we must have gotten it. I explained to her that this alone was grounds for litigation. She told me to do what I needed.

Suprisingly when we got home today there were four diferent letters stating foreclosure. When we called they said our file is still in foreclosure for May 5, but we were being considered for modification.

We asked when we would know if we qualified the rep said to call back in 30 days. That is 9 days before our house is to be sold. This is Ridiculous! I just want to pay my mortgage! I can afford my mortgage! We both have Jobs! Why can we not get this resolved!

Anyone that can Help please contact me. I am desperate. We don't want to lose our home, we dont want to file ch 13 and ruin our credit for years over a mistake by a Scandalous company.

Help for people that are being foreclosed on with proper notification, ESPECIALLY FROM COUNTRYWIDE!!! They are the worst!

I hope that I am not too late. I was served with foreclosure paperwork, just like you, only not just on my primary residence but also on my investment homes. You have 20 days in which to reply to the court and the attorney that sent you the papers. I have replied up to 2 months later. If you do not reply, then you basically forfeit your right to be present at the hearing and neither the court nor the attorney are obligated to give you the court date or any further correspondence about your home--except when to move out. After you submit your reply to the court, it may take several months to get a court date. Call the clerk of court for your county every month on the first to see if you are on the schedule for a court date. On 2 of my properties, I was never notified about the court dates and the judge set up the sale of the house for 30 days after the court date. I was able to call the judge's secretary and ask her what to do and she told me to file a motion asking for the judge to "vacate the judgment" because I was not properly notified of the court date and therefore not allowed the opportunity to attend court and defend myself. I was able to type it up and fax it to her and she delivered it to the judge. Immediately, the judge issued the opposing counsel (whom Countrywide had hired--some law firm out of Tampa that is basically a foreclosure assembly line for the entire state of FL) to tell them that he was vacating the judgment against me and to basically start the whole process all over again. It has been over a year now and Countrywide still hasn't foreclosed on the 2 properties! I have tried numerous times to contact them and have tried in vain to "work out" a payment plan but I really don't think they want that. I was told by an insurance adjuster and mortgage financier that if Countrywide forecloses on your house that the investors get paid because they have prepurchased an insurance policy on your mortgage. It's called foreclosure insurance and it actually pays the investor RIGHT NOW, if they foreclose on your property. That means that the investor would get their money immediately instead of waiting for your to pay your mortgage and then at the end of your loan, you would be paying your past due payments. There are a bunch of web sites to visit that will explain what you should put on your reply to the court. Please let me know if this was at all helpful. I have so much more that I could tell you, from the school of hard knocks--mostly by Countrywide, if you are interested. Good Luck.

Countrywide has foreclosed on me twice once in 2007 and just last month. No notification. Found out by someone coming to my door wanting to purchase my home. I thought it was cute until I remembered what happened in 2007. Sure enough he said that I was in foreclosure. Counrywide had filed and I new nothing about it. I was on a repayment schedule with them never missed a payment. What happened was someone at Countrywide posted my home loan payment to my Home Equity Line of Credit. By the time I called Countrywide to find out what was going on they said I was in foreclosure and gave me a rediculas amount due. I am only past due 2 payments. Anyway If you are running out of time and foreclosure is right on your tale. The best alternative is to call them and say you want to set up a repayment plan. They will ask you all kinds of financial information. They will want to make sure that you can make the payments. You will have to make a full monthly payment and a partial paymet. But at least it gives you a little time to figure something else out. They are not moving on modifications, seems to me that they are trying to foreclose on homes. I have been trying since 2006 to get my payments straightened out with them. When I asked the girl to move the payment that they posted to my home equity to my mortgage. She actually said that I would have to prove it was Countrywides error. After faxing all info to her she still refused saying she was not sure if the last number in the memo field was a 3 or 2. And would not do it. Even with a perfectly clear receipt. I hate Countrywide they are crooks. Just make sure that you tell them you have enough income to make the payments. They will set you up.
